Tahliye karar\u0131 gere\u011fi ta\u015f\u0131nmaz\u0131n tahliyesine gidildi\u011finde kirac\u0131 oldu\u011funu resmi belge ile ispat etmedi\u011fi m\u00fcddet\u00e7e mecurdan tahliye olunur.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Ortak Giderlerin \u00d6denmemesi Tahliye Nedeni Midir?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kirac\u0131n\u0131n aidat borcunu \u00f6dememesi tahliye sebebi mi? TBK m.314 ve TBK m.317 h\u00fck\u00fcmlerine g\u00f6re; aksine h\u00fck\u00fcm veya yerel adet yoksa kirac\u0131 kira bedeli d\u0131\u015f\u0131nda temizlik, aidat gibi giderleri de \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr. Kiraya veren kirac\u0131n\u0131n \u00f6demesi gereken aidat\u0131 \u00f6dedikten sonra kirac\u0131ya tahliye talepli icra takibi ba\u015flatabilir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kirac\u0131n\u0131n Birden Fazla Olmas\u0131 Halinde Hakl\u0131 \u0130htar\u0131n Kirac\u0131lardan Birine Tebli\u011fi Yeterli Midir?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kirac\u0131lar aras\u0131nda zorunlu dava arkada\u015fl\u0131\u011f\u0131 bulunmaktad\u0131r. Bu nedenle tebligat\u0131n b\u00fct\u00fcn kirac\u0131lara g\u00f6nderilmesi ve tahliye davas\u0131nda husumetin b\u00fct\u00fcn kirac\u0131lara y\u00f6neltilmesi gerekmektedir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kira S\u00f6zle\u015fmesinin Yenilenmesi Halinde 10 Y\u0131ll\u0131k S\u00fcre<\/strong><\/h1>\n<p style=\"text-align: justify;\">Yarg\u0131tay&#8217;a g\u00f6re, kirac\u0131yla s\u00f6zle\u015fme yenilenmesi halinde 10 y\u0131ll\u0131k s\u00fcre yeni kira s\u00f6zle\u015fmesine g\u00f6re ba\u015flayacakt\u0131r. En son yap\u0131lan kira s\u00f6zle\u015fmesi \u00fczerinden 10 y\u0131l hesaplanmas\u0131 gerekir. (Yarg\u0131tay HGK Esas:2017-458 Karar:2021-614)<\/p>\n<h1 style=\"text-align: justify;\"><strong>10 Y\u0131ll\u0131k S\u00fcrenin Dolmas\u0131 Nedeniyle Tahliye Davas\u0131 Ne Zaman A\u00e7\u0131l\u0131r?<\/strong><\/h1>\n<p style=\"text-align: justify;\">TBK 347. maddesine g\u00f6re; 10 y\u0131ll\u0131k uzama s\u00fcresi sonunda kiraya veren, bu s\u00fcreyi izleyen her uzama y\u0131l\u0131n\u0131n bitiminden en az \u00fc\u00e7 ay \u00f6nce bildirimde bulunmak ko\u015fuluyla, herhangi bir sebep g\u00f6stermeksizin s\u00f6zle\u015fmeye son verebilir.<\/p>\n<p>\u00d6rne\u011fin: 01.01.2012 tarihinde 1 y\u0131ll\u0131k kira s\u00f6zle\u015fmesi yap\u0131lm\u0131\u015f olsun. 10 y\u0131ll\u0131k kirac\u0131ya dava a\u00e7abilmek i\u00e7in 01.01.2024 tarihinde dava a\u00e7\u0131labilecektir. Tabi ki ihtarname \u00e7ekilmi\u015f olmas\u0131 \u015fartt\u0131r. \u0130htarname s\u00fcresi i\u00e7in a\u015fa\u011f\u0131daki soruya bakabilirsiniz.<\/p>\n<h1><strong>10 Y\u0131ll\u0131k Kira S\u00f6zle\u015fmesinin Feshi \u0130htarname S\u00fcresi<\/strong><\/h1>\n<p>Kiraya veren, s\u00f6zle\u015fme s\u00fcresinin bitimine dayanarak s\u00f6zle\u015fmeyi sona erdiremez. Ancak, on y\u0131ll\u0131k uzama s\u00fcresi sonunda kiraya veren, bu s\u00fcreyi izleyen her uzama y\u0131l\u0131n\u0131n bitiminden en az \u00fc\u00e7 ay \u00f6nce bildirimde bulunmak ko\u015fuluyla, herhangi bir sebep g\u00f6stermeksizin s\u00f6zle\u015fmeye son verebilir.