Hukuk Dairesi 01.03.2018 Tarihli 2018\/1057 E. \u2013 2018\/1859 K.\u00a0<\/strong><\/p>\n<p class=\"grounds-paragraph\" style=\"text-align: justify;\">Davac\u0131, halen e\u015fi ad\u0131na kay\u0131tl\u0131 ta\u015f\u0131nmazda oturdu\u011funu, bu ta\u015f\u0131nmaz\u0131n riskli yap\u0131 kabul edildi\u011fini ve y\u0131k\u0131m a\u015famas\u0131nda oldu\u011funu, kiralanan konuta ihtiya\u00e7lar\u0131 bulundu\u011funu belirterek daval\u0131n\u0131n kiralanandan\u00a0tahliyesine karar verilmesini istemi\u015ftir.<br \/>\nDaval\u0131, ihtiyac\u0131n samimi olmad\u0131\u011f\u0131n\u0131 savunarak, davan\u0131n reddini istemi\u015ftir.<br \/>\nMahkemece, ihtiyac\u0131n samimi ve zorunlu olmad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<br \/>\n\u0130htiya\u00e7 iddias\u0131na dayal\u0131 davalarda tahliyeye karar verilebilmesi i\u00e7in ihtiyac\u0131n ger\u00e7ek, samimi ve zorunlu oldu\u011funun kan\u0131tlanmas\u0131 gerekir. Devaml\u0131l\u0131k arz etmeyen ge\u00e7ici ihtiya\u00e7 tahliye nedeni yap\u0131lamayaca\u011f\u0131 gibi hen\u00fcz do\u011fmam\u0131\u015f veya ger\u00e7ekle\u015fmesi uzun bir s\u00fcreye ba\u011fl\u0131 olan ihtiya\u00e7 da tahliye sebebi olarak kabul edilemez. Davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihte ihtiya\u00e7 sebebinin varl\u0131\u011f\u0131 yeterli olmay\u0131p, bu ihtiyac\u0131n yarg\u0131lama s\u0131ras\u0131nda da devam etmesi gerekir.<br \/>\nSomut olayda; h\u00fckme esas al\u0131nan 01.04.2014 ba\u015flang\u0131\u00e7 tarihli ve bir y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi konusunda taraflar aras\u0131nda bir uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Davac\u0131n\u0131n halen oturdu\u011fu ve e\u015fi ad\u0131na kay\u0131tl\u0131 olan ta\u015f\u0131nmaz hakk\u0131nda 6306 say\u0131l\u0131 yasa kapsam\u0131nda y\u0131k\u0131m karar\u0131 al\u0131nm\u0131\u015f oldu\u011fu, davac\u0131 tan\u0131klar\u0131n\u0131n anlat\u0131m\u0131ndan ise davac\u0131n\u0131n e\u015fyalar\u0131n\u0131 bir depoya b\u0131rakt\u0131\u011f\u0131 ve&#8230;&#8217; da bulunan 1+1 yazl\u0131k eve ge\u00e7ici olarak ta\u015f\u0131nd\u0131klar\u0131 anla\u015f\u0131lmaktad\u0131r. Bu durumda toplanan deliller birlikte de\u011ferlendirildi\u011finde davac\u0131n\u0131n ihtiyac\u0131n\u0131n ger\u00e7ek, samimi ve zorunlu oldu\u011funun kabul\u00fc gerekir. Mahkemece bu nedenle davan\u0131n kabul\u00fc ile daval\u0131n\u0131n kiralanandan tahliyesine karar verilmesi gerekirken, yaz\u0131l\u0131 \u015fekilde davan\u0131n reddine karar verilmesi usul ve yasaya ayk\u0131r\u0131 olup bozmay\u0131 gerektirmi\u015ftir.<\/p>\n<h4 style=\"text-align: justify;\"><strong>2-) Davaya dayanak te\u015fkil eden ihtar, s\u00f6zle\u015fmenin ayn\u0131 ko\u015fullarla bir y\u0131l yenilenmesinden sonra g\u00f6nderildi\u011fi i\u00e7in sonraki kira d\u00f6nemine ili\u015fkin h\u00fck\u00fcm ifade etmektedir. Bu nedenle s\u00fcresinde a\u00e7\u0131lmayan davan\u0131n reddine karar verilmesi gerekir.