Kanunda tan\u0131mland\u0131\u011f\u0131 \u00fczere ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler \u00fczerinde kurulan m\u00fclkiyet hakk\u0131 olarak d\u00fczenlenmi\u015ftir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kat Maliki Nedir?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kat maliki, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler \u00fczerinde bu hakka sahip olanlar olarak tan\u0131mlanm\u0131\u015ft\u0131r. Yani Kat M\u00fclkiyeti Kanununa g\u00f6re yap\u0131m\u0131 tamamlanm\u0131\u015f ve kullan\u0131ma haz\u0131r bir binan\u0131n ba\u011f\u0131ms\u0131z alanlar\u0131 \u00fczerindeki kat m\u00fclkiyeti hakk\u0131na sahip ki\u015filere denir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kat M\u00fclkiyeti ve Kat \u0130rtifak\u0131 Aras\u0131ndaki Fark Nedir?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Yukar\u0131da de\u011findi\u011fimiz \u00fczere kat m\u00fclkiyeti ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler \u00fczerinde kurulan m\u00fclkiyet hakk\u0131d\u0131r. Kat irtifak\u0131 da bir tapu \u00e7e\u015fididir. Bir arsa \u00fczerinde ileride kat m\u00fclkiyetine konu olacak in\u015faata y\u00f6nelik bir veya birden \u00e7ok yap\u0131n\u0131n ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerinde yani hen\u00fcz tamamlanmam\u0131\u015f bir in\u015faat\u0131n hak sahiplerinin paylar\u0131n\u0131 belirtmek ve g\u00f6stermek amac\u0131 ile haz\u0131rlanan bir tapu \u00e7e\u015fididir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Giri\u015f Katta Oturanlar Asans\u00f6r Paras\u0131n\u0131 \u00d6demek Zorunda M\u0131?\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">Giri\u015f katta oturan kirac\u0131 asans\u00f6r paras\u0131 \u00f6der mi? Bu soru genelde kirac\u0131lar ile ev sahipleri aras\u0131nda tart\u0131\u015fma konusudur.<\/p>\n<p style=\"text-align: justify;\">Asans\u00f6r bak\u0131m \u00fccretinin kim taraf\u0131ndan \u00f6denece\u011fi KMK&#8217;da d\u00fczenlenmi\u015ftir. Kat maliklerinden her birinin KMK m.20 uyar\u0131nca genel giderlere kat\u0131lma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc vard\u0131r.<\/p>\n<p style=\"text-align: justify;\">Dolay\u0131s\u0131yla nerde oturdu\u011fu fark etmeksizin<strong> giri\u015f katta oturan kirac\u0131 veya kat maliki<\/strong> de\u00a0her kat maliki gibi <strong>asans\u00f6r paras\u0131 \u00fccreti ve aidat\u0131n\u0131 \u00f6demek zorundad\u0131r.<\/strong> Asans\u00f6rler binan\u0131n ortak kullan\u0131m alan\u0131 olmas\u0131 sebebiyle ortak \u00fccrete tabidir. Bunun i\u00e7in giri\u015f kat\u0131, bodrum kat\u0131 gibi konumlar \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc ortan kald\u0131rmaz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Asans\u00f6r Bak\u0131m \u00dccretini Kirac\u0131 M\u0131 \u00d6der?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Asans\u00f6r bak\u0131m \u00fccretini kim \u00f6der?<\/p>\n<p style=\"text-align: justify;\">Asans\u00f6r\u00fcn servis ve elektrik<strong> bak\u0131m \u00fccretleri ile y\u0131ll\u0131k periyodik muayene<\/strong> bedellerini <b>kirac\u0131 \u00f6der. <\/b><\/p>\n<p style=\"text-align: justify;\"><strong>Asans\u00f6r de\u011fi\u015fimi ya da yeni par\u00e7a ilavesi<\/strong> gibi masraflar\u0131 ise<b> kat maliki yani ev sahibi \u00f6deyecektir.