<\/p>\n<p>TBK 347. maddede belirtildi\u011fi gibi, 10 y\u0131ll\u0131k uzama y\u0131l\u0131n\u0131n bitiminden en az 3 ay \u00f6nce ihtarnamenin kirac\u0131ya ula\u015fmas\u0131 gerekir.<\/p>\n<p>\u00d6rne\u011fin: 06.06.2012 tarihinde 1 y\u0131ll\u0131k kira s\u00f6zle\u015fmesi yap\u0131lm\u0131\u015f olsun. 10 y\u0131ll\u0131k kirac\u0131ya dava a\u00e7abilmek i\u00e7in 06.06.2024 tarihinde dava a\u00e7\u0131labilecektir. \u0130htarnamenin ise en ge\u00e7 06.03.2024 tarihinde kirac\u0131ya ula\u015fm\u0131\u015f olmas\u0131 gerekir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>\u0130ki Hakl\u0131 \u0130htar Nedeniyle Tahliye Davas\u0131 Ne Zaman A\u00e7\u0131l\u0131r?<\/strong><\/h1>\n<p style=\"text-align: justify;\">TBK 352. maddeye g\u00f6re; Kira s\u00f6zle\u015fmesi 1 y\u0131l veya 1 y\u0131ldan k\u0131sa s\u00fcreli ise kirac\u0131n\u0131n kira s\u00fcresi i\u00e7erisinde <strong>2 kez<\/strong> kira \u00f6demesini yapmamas\u0131 veya eksik \u00f6demesi durumunda kiraya veren taraf\u0131ndan kira s\u00fcresi i\u00e7erisinde <strong>2 hakl\u0131 ihtar<\/strong> \u00e7ekilmesi halinde kira s\u00fcresinin bitiminden ba\u015flayarak <strong>1 ay<\/strong> i\u00e7erisinde a\u00e7aca\u011f\u0131 dava ile kira s\u00f6zle\u015fmesini sona erdirebilir.<\/p>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesi 1 y\u0131ldan daha uzun s\u00fcreli ise kirac\u0131n\u0131n bir kira y\u0131l\u0131 i\u00e7erisinde 2 kez kira bedelini \u00f6dememesi ve kiraya veren taraf\u0131ndan kira y\u0131l\u0131 i\u00e7erisinde kirac\u0131ya 2 ihtar \u00e7ekilmesi halinde ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak 1 ay i\u00e7erisinde a\u00e7aca\u011f\u0131 dava ile kira s\u00f6zle\u015fmesini sona erdirebilir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>\u0130ntifa Hakk\u0131 Sahibi Tahliye Davas\u0131 A\u00e7abilir Mi?<\/strong><\/h1>\n<p style=\"text-align: justify;\">\u0130ntifa hakk\u0131; TMK m.794 gere\u011fi ki\u015fiye o ta\u015f\u0131nmaz \u00fczerinde yararlanma hakk\u0131 vermektedir. Bu nedenle kiraya veren gibi intifa hakk\u0131 sahibinin de kira konusu ta\u015f\u0131nmaza ili\u015fkin olarak tahliye davas\u0131 a\u00e7ma hakk\u0131 bulunmaktad\u0131r.<\/p>\n<p>\u0130ntifa hakk\u0131 sahibi ihtiya\u00e7 nedeniyle tahliye davas\u0131 da a\u00e7abilir.<\/p>\n<h1><strong>\u0130ntifa Hakk\u0131 Sahibi Kiraya Verebilir Mi?<\/strong><\/h1>\n<p>Aksine d\u00fczenleme olmad\u0131k\u00e7a intifa hakk\u0131, sahibine, konusu \u00fczerinde tam yararlanma yetkisi sa\u011flar. Bu nedenle intifa hakk\u0131 sahibi s\u00f6z konusu ta\u015f\u0131nmaz\u0131 kiraya vermeye de yetkilidir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kira S\u00f6zle\u015fmesi \u0130\u00e7inde Tahliye Taahh\u00fctnamesi Olmas\u0131 Halinde\u00a0Bu Tahliye Taahh\u00fcd\u00fc Ge\u00e7erli Midir?