\u00a0<\/strong><\/h4>\n<p style=\"text-align: justify;\"><strong>Yarg\u0131tay 3. Hukuk Dairesi 06.07.2017 Tarihli 2017\/4069 E. \u2013 2017\/11195 K.\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Davac\u0131 vekili, taraflar aras\u0131nda 01\/10\/2011 ba\u015flang\u0131\u00e7 tarihli 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi bulundu\u011funu, daval\u0131lar\u0131n bu s\u00f6zle\u015fmeye dayal\u0131 olarak davac\u0131ya ait konutta kirac\u0131 olduklar\u0131n\u0131 ancak m\u00fcvekkilinin a\u011f\u0131r rahats\u0131zl\u0131klar\u0131 nedeniyle hastaneye ba\u011f\u0131ml\u0131 ya\u015fad\u0131\u011f\u0131n\u0131 ve evinin bulundu\u011fu Beylikd\u00fcz\u00fc adresinden tedavi g\u00f6rd\u00fc\u011f\u00fc hastanelere ula\u015f\u0131m\u0131n zor oldu\u011funu bu nedenle kiralanan ta\u015f\u0131nmaza ihtiyac\u0131 oldu\u011funu belirterek daval\u0131lar\u0131n ta\u015f\u0131nmazdan tahliyelerine karar verilmesini talep etmi\u015ftir.<br \/>\nDaval\u0131lar, davan\u0131n reddini savunmu\u015ftur.<br \/>\nMahkemece, zaruri ve samimi ihtiya\u00e7 nedeniyle davan\u0131n kabul\u00fc ile tahliyeye karar verilmi\u015f, h\u00fck\u00fcm daval\u0131lar taraf\u0131ndan temyiz edilmi\u015ftir.<br \/>\n6098 say\u0131l\u0131 TBK.\u2019nun 350\/1. maddesi h\u00fckm\u00fcne g\u00f6re ihtiya\u00e7 iddias\u0131na dayal\u0131 olarak a\u00e7\u0131lacak tahliye davalar\u0131n\u0131n belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde bu kanunun 328. maddesinde fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7\u0131lmas\u0131 gerekir. TBK.\u2019nun 353. maddesi uyar\u0131nca kiraya veren, daha \u00f6nce veya en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7aca\u011f\u0131n\u0131 kirac\u0131ya yaz\u0131l\u0131 olarak bildirmi\u015fse dava, bildirimi takip eden uzayan bir kira y\u0131l\u0131 sonuna kadar a\u00e7\u0131labilir. Dava a\u00e7ma s\u00fcresi kamu d\u00fczenine ili\u015fkin olup, daval\u0131 ileri s\u00fcrmese bile mahkemece kendili\u011finden g\u00f6z \u00f6n\u00fcnde bulundurulmas\u0131 gerekir.<\/p>\n<p style=\"text-align: justify;\">Olay\u0131m\u0131za gelince; Taraflar aras\u0131nda d\u00fczenlenen 01\/10\/2011 ba\u015flang\u0131\u00e7 tarihli 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi hususunda bir uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Davac\u0131 kiraya veren, 30\/12\/2013 tarihinde ke\u015fide etti\u011fi, 31\/12\/2013 tarihinde muhataplar\u0131nca tebli\u011f olunan ihtarname ile ihtiya\u00e7 iddias\u0131 ve tahliye istemini bildirerek 29\/04\/2014 tarihinde i\u015fbu davay\u0131 a\u00e7m\u0131\u015ft\u0131r. Ne var ki davaya dayanak te\u015fkil eden ihtar, s\u00f6zle\u015fmenin 01\/10\/2013 tarihinde ayn\u0131 ko\u015fullarla bir y\u0131l yenilenmesinden sonra g\u00f6nderildi\u011finden ancak 01\/10\/2014-01\/10\/2015 kira d\u00f6nemine ili\u015fkin h\u00fck\u00fcm ifade etmektedir A\u00e7\u0131klanan bu olgu kar\u015f\u0131s\u0131nda erken a\u00e7\u0131lmakla s\u00fcresinde olmayan davan\u0131n reddine karar verilmesi gerekirken yaz\u0131l\u0131 \u015fekilde kiralanan\u0131n tahliyesine karar verilmesi usul ve yasaya ayk\u0131r\u0131d\u0131r.