Ancak temyiz incelemesi s\u0131ras\u0131nda yeni d\u00f6nemin (01.01.2016 ) ba\u015flad\u0131\u011f\u0131 da g\u00f6z \u00f6n\u00fcnde bulundurularak, mahkemece bir sonraki d\u00f6nem i\u00e7in (2016) kira bedelinin tespitini isteyip istemedi\u011fi hususunun davac\u0131lara sorularak, istenmesi halinde bir sonraki d\u00f6nem i\u00e7in kira bedelinin tespitine karar verilmesi aksi halde davan\u0131n reddine karar verilmesi gerekir.<\/p>\n<p style=\"text-align: justify;\"><b>DAVA :\u00a0<\/b>Taraflar aras\u0131ndaki kira bedelinin tespiti davas\u0131n\u0131n mahkemece yap\u0131lan yarg\u0131lamas\u0131 sonucunda, davan\u0131n k\u0131smen kabul\u00fcne y\u00f6nelik olarak verilen h\u00fckm\u00fcn, s\u00fcresi i\u00e7inde daval\u0131 taraf\u0131ndan temyiz edilmesi \u00fczerine; temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra, dosya i\u00e7erisindeki b\u00fct\u00fcn ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p style=\"text-align: justify;\"><b>KARAR :\u00a0<\/b>As\u0131l ve birle\u015fen davada davac\u0131lar; murisleri ile imzalanan 01.01.1985 ba\u015flang\u0131\u00e7 tarihli s\u00f6zle\u015fme gere\u011fi kirac\u0131l\u0131\u011f\u0131 devam eden daval\u0131n\u0131n, son \u00f6dedi\u011fi 1.000,00 TL kira bedelinin emsal ta\u015f\u0131nmazlara g\u00f6re d\u00fc\u015f\u00fck kald\u0131\u011f\u0131n\u0131 belirterek ayl\u0131k net kira bedelinin yeni d\u00f6nem i\u00e7in 7.000,00 TL olarak tespitine karar verilmesini talep etmi\u015flerdir. Daval\u0131 as\u0131l ve birle\u015fen daval\u0131; talep edilen kira bedelinin fahi\u015f oldu\u011funu belirterek ayn\u0131 \u015fartlarda emsal incelemesi yap\u0131larak karar verilmesini istemi\u015ftir. Mahkemece, davan\u0131n k\u0131smen kabul\u00fcne, dava konusu kiralanan\u0131n ayl\u0131k kira bedelinin 01\/01\/2015 tarihinden ge\u00e7erli olmak \u00fczere ayl\u0131k net 3.600,00 TL olarak tespitine karar verilmi\u015f, h\u00fck\u00fcm daval\u0131 taraf\u0131ndan temyiz edilmi\u015ftir. TBK&#8217;nun 345 maddesinde \u201cKira bedelinin belirlenmesine ili\u015fkin dava her zaman a\u00e7\u0131labilir ancak bu dava, yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan en ge\u00e7 otuz g\u00fcn \u00f6nceki bir tarihte a\u00e7\u0131ld\u0131\u011f\u0131 ya da kiraya veren taraf\u0131ndan bu s\u00fcre i\u00e7inde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 ko\u015fuluyla, izleyen yeni kira d\u00f6nemi sonuna kadar a\u00e7\u0131ld\u0131\u011f\u0131 takdirde, Mahkemece belirlenecek kira bedeli, bu yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren kirac\u0131y\u0131 ba\u011flar. S\u00f6zle\u015fmede yeni kira d\u00f6neminde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin bir h\u00fck\u00fcm varsa, yeni kira d\u00f6neminin sonuna kadar a\u00e7\u0131lacak davada mahkemece belirlenecek kira bedeli de, bu yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olur.