\u00a0<\/b><\/p>\n<h2 style=\"text-align: justify;\"><strong>Ev Sahibi Aidat \u00d6demezse Ne Olur?<\/strong><\/h2>\n<p style=\"text-align: justify;\">KMK m.20 c bendinde a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere kat malikleri bunlardan faydalanmaya (asans\u00f6r, kap\u0131c\u0131) l\u00fczum ve ihtiya\u00e7 bulunmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrmek suretiyle bu gider ve avans pay\u0131n\u0131 \u00f6demekten ka\u00e7\u0131namaz. Aidatlar\u0131n\u0131\u00a0\u00f6demeyen kat maliki hakk\u0131nda, di\u011fer kat maliklerinden her biri veya y\u00f6netici taraf\u0131ndan, y\u00f6netim plan\u0131na, bu Kanuna ve genel h\u00fck\u00fcmlere g\u00f6re dava a\u00e7\u0131labilir, icra takibi yap\u0131labilir. Gider ve avans pay\u0131n\u0131n tamam\u0131n\u0131 \u00f6demeyen kat maliki \u00f6demede gecikti\u011fi g\u00fcnler i\u00e7in ayl\u0131k y\u00fczde be\u015f hesab\u0131yla gecikme<br \/>\ntazminat\u0131 \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kat Malikleri Kurulu Karar\u0131n\u0131n \u0130ptali\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kat malikleri kurulu toplant\u0131s\u0131na herhangi bir sebeple kat\u0131lmayan kat maliklerinden her biri iptal davas\u0131 a\u00e7abilmektedir. Toplant\u0131ya kat\u0131lan kat maliklerinin iptal davas\u0131 a\u00e7abilmesi i\u00e7in ise al\u0131nan karar\u0131n aleyhine oy kullan\u0131lm\u0131\u015f olmalar\u0131 gerekmektedir. Kat M\u00fclkiyeti Kanunu m.33\/1 uyar\u0131nca toplant\u0131da aleyhe oy kullanan her kat maliki karar tarihinden ba\u015flayarak bir ay i\u00e7inde, toplant\u0131ya kat\u0131lmayan her kat maliki karar\u0131 \u00f6\u011frenmesinden ba\u015flayarak bir ay i\u00e7inde ve her halde karar tarihinden ba\u015flayarak alt\u0131 ay i\u00e7inde ana gayrimenkul\u00fcn bulundu\u011fu yerdeki sulh mahkemesine iptal davas\u0131 a\u00e7abilir.<\/p>\n<p style=\"text-align: justify;\">\u00d6rne\u011fin kat malikleri kurulunda y\u00fcksek bir aidat karara ba\u011fland\u0131 ve bu karara itiraz etmek istiyorsunuz. Bu durumda kat malikleri kurulunca verilen bu\u00a0 karar aleyhine kurul toplant\u0131s\u0131na kat\u0131lan fakat ayk\u0131r\u0131 oy kullanan her kat maliki karar tarihinden ba\u015flayarak1 ay i\u00e7inde ve her halde karar tarihinden ba\u015flayarak 6 ay i\u00e7inde i\u00e7inde ana gayrimenkul\u00fcn bulundu\u011fu yerdeki sulh mahkemesine iptal davas\u0131 a\u00e7abilir.<\/p>\n<p style=\"text-align: justify;\">Son olarak toplant\u0131daki karar kanun koyucu nezdinde \u201cyok\u201d say\u0131lan veya \u201cmutlak butlan\u201d ile h\u00fck\u00fcms\u00fcz kabul edilen bir karar ise bu kararlar herhangi bir s\u00fcreye ba\u011fl\u0131 olmadan da iptalinin istenebilece\u011fini d\u00fczenlemi\u015ftir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kat Malikleri Gelir Gider Defterini \u0130nceleyebilir Mi?