<br \/>\nH\u00fck\u00fcm bu nedenle bozulmal\u0131d\u0131r.<\/p>\n<h4 style=\"text-align: justify;\"><strong>3-) Kiralanan yerin dava a\u015famas\u0131nda tahliye edilmesi nedeniyle talebin konusuz kald\u0131\u011f\u0131 bu nedenle &#8220;Karar verilmesine yer olmad\u0131\u011f\u0131&#8221; karar\u0131 verilmelidir. Yine davac\u0131n\u0131n hakl\u0131 oldu\u011fu g\u00f6zetilerek yarg\u0131lama giderlerine ve vekalet \u00fccretine takdir edilmelidir.\u00a0<\/strong><\/h4>\n<p style=\"text-align: justify;\"><strong>Yarg\u0131tay Hukuk Genel Kurulu 29.06.2021 Tarihli 2017\/6-1540 E. \u2013 2021\/878 K.\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\">Dava ve Karar: 1. Taraflar aras\u0131ndaki \u201ckiralanan\u0131n tahliyesi\u201d davas\u0131ndan dolay\u0131 yap\u0131lan yarg\u0131lama sonunda, \u0130stanbul Anadolu 17. Sulh Hukuk Mahkemesince verilen davan\u0131n reddine ili\u015fkin karar davac\u0131 vekili taraf\u0131ndan temyiz edilmesi \u00fczerine Yarg\u0131tay (Kapat\u0131lan) 6. Hukuk Dairesince yap\u0131lan inceleme sonunda bozulmu\u015f, Mahkemece \u00d6zel Daire bozma karar\u0131na kar\u015f\u0131 direnilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">2. Direnme karar\u0131 davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">3. Hukuk Genel Kurulunca dosyadaki belgeler incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcld\u00fc:<\/p>\n<p style=\"text-align: justify;\">I. YARGILAMA S\u00dcREC\u0130<\/p>\n<p style=\"text-align: justify;\">Davac\u0131 \u0130stemi:<br \/>\n4. Davac\u0131 vekili; m\u00fcvekkilinin konut ihtiyac\u0131 i\u00e7in sat\u0131n ald\u0131\u011f\u0131 ta\u015f\u0131nmazda daval\u0131n\u0131n eski malikin kirac\u0131s\u0131 olarak oturdu\u011funu, \u00f6nceki malikle yap\u0131lan kira s\u00f6zle\u015fmesinin yenilenmeyece\u011finin noter arac\u0131l\u0131\u011f\u0131 ile g\u00f6nderilen ihtarname ile daval\u0131ya bildirildi\u011fini ancak daval\u0131n\u0131n kiralanan\u0131 bo\u015faltmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek kiralanan\u0131n tahliyesine karar verilmesini talep etmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Daval\u0131 cevab\u0131:<br \/>\n5. Daval\u0131 vekili; yurt d\u0131\u015f\u0131nda ya\u015fayan davac\u0131n\u0131n T\u00fcrkiye\u2019ye kesin d\u00f6n\u00fc\u015f yapaca\u011f\u0131 iddias\u0131n\u0131n ger\u00e7ek d\u0131\u015f\u0131 ve farazi oldu\u011funu, ge\u00e7ici bir ihtiyac\u0131n tahliye nedeni yap\u0131lamayaca\u011f\u0131n\u0131, davan\u0131n hukuk\u00ee bir dayana\u011f\u0131n\u0131n bulunmad\u0131\u011f\u0131n\u0131 belirterek davan\u0131n reddini savunmu\u015ftur.