\u201d h\u00fckm\u00fcne yer verilmi\u015ftir. 6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu 01.07.2012 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015f olup, TBK&#8217;nun 345. maddesi bu tarihten sonra a\u00e7\u0131lacak kira bedelinin tespiti istemlerinde uygulan\u0131r. Yine 21.11.1966 g\u00fcn ve 19\/10 Say\u0131l\u0131 Yarg\u0131tay \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131 gere\u011fince, kira bedelinin artt\u0131r\u0131lmas\u0131 ile ilgili olarak g\u00f6nderilen ihtarname veya ayn\u0131 ama\u00e7 i\u00e7in a\u00e7\u0131lan davan\u0131n dilek\u00e7esinin tebli\u011f tarihi, tespit edilecek kira paras\u0131n\u0131n ge\u00e7erli olaca\u011f\u0131 d\u00f6nemin belirlenmesi a\u00e7\u0131s\u0131ndan \u00f6nemlidir. Olay\u0131m\u0131za gelince; 01.01.1985 ba\u015flang\u0131\u00e7 tarihli ve 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesine ili\u015fkin taraflar aras\u0131nda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Kira s\u00f6zle\u015fmesinde art\u0131\u015f h\u00fckm\u00fcne yer verilmemi\u015ftir. Bu durumda davac\u0131 s\u00f6zle\u015fmenin yenilendi\u011fi 01.01.2015 tarihinden itibaren kira bedelinin tespitini talep edebilmesi i\u00e7in, davan\u0131n bu d\u00f6nemin ba\u015flang\u0131c\u0131ndan en ge\u00e7 otuz g\u00fcn \u00f6nceki bir tarihte a\u00e7\u0131lmas\u0131 ya da kiraya veren taraf\u0131ndan bu s\u00fcre i\u00e7inde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 gerekir.<\/p>\n<p style=\"text-align: justify;\">Taraflar aras\u0131ndaki kira s\u00f6zle\u015fmesinde art\u0131\u015f \u015fart\u0131 bulunmad\u0131\u011f\u0131na ve s\u00fcresinde g\u00f6nderilmi\u015f ihtarname veya a\u00e7\u0131lm\u0131\u015f dava da bulunmad\u0131\u011f\u0131na g\u00f6re, 20.11.2014 tarihinde a\u00e7\u0131lan as\u0131l dava dilek\u00e7esinin 08.12.2014 tarihinde daval\u0131ya tebli\u011f edilmi\u015f olmas\u0131 ve yine birle\u015fen davan\u0131n 24.12.2014 tarihinde a\u00e7\u0131lm\u0131\u015f olmas\u0131 kar\u015f\u0131s\u0131nda 01.01.2015 g\u00fcn\u00fc ba\u015flayan d\u00f6nem i\u00e7in kira bedelinin tespitine karar verilemez. Ancak temyiz incelemesi s\u0131ras\u0131nda yeni d\u00f6nemin (01.01.2016 ) ba\u015flad\u0131\u011f\u0131 da g\u00f6z \u00f6n\u00fcnde bulundurularak, mahkemece bir sonraki d\u00f6nem i\u00e7in (2016) kira bedelinin tespitini isteyip istemedi\u011fi hususunun davac\u0131lara sorularak, istenmesi halinde bir sonraki d\u00f6nem i\u00e7in kira bedelinin tespitine karar verilmesi aksi halde davan\u0131n reddine karar verilmesi gerekir. \u00d6yle ise Mahkemece, yukar\u0131daki ilkeler gere\u011fince yarg\u0131lama yap\u0131l\u0131p has\u0131l olacak sonuca g\u00f6re bir karar verilmesi gerekirken, yan\u0131lg\u0131l\u0131 de\u011ferlendirme sonucu yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm tesisi usul ve yasaya ayk\u0131r\u0131 olup, bozmay\u0131 gerektirmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\"><b>SONU\u00c7 :\u00a0<\/b>Yukar\u0131da a\u00e7\u0131klanan esaslar g\u00f6z\u00f6n\u00fcnde tutulmaks\u0131z\u0131n yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm tesisi isabetsiz, temyiz itirazlar\u0131 bu nedenlerle yerinde oldu\u011fundan kabul\u00fcyle h\u00fckm\u00fcn HUMK.nun 428.maddesi gere\u011fince daval\u0131 