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kat M\u00fclkiyeti Kanunu m.38&#8217;de y\u00f6neticin hesap verme sorumlulu\u011fu d\u00fczenlenmi\u015ftir. Buna g\u00f6re y\u00f6netim plan\u0131nda yaz\u0131l\u0131 zamanlarda defter inceleme i\u00e7in bir zaman belirlenmi\u015fse o zamanda, e\u011fer b\u00f6yle bir zaman yaz\u0131lmam\u0131\u015fsa her takvim y\u0131l\u0131n\u0131n birinci ay\u0131 i\u00e7inde kat malikleri kuruluna o tarihe kadar elde edilen gelirlerin ve yap\u0131lm\u0131\u015f olan giderlerin hesab\u0131n\u0131 vermekle y\u00fck\u00fcml\u00fcd\u00fcr. Yani kat maliklerinde her biri istedi\u011fi zaman gelir gider defterlerini inceleme yetkisi yoktur. Ancak kat maliklerinin yar\u0131s\u0131 isterse, bunlar\u0131n arsa paylar\u0131 ne olursa olsun y\u00f6netim plan\u0131nda yaz\u0131l\u0131 zamanlar d\u0131\u015f\u0131nda da hesab\u0131n g\u00f6sterilmesi y\u00f6neticiden istenebilmektedir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kat Malikleri Kurulu Toplant\u0131 Yeter Say\u0131s\u0131?<\/strong><\/h2>\n<p style=\"text-align: justify;\">KMK m.30&#8217;da toplant\u0131 yeter say\u0131s\u0131 d\u00fczenlenmi\u015ftir. Kat malikleri kurulu, kat maliklerinin say\u0131 ve arsa pay\u0131 bak\u0131m\u0131ndan yar\u0131s\u0131ndan 1 fazlas\u0131yla toplan\u0131r ve oy \u00e7oklu\u011fuyla karar verir. \u00f6rne\u011fin 100 daire varsa 51 dairenin maliki toplant\u0131ya kat\u0131lmas\u0131 gerekir. Yeter say\u0131n\u0131n sa\u011flanamamas\u0131 nedeniyle ilk toplant\u0131n\u0131n yap\u0131lamamas\u0131 halinde, ikinci toplant\u0131, en ge\u00e7 15 g\u00fcn sonra yap\u0131l\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Ana Gayrimenkul\u00fcn Genel Giderleri Nelerdir?<\/strong><\/h2>\n<p style=\"text-align: justify;\">KMK m.20 a ve b bentleri uyar\u0131nca kat maliklerinden her biri <strong>aralar\u0131nda ba\u015fka t\u00fcrl\u00fc anla\u015fma olmad\u0131k\u00e7a<\/strong>:<br \/>\na) Kap\u0131c\u0131, kaloriferci, bah\u00e7\u0131van ve bek\u00e7i giderlerine ve bunlar i\u00e7in toplanacak avansa e\u015fit olarak;<br \/>\nb) Ana gayrimenkul\u00fcn sigorta primlerine ve b\u00fct\u00fcn ortak yerlerin bak\u0131m, koruma, g\u00fc\u00e7lendirme ve onar\u0131m giderleri ile y\u00f6netici ayl\u0131\u011f\u0131 gibi di\u011fer giderlere ve ortak tesislerin i\u015fletme giderlerine ve giderler i\u00e7in toplanacak avansa kendi arsa pay\u0131 oran\u0131nda kat\u0131lmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p style=\"text-align: justify;\">Genel giderlere kat\u0131lma konusu a bendine g\u00f6re her kat maliki i\u00e7in <strong>e\u015fit<\/strong>, b bendine g\u00f6re <strong>arsa pay\u0131 oran\u0131nda<\/strong> kat\u0131lma \u015feklinde olmaktad\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Y\u00f6neticinin G\u00f6revleri Nelerdir?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Y\u00f6neticinin g\u00f6revleri KMK&#8217;da genel y\u00f6netim i\u015fleri, defter ve belge tutma i\u015fleri ve i\u015fletme projesinin yap\u0131lmas\u0131 \u015feklinde 3 ba\u015fl\u0131kta d\u00fczenlenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\"><strong>Genel y\u00f6netim i\u015fleri:<\/strong><\/p>\n<p style=\"text-align: justify;\">\u2013 Y\u00f6neticinin g\u00f6revleri, y\u00f6netim plan\u0131nda belirtilir; y\u00f6netim plan\u0131nda aksine h\u00fck\u00fcm olmad\u0131k\u00e7a, y\u00f6netici a\u015fa\u011f\u0131daki i\u015fleri g\u00f6r\u00fcr:<br \/>\na) Kat malikleri kurulunca verilen kararlar\u0131n yerine getirilmesi;<br \/>\nb) Ana gayrimenkul\u00fcn gayesine uygun olarak kullan\u0131lmas\u0131, korunmas\u0131, bak\u0131m\u0131 