<\/p>\n<p style=\"text-align: justify;\">Mahkeme Karar\u0131:<br \/>\n6. \u0130stanbul Anadolu 17. Sulh Hukuk Mahkemesinin 07.05.2013 tarihli ve 2012\/1125 E., 2013\/321 K. say\u0131l\u0131 karar\u0131 ile; davac\u0131n\u0131n T\u00fcrkiye\u2019ye kesin d\u00f6n\u00fc\u015f yapaca\u011f\u0131 iddias\u0131n\u0131 pasaport i\u015flemleri itibariyle kan\u0131tlayamad\u0131\u011f\u0131, daval\u0131 tarafla yapt\u0131\u011f\u0131 g\u00f6r\u00fc\u015fmeye g\u00f6re evi yat\u0131r\u0131m maksatl\u0131 ald\u0131\u011f\u0131n\u0131 beyan etti\u011fi, hukukta yeri olmasa da bu a\u015famada dava konusu edilen eve davac\u0131n\u0131n de\u011fil daval\u0131n\u0131n ihtiyac\u0131n\u0131n daha fazla oldu\u011fu gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">\u00d6zel Daire Bozma Karar\u0131:<\/p>\n<p style=\"text-align: justify;\">7. Yerel Mahkemenin yukar\u0131da belirtilen karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde davac\u0131 vekili taraf\u0131ndan temyiz isteminde bulunulmu\u015ftur.<\/p>\n<p style=\"text-align: justify;\">8. Yarg\u0131tay (Kapat\u0131lan) 6. Hukuk Dairesinin 25.09.2013 tarihli ve 2013\/11643 E., 2013\/13045 K. say\u0131l\u0131 karar\u0131 ile;<br \/>\n\u201c\u2026Davac\u0131 vekili, ihtiya\u00e7l\u0131 davac\u0131n\u0131n yurtd\u0131\u015f\u0131nda ya\u015fad\u0131\u011f\u0131n\u0131 ve yurda kesin d\u00f6n\u00fc\u015f yapaca\u011f\u0131n\u0131 belirterek bu davay\u0131 a\u00e7m\u0131\u015ft\u0131r. Her ne kadar yarg\u0131lama s\u0131ras\u0131nda kesin d\u00f6n\u00fc\u015f yap\u0131laca\u011f\u0131n\u0131 bildirir dilek\u00e7e sunmam\u0131\u015f ve yaz aylar\u0131nda T\u00fcrkiye&#8217;ye kesin d\u00f6n\u00fc\u015f yapacaklar\u0131n\u0131 s\u00f6ylemi\u015f ise de, davac\u0131 vekilinin temyiz dilek\u00e7esi ekinde sunmu\u015f oldu\u011fu davac\u0131n\u0131n e\u015finin ABD&#8217;de \u00e7al\u0131\u015ft\u0131\u011f\u0131 \u015firketten 31.05.2013 tarihinde istifa etti\u011fini belirtir belge ile T\u00fcrkiye\u2019ye kesin d\u00f6n\u00fc\u015f yapmak i\u00e7in 10.05.2013 tarihli ikametgah nakil belgesi ald\u0131\u011f\u0131na ili\u015fkin belgelere g\u00f6re ihtiyac\u0131n samimi oldu\u011funun kabul\u00fc ile davan\u0131n kabul\u00fcne karar verilmesi gerekirken yaz\u0131l\u0131 \u015fekilde davan\u0131n reddine karar verilmesi do\u011fru de\u011fildir\u2026\u201d gerek\u00e7esiyle karar bozulmu\u015ftur.