yarar\u0131na BOZULMASINA, pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istek halinde temyiz edene iadesine, 6100 Say\u0131l\u0131 HMK&#8217;nun ge\u00e7ici madde 3 atf\u0131yla 1086 Say\u0131l\u0131 HUMK.nun 440.maddesi gere\u011fince karar d\u00fczeltme yolu kapal\u0131 olmak \u00fczere, 23.01.2019 tarihinde oybirli\u011fiyle karar verildi<\/p>\n<h2><strong>B-) Kira S\u00f6zle\u015fmesinde Kira Bedelinin Art\u0131r\u0131laca\u011f\u0131na \u0130li\u015fkin Bir H\u00fck\u00fcm Olup Olmamas\u0131na G\u00f6re Kira Tespit Davas\u0131 A\u00e7ma Zaman\u0131 De\u011fi\u015fiklik G\u00f6sterir.<\/strong><\/h2>\n<h3><strong>1-) S\u00f6zle\u015fmede yeni kira d\u00f6neminde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin bir h\u00fck\u00fcm varsa, yeni kira d\u00f6neminin sonuna kadar a\u00e7\u0131lacak davada mahkemece belirlenecek kira bedeli de bu yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olur.<\/strong><\/h3>\n<h4 style=\"text-align: justify;\"><em><strong>Yarg\u0131tay 3. Hukuk Dairesi 2017\/6552 E. 2019\/2619 K.<\/strong><\/em><\/h4>\n<p style=\"text-align: justify;\">\u201c6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 345. maddesi gere\u011fince; kira bedelinin belirlenmesine ili\u015fkin dava her zaman a\u00e7\u0131labilir. Ancak, bu dava, yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan en ge\u00e7 otuz g\u00fcn \u00f6nceki bir tarihte a\u00e7\u0131ld\u0131\u011f\u0131 ya da kiraya veren taraf\u0131ndan bu s\u00fcre i\u00e7inde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 ko\u015fuluyla, izleyen yeni kira d\u00f6nemi sonuna kadar a\u00e7\u0131ld\u0131\u011f\u0131 takdirde, mahkemece belirlenecek kira bedeli, bu yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren kirac\u0131y\u0131 ba\u011flar. S\u00f6zle\u015fmede yeni kira d\u00f6neminde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin bir h\u00fck\u00fcm varsa, yeni kira d\u00f6neminin sonuna kadar a\u00e7\u0131lacak davada mahkemece belirlenecek kira bedeli de bu yeni d\u00f6nemin ba\u015flang\u0131c\u0131ndan itibaren ge\u00e7erli olur. Taraflar aras\u0131nda kira paras\u0131n\u0131n miktar\u0131na ili\u015fkin bir uyu\u015fmazl\u0131k bulunup mahkemeye m\u00fcracaat edildi\u011fine ve kira paras\u0131n\u0131n dava yoluyla tespiti istenildi\u011fine g\u00f6re; daval\u0131 taraf art\u0131r\u0131lmas\u0131 istenilen veya karar verilecek miktar\u0131 \u00f6dese bile dava reddedilmeyip, bu miktar h\u00fck\u00fcm alt\u0131na al\u0131narak bir tespit karar\u0131 verilmesi gerekirken, yaz\u0131l\u0131 \u015fekilde davan\u0131n reddine karar verilmesi do\u011fru de\u011fildir.