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesi yap\u0131l\u0131rken s\u00f6zle\u015fmenin i\u00e7inde tahliye taahh\u00fcd\u00fc olmas\u0131 halinde bu taahh\u00fct ge\u00e7ersiz olacakt\u0131r. \u00c7\u00fcnk\u00fc kira s\u00f6zle\u015fmesi ve tahliye taahh\u00fcd\u00fc ayn\u0131 g\u00fcnde imzalanamaz. Tahliye taahh\u00fcd\u00fc kira s\u00f6zle\u015fme tarihinden en az 1 g\u00fcn sonra imzalanmal\u0131d\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Tahliye Taahh\u00fctnamesinin Bo\u015f Olarak Verilmesi<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kirac\u0131 tahliye tarihini ve tahliye taahh\u00fcd\u00fcn\u00fcn d\u00fczenlendi\u011fi tarihi bo\u015f olarak imzalam\u0131\u015fsa buna katlanmak zorundad\u0131r. Tahliye taahh\u00fcd\u00fcn\u00fcn sonradan dolduruldu\u011funu ileri s\u00fcremez. S\u00f6z konusu tahliye taahh\u00fcd\u00fc ge\u00e7erli olacakt\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kira S\u00f6zle\u015fmesine Cezai \u015eart Konulabilir Mi?<\/strong><\/h1>\n<p style=\"text-align: justify;\">TBK m.346&#8242; ya g\u00f6re; kirac\u0131ya kira ve yan giderler d\u0131\u015f\u0131nda \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc giderilemez . Kira bedelinin zaman\u0131nda \u00f6denmemesi halinde cezai \u015fart \u00f6denece\u011fine ili\u015fkin h\u00fck\u00fcmler ge\u00e7ersizdir.<\/p>\n<p>Kira s\u00f6zle\u015fmelerinde kirac\u0131 ve kiraya veren, s\u00f6zle\u015fmeyi erken feshetmek isteyebilir.\u00a0Kira s\u00f6zle\u015fmelerinin erken feshedilmesi durumunda ise taraflar\u0131n kira s\u00f6zle\u015fmesinden do\u011fan y\u00fck\u00fcml\u00fcl\u00fcklerini ifa etmekten ka\u00e7\u0131nmalar\u0131n\u0131 engellemek i\u00e7in <strong>kira s\u00f6zle\u015fmesinde<\/strong><b>\u00a0cezai \u015fart kararla\u015ft\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr<\/b>.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Tahliye Taahh\u00fctnamesine Cezai \u015eart Eklenebilir Mi?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Tahliye taahh\u00fctnamesinde<b>\u00a0cezai \u015fart kararla\u015ft\u0131r\u0131labilir.<\/b>\u00a0Ancak belirlenen tutar fahi\u015f miktarda olmamal\u0131d\u0131r.<\/p>\n<p>E\u011fer tahliye taahh\u00fcd\u00fc ge\u00e7ersiz ise o zaman tahliye taahh\u00fcd\u00fcndeki ceza \u015fart da ge\u00e7ersiz olacakt\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Tahliye Karar\u0131 Kesinle\u015fmeden \u0130craya Konulabilir Mi?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Tahliye karar\u0131n\u0131n icras\u0131 i\u00e7in kesinle\u015fmesi gerekir mi? Tahliye karar\u0131n\u0131n icraya konulmas\u0131 i\u00e7in <strong>kesinle\u015fmesine gerek yoktur.<\/strong><\/p>\n<p style=\"text-align: justify;\">Ta\u015f\u0131nmaza ili\u015fkin tahliye karar\u0131n\u0131n al\u0131nmas\u0131ndan sonra karar\u0131n yerine getirilmesi i\u00e7in ilaml\u0131 icra takibi yap\u0131l\u0131r. Kirac\u0131 tahliye i\u015flemlerini durdurmak isterse \u00fc\u00e7 ayl\u0131k kira paras\u0131, mahkeme masraf\u0131, mahkeme yarg\u0131lama giderleri ve vekalet \u00fccretini dosyaya \u00f6demesi gerekmektedir. Tehiri icra karar\u0131 dosyaya getirilerek istinaf karar\u0131 kesinle\u015fene kadar tahliye i\u015flemleri bekletilir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Yeni Ev Sahibi Kirac\u0131y\u0131 \u00c7\u0131karabilir Mi?