ve onar\u0131m\u0131 i\u00e7in gereken tedbirlerin al\u0131nmas\u0131;<br \/>\nc) Ana gayrimenkul\u00fcn sigorta ettirilmesi;<br \/>\nd) Ana gayrimenkul\u00fcn genel y\u00f6netim i\u015fleriyle korunma, onar\u0131m, temizlik gibi bak\u0131m i\u015fleri ve asans\u00f6r ve kalorifer, s\u0131cak ve so\u011fuk hava i\u015fletmesi ve sigorta i\u00e7in y\u00f6netim plan\u0131nda g\u00f6sterilen zamanda, e\u011fer b\u00f6yle bir zaman g\u00f6sterilmemi\u015fse, her takvim y\u0131l\u0131n\u0131n ilk ay\u0131 i\u00e7inde, kat maliklerinden avans olarak m\u00fcnasip miktarda paran\u0131n toplanmas\u0131 ve bu avans\u0131n harcan\u0131p bitmesi halinde, geri kalan i\u015fler i\u00e7in tekrar avans toplanmas\u0131;<br \/>\ne) Ana gayrimenkul\u00fcn y\u00f6netimiyle ilgili di\u011fer b\u00fct\u00fcn \u00f6demelerin kabul\u00fc, y\u00f6netim dolay\u0131s\u0131yla do\u011fan bor\u00e7lar\u0131n \u00f6denmesi ve kat malikleri taraf\u0131ndan ayr\u0131ca yetkili k\u0131l\u0131nm\u0131\u015fsa, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlere ait kiralar\u0131n toplanmas\u0131;<br \/>\nf) Ana gayrimenkul\u00fcn t\u00fcm\u00fcn\u00fc ilgilendiren tebligat\u0131n kabul\u00fc;<br \/>\ng) Ana gayrimenkul\u00fc ilgilendiren bir s\u00fcrenin ge\u00e7mesinden veya bir hakk\u0131n kayb\u0131na meydan vermeyecek gerekli tedbirlerin al\u0131nmas\u0131;<br \/>\nh) Ana gayrimenkul\u00fcn korunmas\u0131 ve bak\u0131m\u0131 i\u00e7in kat maliklerinin yarar\u0131na olan hususlarda gerekli tedbirlerin, onlar ad\u0131na al\u0131nmas\u0131;<br \/>\ni) Kat m\u00fclkiyetine ili\u015fkin bor\u00e7 ve y\u00fck\u00fcmlerini yerine getirmeyen kat maliklerine kar\u015f\u0131 dava ve icra takibi yap\u0131lmas\u0131 ve kanuni ipotek hakk\u0131n\u0131n kat m\u00fclkiyeti k\u00fct\u00fc\u011f\u00fcne tescil ettirilmesi;<br \/>\nj) Toplad\u0131\u011f\u0131 paralar\u0131 ve avanslar\u0131 yat\u0131rmak ve gerekti\u011finde almak \u00fczere muteber bir bankada kendi ad\u0131na ve fakat ana gayrimenkul\u00fcn y\u00f6netici s\u0131fat\u0131 g\u00f6sterilmek suretiyle, hesap a\u00e7t\u0131r\u0131lmas\u0131;<br \/>\nk) Kat malikleri kurulunun toplant\u0131ya \u00e7a\u011f\u0131r\u0131lmas\u0131.<br \/>\nl) ) Ana gayrimenkulde bulunan asans\u00f6rlerin g\u00fcvenli bir \u015fekilde i\u015fletilmesinin sa\u011flanmas\u0131 amac\u0131yla ayl\u0131k bak\u0131mlar\u0131 ile y\u0131ll\u0131k kontrollerinin ilgili teknik d\u00fczenlemelere uygun \u015fekilde yapt\u0131r\u0131lmas\u0131 ve bu i\u015flemlere ili\u015fkin \u00fccretlerin \u00f6denmesi. Bu Kanunun 34 \u00fcnc\u00fc maddesinde belirtilen \u015fartlar\u0131 ta\u015f\u0131mas\u0131na ra\u011fmen y\u00f6netici atamas\u0131 yap\u0131lmayan ana gayrimenkulde, birinci f\u0131krada say\u0131lan i\u015flerin yapt\u0131r\u0131lmas\u0131ndan kat malikleri m\u00fc\u015ftereken sorumludur.