\u201d<\/p>\n<h2><strong>C-) Kira Tespit Davas\u0131 Kirac\u0131 Lehine Yarg\u0131tay Kararlar\u0131<\/strong><\/h2>\n<h4 style=\"text-align: justify;\"><strong>1-) Yerle\u015fik Yarg\u0131tay uygulamalar\u0131na g\u00f6re \u201chak ve nesafet\u201d ilkesi uyar\u0131nca kira paras\u0131n\u0131n tespit edilmesi i\u00e7in, \u00f6ncelikle taraflar\u0131n t\u00fcm delilleri varsa emsal kira s\u00f6zle\u015fmeleri asl\u0131 veya onayl\u0131 \u00f6rnekleri dosyaya al\u0131nmal\u0131, bilirki\u015fi marifetiyle kiralanan ta\u015f\u0131nmaz ve taraf emsalleri tek tek g\u00f6r\u00fcl\u00fcp incelenmeli, b\u00f6ylece elde edilen veriler somutla\u015ft\u0131r\u0131larak, dava konusu yer ile ayr\u0131 ayr\u0131 (konumu, \u00e7evresi, niteli\u011fi, kullan\u0131m \u015fekli, kira ba\u015flang\u0131\u00e7 tarihi, kira s\u00fcreleri vb.) kira paras\u0131na etki eden t\u00fcm nitelikleri kar\u015f\u0131la\u015ft\u0131r\u0131lmal\u0131, emsal kira bedellerinin ni\u00e7in uygun emsal olup olmad\u0131\u011f\u0131 somut gerek\u00e7elerle a\u00e7\u0131klanmal\u0131d\u0131r.<br \/>\n<\/strong><\/h4>\n<h4 style=\"text-align: justify;\"><strong><em>Yarg\u0131tay 3. Kira ba\u015flang\u0131\u00e7 tarihi 10.03.2008 oldu\u011fundan ve 5 y\u0131l sonras\u0131na ili\u015fkin kira belirlemesi talep edildi\u011finden, daval\u0131 kirac\u0131n\u0131n tacir olup olmad\u0131\u011f\u0131 nazara al\u0131nmaks\u0131z\u0131n her halde, tespiti istenen d\u00f6neminin hak ve nesafet d\u00f6nemi oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u201cHak ve nesafet\u201d ilkesi uyar\u0131nca kira paras\u0131n\u0131n tespit edilmesi i\u00e7in, \u00f6ncelikle taraflar\u0131n t\u00fcm delilleri varsa emsal kira s\u00f6zle\u015fmeleri asl\u0131 veya onayl\u0131 \u00f6rnekleri dosyaya al\u0131nmal\u0131, bilirki\u015fi marifetiyle kiralanan ta\u015f\u0131nmaz ve taraf emsalleri tek tek g\u00f6r\u00fcl\u00fcp incelenmeli, b\u00f6ylece elde edilen veriler somutla\u015ft\u0131r\u0131larak, dava konusu yer ile ayr\u0131 ayr\u0131 (konumu, \u00e7evresi, niteli\u011fi, kullan\u0131m \u015fekli, kira ba\u015flang\u0131\u00e7 tarihi, kira s\u00fcreleri vb.) kira paras\u0131na etki eden t\u00fcm nitelikleri kar\u015f\u0131la\u015ft\u0131r\u0131lmal\u0131, emsal kira bedellerinin ni\u00e7in uygun emsal olup olmad\u0131\u011f\u0131 somut gerek\u00e7elerle a\u00e7\u0131klanmal\u0131, dava konusu ta\u015f\u0131nmaz\u0131n tespiti istenen kira d\u00f6nemi itibariyle yeniden kiraya verilmesi halinde bo\u015f olarak getirebilece\u011fi kira paras\u0131 belirlenmeli, hakimce bu kira paras\u0131 dikkate al\u0131nmak suretiyle hak ve nesafete uygun makul bir kira paras\u0131na h\u00fckmedilmelidir. Mahkemece, belirtilen ilkeler \u0131\u015f\u0131\u011f\u0131nda d\u00fczenlenecek \u015fekilde rapor ald\u0131rarak dava konusu kiralanan\u0131n tespiti istenen d\u00f6nem itibariyle yeniden kiraya verilmesi halinde getirebilece\u011fi ayl\u0131k kira bedeli belirlenerek ve bunun \u00fczerinden hak ve nesafet indirimi yap\u0131larak sonucuna g\u00f6re karar verilmesi gerekir.<\/p>\n<p style=\"text-align: justify;\"><b>DAVA :\u00a0<\/b>Taraflar aras\u0131ndaki kira bedelinin tespiti davas\u0131n\u0131n mahkemece yap\u0131lan yarg\u0131lamas\u0131 sonucunda, davan\u0131n k\u0131smen kabul\u00fcne y\u00f6nelik olarak verilen h\u00fckm\u00fcn, s\u00fcresi i\u00e7inde davac\u0131 vekili taraf\u0131ndan temyiz edilmesi \u00fczerine; temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra, dosya i\u00e7erisindeki ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p