<\/p>\n<p style=\"text-align: justify;\">Direnme Karar\u0131:<\/p>\n<p style=\"text-align: justify;\">9. Mahkemenin 04.02.2014 tarihli ve 2013\/800 E., 2014\/63 K. say\u0131l\u0131 karar\u0131 ile; \u00d6zel Dairenin temyiz a\u015famas\u0131nda sunulan belgeye dayanarak ve 07.05.2013 tarihli celsede bizzat davac\u0131 vekilinin &#8220;&#8230;m\u00fcvekkilimin T\u00fcrkiye&#8217;ye kesin d\u00f6n\u00fc\u015f yapaca\u011f\u0131 d\u00fc\u015f\u00fcncesine dayan\u0131larak a\u00e7\u0131lm\u0131\u015f bir dava de\u011fildir&#8230;&#8221; s\u00f6z\u00fc ortada iken bozma karar\u0131 vermesinin dosyan\u0131n olu\u015funa uygun d\u00fc\u015fmedi\u011fi, davac\u0131n\u0131n ihtiyac\u0131n\u0131n samimi g\u00f6r\u00fclmedi\u011fi, bu nedenle direnme karar\u0131 verilmesi gerekti\u011fi ancak ta\u015f\u0131nmaz\u0131n tahliye edilmi\u015f olmas\u0131 nedeniyle talebin konusuz kald\u0131\u011f\u0131 gerek\u00e7esiyle karar ittihaz\u0131na yer olmad\u0131\u011f\u0131na, yarg\u0131lama giderlerinin davac\u0131 \u00fczerinde b\u0131rak\u0131lmas\u0131na ve daval\u0131 lehine maktu vek\u00e2let \u00fccreti takdirine karar verilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Direnme Karar\u0131n\u0131n Temyizi:<br \/>\n10. Direnme karar\u0131 s\u00fcresi i\u00e7inde davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">II. UYU\u015eMAZLIK<\/p>\n<p style=\"text-align: justify;\">11. Direnme yolu ile Hukuk Genel Kurulu \u00f6n\u00fcne gelen uyu\u015fmazl\u0131k; davac\u0131 yeni malikin konut ihtiyac\u0131n\u0131n ger\u00e7ek, samimi ve zorunlu oldu\u011funun kan\u0131tlan\u0131p kan\u0131tlanmad\u0131\u011f\u0131 noktas\u0131nda toplanmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">III. \u00d6N SORUN<br \/>\n12. Hukuk Genel Kurulunda yap\u0131lan g\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda; bozma karar\u0131ndan sonra 31.01.2014 tarihinde ger\u00e7ekle\u015fen tahliye nedeniyle Mahkemece direnme ad\u0131 alt\u0131nda verilen \u201cdavan\u0131n konusuz kalmas\u0131 nedeniyle karar ittihaz\u0131na yer olmad\u0131\u011f\u0131na\u201d dair karar\u0131n ger\u00e7ekte yeni h\u00fck\u00fcm olup olmad\u0131\u011f\u0131, buna g\u00f6re temyiz incelemesinin Hukuk Genel Kurulunca m\u0131, yoksa \u00d6zel Dairece mi yap\u0131laca\u011f\u0131 \u00f6n sorun olarak tart\u0131\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">13. Yap\u0131lan g\u00f6r\u00fc\u015fmelerde kiralanan\u0131n yarg\u0131lama s\u0131ras\u0131nda ancak \u00d6zel Dairenin bozmas\u0131ndan sonra daval\u0131 taraf\u0131ndan tahliye edilmi\u015f olmas\u0131 nedeniyle, davan\u0131n konusuz kald\u0131\u011f\u0131, Mahkemece verilmesi gereken karar\u0131n ku\u015fkusuz \u201ckarar verilmesine yer olmad\u0131\u011f\u0131na\u201d \u015feklinde olmas\u0131 gerekti\u011fi ancak davan\u0131n yarg\u0131lama giderleri a\u00e7\u0131s\u0131ndan devam edece\u011fi, yarg\u0131lama giderlerinin davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihteki hakl\u0131l\u0131k durumuna g\u00f6re belirlenmesi gerekti\u011fi ve bozma karar\u0131na kar\u015f\u0131 Mahkemenin davac\u0131n\u0131n dava a\u00e7makta haks\u0131z oldu\u011fu gerek\u00e7esindeki \u0131srar\u0131 nedeniyle direnme karar\u0131 verilmesinin usul\u00fcne uygun oldu\u011fu, uyu\u015fmazl\u0131\u011f\u0131n