Medical errors can change a patient’s life. A medical malpractice lawyer in Turkey investigates what went wrong, obtains expert evidence and claims compensation from the doctor, the private hospital or the state. We represent Turkish and foreign patients, including health tourists who were treated in Turkey and have returned home.
Medical Malpractice Lawyer
Medical malpractice lawyer Istanbul: we investigate surgical errors, misdiagnosis, birth injuries and dental or cosmetic surgery complications, obtain expert evidence and claim compensation from doctors, private hospitals and the state, including for patients who have returned home.
Types of Medical Malpractice Cases
- surgical errors: wrong-site surgery, damage to organs or nerves, retained instruments,
- misdiagnosis and delayed diagnosis, including cancer and stroke,
- birth injuries to mother or child,
- anaesthesia and medication errors,
- hospital-acquired infections due to inadequate hygiene,
- lack of informed consent about risks and alternatives.
For specific procedures, see our dedicated guides on dental malpractice and botched cosmetic surgery and hair transplants.
Private Hospital or Public Hospital?
- Private hospitals and doctors: the patient relationship is generally treated as a consumer transaction, so compensation claims are usually heard by the consumer courts.
- Public and university hospitals: the claim is brought against the administration, first by an application to the institution and then by a full remedy action before the administrative court.
A criminal complaint for negligent injury or death can be filed alongside the civil claim.
Evidence and Expert Reports
Medical malpractice cases depend on expert opinion. We obtain your complete medical records, imaging and test results, and the court appoints experts, usually university specialists or the Council of Forensic Medicine. We often have the file reviewed by an independent specialist before filing.
Compensation
Patients can claim treatment and care costs, loss of earnings and working capacity, and moral damages. In fatal cases, dependants can claim loss of support and moral damages.
Time Limits
Time limits vary: claims against private doctors and hospitals and claims against public hospitals are subject to different periods, and criminal complaints for simple negligent injury have a short six-month complaint period. Get advice as early as possible. We offer a free short preliminary consultation.
Can I sue a hospital in Turkey for malpractice?
Yes. Claims against private hospitals are usually heard by consumer courts; claims against public hospitals go to the administrative courts after an application to the institution.
What compensation can I claim?
Treatment and care costs, loss of earnings and working capacity, and moral damages; in fatal cases, loss of support for dependants.
How is malpractice proven?
Through medical records and an expert report, usually from university specialists or the Council of Forensic Medicine.
Can I claim from abroad?
Yes. Your lawyer can act under a power of attorney and you rarely need to travel.
Is lack of informed consent malpractice?
It can be. Doctors must inform patients of the risks and alternatives; failure to do so can ground liability.

Can I also file a criminal complaint?
Yes, for negligent injury or death, alongside the compensation claim.
Do you handle dental and cosmetic surgery cases?