style=\"text-align: justify;\"><b>KARAR :\u00a0<\/b>Davac\u0131,01.04.2014 tarihinde a\u00e7t\u0131\u011f\u0131 davada , daval\u0131 ile aralar\u0131nda 10.03.2008 tarihli kira s\u00f6zle\u015fmesi d\u00fczenlendi\u011fini ,bu s\u00f6zle\u015fme ile daval\u0131n\u0131n &#8230; No:14\/A adresinde yer alan i\u015fyerinde kirac\u0131 olarak bulundu\u011funu, kira s\u00f6zle\u015fmesinin yap\u0131ld\u0131\u011f\u0131 tarihte kira bedelinin 9.000 TL olarak belirlendi\u011fini, 3 y\u0131l 9.000 TL olarak kalmas\u0131 daha sonraki y\u0131llarda enflasyon oran\u0131nda art\u0131\u015f yap\u0131lmas\u0131n\u0131 kararla\u015ft\u0131rd\u0131klar\u0131n\u0131, mevcut kira bedelinin 11.680 TL oldu\u011funu ancak bu bedelin b\u00f6lgede uygulanan emsal kira bedelleri kar\u015f\u0131s\u0131nda olduk\u00e7a d\u00fc\u015f\u00fck kald\u0131\u011f\u0131n\u0131 belirterek ayl\u0131k kira dava tarihi itibari ile 20.000 TL olarak tespitine ve arada olu\u015facak fark\u0131n taraf\u0131na \u00f6denmesine karar verilmesini talep etmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Daval\u0131, davan\u0131n reddini dilemi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Mahkemece, davan\u0131n k\u0131smen kabul\u00fcyle 10.03.2014-26.11.2014 tarihleri aras\u0131nda ayl\u0131k kira bedelinin dosya kapsam\u0131nda ald\u0131r\u0131lan ve enflasyon oran\u0131na g\u00f6re belirlendi\u011fi anla\u015f\u0131lan stopaj dahil 12.449,43 TL olarak tespitine karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Yerle\u015fik Yarg\u0131tay uygulamalar\u0131na g\u00f6re \u015fartlar de\u011fi\u015fmedi\u011fi ve \u00f6zel geli\u015fmelerin varl\u0131\u011f\u0131 iddia ve ispat edilmedik\u00e7e, hak ve nesafet ilkesine g\u00f6re kira paras\u0131n\u0131n tespit edildi\u011fi d\u00f6nemden sonra \u00fc\u00e7 y\u0131l i\u00e7in ard arda endeks uygulanarak bulunacak kira paras\u0131n\u0131n o d\u00f6nem i\u00e7in hak ve nesafete uygun ve a\u015f\u0131r\u0131 olmayan bir kira paras\u0131 oldu\u011fu ilke olarak kabul edilmeli ve ona g\u00f6re uygulama yap\u0131lmal\u0131d\u0131r. \u00dc\u00e7 y\u0131ldan sonra ise yeniden hak ve nesafete g\u00f6re kira paras\u0131 tespit edilebilecektir.<\/p>\n<p style=\"text-align: justify;\">01\/07\/2012 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu 344.maddesinde; \u201cTaraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir. Bu kural, bir y\u0131ldan daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde de uygulan\u0131r. Taraflarca bu konuda bir anla\u015fma yap\u0131lmam\u0131\u015fsa, kira bedeli, bir \u00f6nceki kira y\u0131l\u0131n\u0131n \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla h\u00e2kim taraf\u0131ndan, kiralanan\u0131n durumu g\u00f6z \u00f6n\u00fcne al\u0131narak hakkaniyete g\u00f6re belirlenir. Taraflarca bu konuda bir anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde ve bundan sonraki her be\u015f y\u0131l\u0131n sonunda, yeni kira y\u0131l\u0131nda uygulanacak kira bedeli, h\u00e2kim taraf\u0131ndan \u00fcretici fiyat endeksindeki art\u0131\u015f oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete uygun bi\u00e7imde belirlenir. Her be\u015f y\u0131ldan sonraki kira y\u0131l\u0131nda bu bi\u00e7imde belirlenen kira bedeli, \u00f6nceki f\u0131kralarda yer alan ilkelere g\u00f6re de\u011fi\u015ftirilebilir.