davac\u0131n\u0131n tahliye isteminin ger\u00e7ek ve samimi olup olmad\u0131\u011f\u0131 noktas\u0131nda topland\u0131\u011f\u0131, dolay\u0131s\u0131yla yeni h\u00fck\u00fcm bulunmad\u0131\u011f\u0131 ve temyiz incelemesinin Hukuk Genel Kurulunca yap\u0131lmas\u0131 gerekti\u011fi sonucuna var\u0131larak \u00f6n sorunun bulunmad\u0131\u011f\u0131na oy \u00e7oklu\u011fu ile karar verilerek, i\u015fin esas\u0131n\u0131n incelenmesine ge\u00e7ilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">IV. GEREK\u00c7E<br \/>\n14. Dava, yeni malikin iktisap ve mesken ihtiyac\u0131 sebebiyle kiralanan\u0131n tahliyesi istemine ili\u015fkindir<\/p>\n<p style=\"text-align: justify;\">15. Hemen belirtmek gerekir ki, m\u00fclga 6570 say\u0131l\u0131 Gayrimenkullerin Kiralanmas\u0131 Hakk\u0131nda Kanun kapsam\u0131na giren bir ta\u015f\u0131nmaz\u0131 iktisap eden kimse dilerse eski malik ile kirac\u0131 aras\u0131nda yap\u0131lm\u0131\u015f s\u00f6zle\u015fmeye dayanarak s\u00f6zle\u015fmenin sonunda, dilerse Kanun\u2019un 7\/(d) maddesinde \u00f6ng\u00f6r\u00fclen s\u00fcrelerden yararlanarak ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7abilir. Yeni malikin bu se\u00e7eneklerden hangisi yarar\u0131na ise onu tercih etme hakk\u0131 vard\u0131r.<\/p>\n<p style=\"text-align: justify;\">16. M\u00fclga 6570 say\u0131l\u0131 Gayrimenkullerin Kiralanmas\u0131 Hakk\u0131nda Kanun\u2019un 7\/(d) maddesi;<br \/>\n\u201cGayrimenkul\u00fc Medeni Kanun h\u00fck\u00fcmlerine g\u00f6re iktisabeden kimse kendisi veya e\u015fi veya \u00e7ocuklar\u0131 i\u00e7in tamamen veya k\u0131smen mesken olarak ve yine kendisi veya e\u015fi veya \u00e7ocuklar\u0131 i\u00e7in bir meslek veya sanat\u0131n bizzat icras\u0131 maksadiyle i\u015f yeri olarak kullanma ihtiyac\u0131nda ise iktisap tarihinden itibaren bir ay zarf\u0131nda kirac\u0131y\u0131 keyfiyetten ihtarname ile haberdar etmek \u015fart\u0131yle alt\u0131 ay sonra, tahliye davas\u0131 a\u00e7abilirler.\u201d \u00a0\u015feklinde olup; yeni sat\u0131n alan malike, eski malikin s\u00f6zle\u015fme s\u00fcresinin sonunu beklemeden iktisap tarihinden bir ay i\u00e7inde ihtarname tebli\u011f etmek ko\u015fuluyla, takip eden alt\u0131 ay i\u00e7inde tahliye davas\u0131 a\u00e7abilme olana\u011f\u0131n\u0131 tan\u0131maktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">17. Nitekim, 01.07.2012 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 351. maddesinde de benzer bir d\u00fczenlemeye yer verilerek;<br \/>\n\u201cKiralanan\u0131 sonradan edinen ki\u015fi, onu kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini alt\u0131 ay sonra a\u00e7aca\u011f\u0131 bir davayla sona erdirebilir.<br \/>\nKiralanan\u0131 sonradan edinen ki\u015fi, dilerse gereksinim sebebiyle s\u00f6zle\u015fmeyi sona erdirme hakk\u0131n\u0131, s\u00f6zle\u015fme s\u00fcresinin bitiminden ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava yoluyla da kullanabilir.