\u00a0<\/strong><\/h1>\n<p style=\"text-align: justify;\">TBK m.351&#8242; e g\u00f6re yeni malik ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7abilir. Yeni malik ta\u015f\u0131nmaz\u0131 ald\u0131ktan sonra 1 ay i\u00e7erisinde ihtar ke\u015fide edip tebli\u011f ettikten 6 ay sonra tahliye davas\u0131 a\u00e7abilir.<\/p>\n<p>Kiralanan\u0131 sonradan edinen ki\u015fi, dilerse gereksinim sebebiyle s\u00f6zle\u015fmeyi sona erdirme hakk\u0131n\u0131, s\u00f6zle\u015fme s\u00fcresinin bitiminden ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava yoluyla da kullanabilir.<\/p>\n<p>Yeni ev sahibi eski ev sahibinin taraf oldu\u011fu s\u00f6zle\u015fmeye ta\u015f\u0131nmaz\u0131 sat\u0131n ald\u0131\u011f\u0131 tarihten itibaren taraf olacakt\u0131r. Bu nedenle kirac\u0131dan kaynaklanan sebeplerden dolay\u0131 da tahliye davas\u0131n\u0131 yeni malik a\u00e7abilir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Temerr\u00fct Nedeniyle A\u00e7\u0131lan Tahliye Davas\u0131ndan Yeni Malik De Yararlanabilir mi?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Yeni malik a\u00e7t\u0131\u011f\u0131 tahliye veya temerr\u00fct ihtar\u0131ndaki haklar\u0131n\u0131 TBK m.183&#8242; e g\u00f6re yeni malike temlik etmi\u015fse yeni malik temerr\u00fct oldu\u011funa dayanarak tahliye davas\u0131 a\u00e7abilir ve a\u00e7\u0131lan davaya devam edebilir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kira S\u00f6zle\u015fmesinde Kirac\u0131n\u0131n Kira S\u00f6zle\u015fmesi \u0130\u00e7erisinde \u0130stedi\u011fi Zaman Kira S\u00f6zle\u015fmesini Fesih Edece\u011fi \u015eart\u0131 Ge\u00e7erli Midir?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesinde kira s\u00fcresi devam ederken kirac\u0131ya \u00f6nceden feshi ihbarda bulunmak suretiyle istedi\u011fi zaman tahliye edilece\u011fi imkan\u0131 tan\u0131nm\u0131\u015fsa <strong>bu \u015fart ge\u00e7erlidir.<\/strong><\/p>\n<h1 style=\"text-align: justify;\"><strong>Tahliye Davas\u0131 Devam Ederken Kirac\u0131n\u0131n Evi Bo\u015faltmas\u0131 Halinde Ne Olur?\u00a0<\/strong><\/h1>\n<p style=\"text-align: justify;\">Tahliye davas\u0131 s\u00fcrerken kirac\u0131 evden \u00e7\u0131karsa dava konusuz kalacakt\u0131r. Davan\u0131n \u00f6n inceleme yap\u0131ld\u0131ktan sonra konusuz kalmas\u0131 veya feragat edilmesi halinde yarg\u0131lama gideri ve vekalet \u00fccretinin tamam\u0131na h\u00fckmedilir. \u00d6n incelemeden \u00f6nce ise yar\u0131s\u0131na h\u00fckmedilir.<\/p>\n<p>Tahliye davas\u0131 s\u00fcrerken kirac\u0131 evi bo\u015falt\u0131rsa dava konusuz kalacak ve hakim <strong>tahliye y\u00f6n\u00fcnden karar verilmesini yer olmad\u0131\u011f\u0131na<\/strong>\u00a0karar\u0131 verecektir.<\/p>\n<p style=\"text-align: justify;\">Hakim dava konusuz kalmam\u0131\u015f gibi davay\u0131 s\u00fcrd\u00fcr\u00fcr ve davay\u0131 kazanan lehine yarg\u0131lama gideri ve vekalet \u00fccretine h\u00fckmeder.