\u201d h\u00fckm\u00fc bulunmaktad\u0131r. T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun Y\u00fcr\u00fcrl\u00fc\u011f\u00fc ve Uygulama \u015eekli Hakk\u0131ndaki Kanunun 2.maddesinde ge\u00e7mi\u015fe etkili olma ba\u015fl\u0131\u011f\u0131 alt\u0131nda \u201cT\u00fcrk Bor\u00e7lar Kanununun d\u00fczenine ve genel ahlaka ili\u015fkin kurallar\u0131 ger\u00e7ekle\u015ftirdikleri tarihe bak\u0131lmaks\u0131z\u0131n, b\u00fct\u00fcn fiil ve i\u015flemlere uygulan\u0131r.\u201d h\u00fckm\u00fc yer almaktad\u0131r. T\u00fcrk Bor\u00e7lar Kanununun kira art\u0131\u015f\u0131na ili\u015fkin 344.maddesindeki d\u00fczenleme kirac\u0131lar\u0131 koruyucu nitelikte olup, kamu d\u00fczenine ili\u015fkindir. Ancak kirac\u0131n\u0131n tacir olmas\u0131 durumunda 6217 Say\u0131l\u0131 Kanunun ge\u00e7ici 2. maddesi gere\u011fince bu kanun h\u00fckm\u00fc 8 y\u0131l s\u00fcreyle uygulanamayaca\u011f\u0131 bu halde kira s\u00f6zle\u015fmelerinde bu maddelerde belirtilmi\u015f olan konulara ili\u015fkin olarak s\u00f6zle\u015fme serbestisi gere\u011fi kira s\u00f6zle\u015fmesinin h\u00fck\u00fcmlerinin tatbik olaca\u011f\u0131, s\u00f6zle\u015fmede h\u00fck\u00fcm bulunmayan hallerde ise M\u00fclga BK h\u00fck\u00fcmlerinin uygulanaca\u011f\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p style=\"text-align: justify;\">Ayr\u0131ca,18.01.2019 tarihli Resmi Gazetede yay\u0131mlanan, 7161 Say\u0131l\u0131 Kanunun 59. maddesiyle 6217 Say\u0131l\u0131 Kanunun ge\u00e7ici 2. maddesine &#8221; Bu f\u0131kray\u0131 ihdas eden Kanunla de\u011fi\u015ftirilen 6098 Say\u0131l\u0131 Kanunun 344 . maddesindeki t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131n esas al\u0131naca\u011f\u0131na ili\u015fkin h\u00fck\u00fcm, birinci f\u0131kra kapsam\u0131nda olan kira s\u00f6zle\u015fmeleri ile akdedilmi\u015f di\u011fer kira s\u00f6zle\u015fmelerinin yenilenmesinde uygulan\u0131r.&#8221;h\u00fckm\u00fc eklenerek, t\u00fcm \u00e7at\u0131l\u0131 gayrimenkul kiralar\u0131nda 01.01.2019 tarihinden itibaren yap\u0131lacak kira art\u0131\u015flar\u0131n\u0131n, t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131n esas al\u0131narak belirlenece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">Somut olayda; 10.03.2008 ba\u015flang\u0131\u00e7 tarihli 5 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesinin varl\u0131\u011f\u0131 hususunda, taraflar aras\u0131nda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Kira s\u00f6zle\u015fmesinin hususi \u015fartlar b\u00f6l\u00fcm\u00fcn\u00fcn 6. maddesinde kira m\u00fcddetinin 5 y\u0131l olup 5 y\u0131l uzat\u0131laca\u011f\u0131 ; 7. maddesinde de kira \u00fccreti art\u0131\u015flar\u0131n\u0131n ilk 3 y\u0131l 9.000 TL olup 3 y\u0131l sonunda enflasyon oran\u0131nda art\u0131\u015f yap\u0131laca\u011f\u0131 d\u00fczenlenmi\u015ftir.