\u201d h\u00fckm\u00fc getirilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">18. Dolay\u0131s\u0131yla, yeni malik iktisap tarihinden itibaren bir ay i\u00e7inde kirac\u0131ya tebli\u011f ettirece\u011fi ihtarname ile ihtiya\u00e7 iddias\u0131n\u0131 kirac\u0131ya bildirdikten sonra tahliye ger\u00e7ekle\u015fmezse takip eden alt\u0131 ay i\u00e7inde tahliye davas\u0131 a\u00e7abilecektir.<\/p>\n<p style=\"text-align: justify;\">19. A\u00e7\u0131lacak davada tahliyeye karar verilebilmesi i\u00e7in ihtiyac\u0131n varl\u0131\u011f\u0131n\u0131n ayr\u0131ca kan\u0131tlanmas\u0131 gerekir.<\/p>\n<p style=\"text-align: justify;\">20. Nitekim, ayn\u0131 ilkeler Hukuk Genel Kurulunun 13.02.2002 tarihli ve 2002\/6-23 E.-2002\/94 K.; 04.03.2009 tarihli ve 2009\/6-74 E., 2009\/98 K.; 18.02.2015 tarihli ve 2014\/6-2410 E., 2015\/818 K. say\u0131l\u0131 kararlar\u0131nda da benimsenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">21. Yap\u0131lan a\u00e7\u0131klamalar \u0131\u015f\u0131\u011f\u0131nda somut olay de\u011ferlendirildi\u011finde; davac\u0131 09.05.2012 tarihinde sat\u0131n ald\u0131\u011f\u0131 ta\u015f\u0131nmazda, eski malikin kirac\u0131s\u0131 olarak bulunan daval\u0131ya konut ihtiyac\u0131n\u0131 belirterek kira s\u00f6zle\u015fmesinin yenilenmeyece\u011fini 10.05.2012 tarihli ihtarnameyle bildirmi\u015f, kiralanan\u0131n bo\u015falt\u0131lmamas\u0131 \u00fczerine ihtiya\u00e7 nedeniyle daval\u0131n\u0131n ta\u015f\u0131nmazdan tahliyesini istemi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">22. Az yukarda belirtildi\u011fi \u00fczere ta\u015f\u0131nmaz\u0131 iktisap eden kimse dilerse eski malik ile kirac\u0131 aras\u0131nda yap\u0131lm\u0131\u015f s\u00f6zle\u015fmeye dayanarak s\u00f6zle\u015fmenin sonunda, dilerse mevzuatta \u00f6ng\u00f6r\u00fclen s\u00fcrelerden yararlanarak ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7abilir. Yeni malikin bu se\u00e7eneklerden hangisi yarar\u0131na ise onu tercih etme hakk\u0131 vard\u0131r. Nitekim, davac\u0131 da \u00f6ng\u00f6r\u00fclen s\u00fcrelerden yararlanarak ihtiya\u00e7 nedeniyle tahliye isteminde bulunmu\u015ftur.<\/p>\n<p style=\"text-align: justify;\">23. Gelinen noktada, uyu\u015fmazl\u0131k \u00e7er\u00e7evesinde, davac\u0131n\u0131n ger\u00e7ek, samimi ve zorunlu bir konut ihtiyac\u0131 i\u00e7inde oldu\u011funu kan\u0131tlay\u0131p kan\u0131tlayamad\u0131\u011f\u0131 \u00f6nem arz etmektedir.<\/p>\n<p style=\"text-align: justify;\">24. \u0130htiya\u00e7 iddias\u0131na dayal\u0131 davalarda tahliyeye karar verilebilmesi i\u00e7in ihtiyac\u0131n ger\u00e7ek, samimi ve zorunlu oldu\u011funun kan\u0131tlanmas\u0131 gerekir. Devaml\u0131l\u0131k arz etmeyen ge\u00e7ici ihtiya\u00e7 tahliye nedeni yap\u0131lamayaca\u011f\u0131 gibi hen\u00fcz do\u011fmam\u0131\u015f veya ger\u00e7ekle\u015fmesi uzun bir s\u00fcreye ba\u011fl\u0131 olan ihtiya\u00e7 da tahliye sebebi olarak kabul edilemez. Davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihte ihtiya\u00e7 sebebinin varl\u0131\u011f\u0131 yeterli olmay\u0131p bu ihtiyac\u0131n yarg\u0131lama s\u0131ras\u0131nda da devam etmesi gerekir.