<\/p>\n<p style=\"text-align: justify;\"><strong>Defter ve belge tutma i\u015fleri:<\/strong><\/p>\n<p style=\"text-align: justify;\">Y\u00f6netici, kat malikleri kurulunun kararlar\u0131n\u0131 protokolleri, yap\u0131lan ihtar ve tebligat\u0131n \u00f6zetini ve tarihlerini ve b\u00fct\u00fcn giderleri, 32.maddede s\u00f6z\u00fc ge\u00e7en deftere tarih<br \/>\ns\u0131ras\u0131yla yazmaya ve bu defteri ve giderlerin belgeleriyle di\u011fer b\u00fct\u00fcn belgeleri bir dosyada saklamaya mecburdur. Bu defterin, her takvim y\u0131l\u0131n\u0131n bitmesinden ba\u015flayarak bir ay i\u00e7inde y\u00f6netici taraf\u0131ndan<br \/>\nnotere kapatt\u0131r\u0131lmas\u0131 mecburidir. Bu maddede yaz\u0131l\u0131 g\u00f6revleri yerine getirmeyen y\u00f6neticiye 33.maddenin son f\u0131kras\u0131nda yaz\u0131l\u0131 cezalar uygulan\u0131r.<\/p>\n<p style=\"text-align: justify;\"><strong>\u0130\u015fletme projesinin yap\u0131lmas\u0131:<\/strong><\/p>\n<p style=\"text-align: justify;\">Kat malikleri kurulunca kabul edilmi\u015f i\u015fletme projesi yoksa, y\u00f6netici gecikmeksizin bir i\u015fletme projesi yapar.<br \/>\nBu projede \u00f6zellikle:<br \/>\na) Ana gayrimenkul\u00fcn bir y\u0131ll\u0131k y\u00f6netiminde tahmini olarak gelir ve gider tutarlar\u0131;<br \/>\nb) T\u00fcm giderlerden her kat malikine, bu Kanunun 20. maddesindeki esaslara g\u00f6re d\u00fc\u015fecek tahmini miktar;<br \/>\nc) Tahmini giderlerle di\u011fer muhtemel giderleri kar\u015f\u0131lamak \u00fczere her kat malikinin 20.maddedeki esaslara g\u00f6re vermesi gereken avans tutar\u0131 g\u00f6sterilir.<br \/>\nBu proje kat maliklerine veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden fiilen yararlananlara, imzalar\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda veya taahh\u00fctl\u00fc mektupla bildirilir. Bildirimden ba\u015flayarak yedi g\u00fcn i\u00e7inde projeye itiraz edilirse durum kat malikleri kurulunda incelenir ve proje hakk\u0131nda, karar verilir, gerekirse yeni bir proje haz\u0131rlan\u0131r.<br \/>\nKesinle\u015fen i\u015fletme projeleri veya kat malikleri kurulunun i\u015fletme giderleri ile ilgili kararlar\u0131, \u0130cra ve \u0130flas Kanununun 68 inci maddesinin 1.f\u0131kras\u0131nda belirtilen belgelerden say\u0131l\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Y\u00f6neticinin Sorumlulu\u011fu<\/strong><\/h2>\n<p style=\"text-align: justify;\">Y\u00f6neticilerin yetkilerinin yan\u0131nda ger\u00e7ekle\u015ftirdikleri fiiller nedeniyle hukuki ve cezai sorumluluklar\u0131 da vard\u0131r. Y\u00f6neticinin defterleri ger\u00e7e\u011fe ayk\u0131r\u0131 tutmas\u0131 veya toplanan paralar\u0131 zimmetine ge\u00e7irmesi gibi fiilleri onun cezai sorumlulu\u011funu do\u011furmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Y\u00f6neticinin hukuki sorumluluklar\u0131na gelince KMK m.38 gere\u011fince y\u00f6netici kat maliklerine kar\u015f\u0131 aynen bir vekil gibi sorumludur. Kanunun bu h\u00fckm\u00fc nedeniyle, y\u00f6netici ile kat malikleri aras\u0131ndaki ili\u015fki vekalet ili\u015fkisidir. E\u011fer y\u00f6netici kat maliklerin kar\u015f\u0131 g\u00f6revlerini yerine getirmezse kat malikleri y\u00f6neticiden tazminat talebinde bulunabilece\u011fi gibi yerine getirmedi\u011fi g\u00f6revin ifas\u0131n\u0131 da talep edebilme hakk\u0131 vard\u0131r.<\/p>\n<p style=\"text-align: justify;\">Son olarak kat maliklerinin y\u00f6neticiyi azletme hakk\u0131 vard\u0131r. Y\u00f6netici g\u00f6revlerini yerine getirmedi\u011fi takdirde kat malikleri kurulu toplanarak y\u00f6neticiyi azledebilmektedir. Bunun i\u00e7in illa haks\u0131z bir fiil \u015fart\u0131 yoktur bu hak her zaman kat malikleri kurulunda mevcuttur.