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiralayan\u0131n Tahliye Edilmesi Halinde Kiralanana Zarar Verildi\u011fi En Ge\u00e7 Ne Zaman Tespit Edilmelidir?<\/strong><\/h1>\n<p style=\"text-align: justify;\">TBK m.334&#8217;e g\u00f6re\u00a0 kirac\u0131 kiralanan\u0131 ne durumda al\u0131rsa \u00f6yle teslim etmekle m\u00fckelleftir. Kirac\u0131 mala zarar vermi\u015f ise kiraya veren taraf\u0131ndan hemen bildirim yap\u0131lmazsa kirac\u0131 her t\u00fcrl\u00fc sorumluluktan kurtulur. Ancak, teslim alma s\u0131ras\u0131nda ola\u011fan incelemeyle belirlenemeyecek olan eksiklerin ve ay\u0131plar\u0131n varl\u0131\u011f\u0131 halinde, kirac\u0131n\u0131n sorumlulu\u011fu devam eder. Kiraya veren, bu t\u00fcr eksikleri ve ay\u0131plar\u0131 belirledi\u011finde, kirac\u0131ya en k\u0131sa s\u00fcrede yaz\u0131l\u0131 olarak bildirmek zorundad\u0131r.<\/p>\n<h1><strong>Ta\u015f\u0131nmaz\u0131n Tahliyesine Gidildi\u011finde Ta\u015f\u0131nmazda 3. Bir Ki\u015fi Olmas\u0131 Halinde Ta\u015f\u0131nmaz\u0131n Tahliye \u0130\u015flemleri Durdurulur Mu, Ne Yap\u0131lmal\u0131d\u0131r?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Tahliye karar\u0131ndan sonra, tahliyeye gidildi\u011finde \u00fc\u00e7\u00fcnc\u00fc \u015fah\u0131s resmi bir vesika g\u00f6stermemekle beraber davaya konu s\u00f6zle\u015fmeden \u00f6nceki tarihli bir s\u00f6zle\u015fmeyi dosyaya ibraz ederse memur durumu tutana\u011fa ge\u00e7irir. Karar vermek \u00fczere dosyay\u0131 tetkik merciine g\u00f6nderir. Tetkik mercii dosya \u00fczerinden karar verir veya 7 g\u00fcn i\u00e7inde mahkemeye m\u00fcracaat edilmesi istenir. Mahkemeye m\u00fcracaat edildi\u011finde mahkeme taraflar\u0131 dinleyip delil toplad\u0131ktan sonra karar verir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Erken Tahliye Halinde Kirac\u0131n\u0131n Sorumlulu\u011fu Ne Zaman Ba\u015flar?<\/strong><\/h1>\n<p style=\"text-align: justify;\">T\u00fcrk hukukunda as\u0131l olan s\u00f6zle\u015fmeye ba\u011fl\u0131l\u0131k ilkesidir. Ancak TBK m.325&#8242; e g\u00f6re kirac\u0131, kira s\u00fcresi dolmadan tahliye edilirse kirac\u0131n\u0131n sorumlulu\u011fu anahtarlar\u0131n kiralayana teslim edilme tarihinden itibaren kiraya verilebilme s\u00fcresi kadard\u0131r. Ancak s\u00f6zle\u015fmede fesih ihbar s\u00fcresi \u00f6ng\u00f6r\u00fclm\u00fc\u015fse fesih ihbar s\u00fcresi ba\u011flay\u0131c\u0131l\u0131k te\u015fkil edecektir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Tahliye Edilen Ta\u015f\u0131nmaz\u0131n Tahliye Ve Teslim Edildi\u011finin \u0130spat Y\u00fck\u00fc Kime Aittir?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Bu durumda ispat y\u00fck\u00fc kirac\u0131ya aittir. Kirac\u0131 bunu yaz\u0131l\u0131 delil ile ispat etmek zorundad\u0131r.<\/p>\n<h1><strong>Ev Sahibinin Abonelikleri Kapatmas\u0131<\/strong><\/h1>\n<p>Ev sahibinin abonelikleri kapatmas\u0131 TCK&#8217;na g\u00f6re su\u00e7tur. Nitekim Ceza Kanunumuzun 123. Maddesine g\u00f6re ev sahibi\u00a0 &#8221;ki\u015filerin huzur ve s\u00fck\u00fbnunu bozma&#8221; su\u00e7unu i\u015fleyecektir.