<\/p>\n<p style=\"text-align: justify;\">25. Eldeki davada, dava tarihinde yurt d\u0131\u015f\u0131nda ya\u015fayan davac\u0131n\u0131n yurda d\u00f6n\u00fc\u015f ihtiyac\u0131 nedeniyle ta\u015f\u0131nmaz ald\u0131\u011f\u0131 ve dolay\u0131s\u0131yla sat\u0131n al\u0131nan ta\u015f\u0131nmaza ihtiya\u00e7 duydu\u011fu hususlar\u0131 yarg\u0131lama s\u0131ras\u0131nda dinletilmi\u015f olan tan\u0131klarla ispatlanm\u0131\u015ft\u0131r. Ayr\u0131ca, dosya aras\u0131na temyiz a\u015famas\u0131nda giren ABD\u2019de \u00e7al\u0131\u015f\u0131lan \u015firketten 31.05.2013 tarihinde istifa edildi\u011fine dair belge ile T\u00fcrkiye\u2019ye kesin d\u00f6n\u00fc\u015f yap\u0131lmak i\u00e7in al\u0131nan 10.05.2013 tarihli ikametg\u00e2h nakil belgesinden ise konut ihtiyac\u0131n\u0131n yarg\u0131lama s\u0131ras\u0131nda da devam etti\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">26. Yarg\u0131lama s\u0131ras\u0131nda davaya konu konutun tahliye edilmi\u015f olmas\u0131 nedeniyle, Mahkemece davan\u0131n konusuz kald\u0131\u011f\u0131ndan bahisle karar verilmesine yer olmad\u0131\u011f\u0131na h\u00fckmedilmi\u015ftir. Bu noktada \u00f6nem arz eden 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu\u2019nun (HMK) 331\/1 maddesi ise \u201cDavan\u0131n konusuz kalmas\u0131 sebebiyle davan\u0131n esas\u0131 hakk\u0131nda bir karar verilmesine gerek bulunmayan h\u00e2llerde, h\u00e2kim, davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihteki taraflar\u0131n hakl\u0131l\u0131k durumuna g\u00f6re yarg\u0131lama giderlerini takdir ve h\u00fckmeder.\u201d \u015feklinde d\u00fczenlenmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">27. An\u0131lan madde do\u011frultusunda, davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihte haks\u0131z oldu\u011fu tespit edilen taraf yarg\u0131lama giderlerini \u00f6demekle y\u00fck\u00fcml\u00fc olacakt\u0131r. Davac\u0131n\u0131n konut ihtiyac\u0131n\u0131n ger\u00e7ek, samimi ve zorunlu oldu\u011fu t\u00fcm dosya i\u00e7eri\u011fi ile anla\u015f\u0131lm\u0131\u015ft\u0131r. Bu durumda Mahkemece \u00d6zel Daire bozma karar\u0131na uyulmak suretiyle davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihte davac\u0131n\u0131n hakl\u0131 oldu\u011fu g\u00f6zetilerek HMK\u2019n\u0131n 331\/1. maddesi uyar\u0131nca yarg\u0131lama giderlerine ve vek\u00e2let \u00fccretine h\u00fckmedilmesi gerekirken \u00f6nceki kararda direnilmesi usul ve yasaya ayk\u0131r\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">28. Bu nedenle direnme karar\u0131 bozulmal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">V.
