Md. 328\/Son Maddesi Uyar\u0131nca Bir Sonraki Fesih D\u00f6nemi \u0130\u00e7in Ge\u00e7erli Olaca\u011f\u0131\/Fesih Bildiriminin Alt\u0131 Ayl\u0131k Kira D\u00f6neminin Sonu \u0130\u00e7in \u00dc\u00e7 Ayl\u0131k Fesih Bildirim S\u00fcresine Uyularak Yap\u0131ld\u0131\u011f\u0131 ve Davan\u0131n S\u00fcresinde A\u00e7\u0131ld\u0131\u011f\u0131 Anla\u015f\u0131lmakla \u0130\u015fin Esas\u0131n\u0131n \u0130ncelenmesi Gerekirken Davan\u0131n S\u00fcre Y\u00f6n\u00fcnden Reddinin \u0130sabetsiz Oldu\u011fu )<\/p>\n<p style=\"text-align: justify;\"><b>\u00d6ZET :\u00a0<\/b>Dava, kiralanan\u0131n tahliyesi istemine ili\u015fkindir.<\/p>\n<p style=\"text-align: justify;\">TBK&#8217; n\u0131n 328\/son maddesine g\u00f6re, &#8220;S\u00f6zle\u015fmede veya kanunda belirtilen fesih d\u00f6nemine veya bildirim s\u00fcresine uyulmam\u0131\u015fsa, bildirim bir sonraki fesih d\u00f6nemi i\u00e7in ge\u00e7erli olur&#8221; d\u00fczenlemesi bulunmakta olup, daval\u0131ya tebli\u011f edilen ihtar TBK\u2019 n\u0131n 328\/son maddesi uyar\u0131nca bir sonraki fesih d\u00f6nemi i\u00e7in ge\u00e7erli olaca\u011f\u0131ndan, fesih bildiriminin alt\u0131 ayl\u0131k kira d\u00f6neminin sonu i\u00e7in \u00fc\u00e7 ayl\u0131k fesih bildirim s\u00fcresine uyularak yap\u0131ld\u0131\u011f\u0131 ve davan\u0131n s\u00fcresinde a\u00e7\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmakla i\u015fin esas\u0131n\u0131n incelenmesi gerekirken, davan\u0131n s\u00fcre y\u00f6n\u00fcnden reddine karar verilmesi isabetsizdir.<\/p>\n<p style=\"text-align: justify;\"><b>DAVA :\u00a0<\/b>Taraflar aras\u0131ndaki kiralanan\u0131n tahliyesi davas\u0131n\u0131n mahkemece yap\u0131lan yarg\u0131lamas\u0131 sonucunda, davan\u0131n reddine y\u00f6nelik olarak verilen h\u00fckm\u00fcn, s\u00fcresi i\u00e7inde davac\u0131 vekili taraf\u0131ndan temyiz edilmesi \u00fczerine; temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra, dosya i\u00e7erisindeki ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p style=\"text-align: justify;\"><b>KARAR :\u00a0<\/b>Davac\u0131; daval\u0131n\u0131n 24.03.1994 y\u0131l\u0131ndan itibaren s\u00f6zl\u00fc kira s\u00f6zle\u015fmesi uyar\u0131nca kirac\u0131 oldu\u011funu, s\u00f6zle\u015fmenin belirsiz s\u00fcreli oldu\u011funu, 10 y\u0131ll\u0131k uzama s\u00fcresinin doldu\u011funu ileri s\u00fcrerek, daval\u0131n\u0131n tahliyesini istemi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Daval\u0131; davan\u0131n s\u00fcresinde olmad\u0131\u011f\u0131n\u0131 savunarak, davan\u0131n reddini istemi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Mahkemece, 24.09.2014-24.03.2015 d\u00f6nemine g\u00f6re ihtar\u0131n s\u00fcrede olmad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 347.maddesi h\u00fckm\u00fcne g\u00f6re, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda kiraya veren s\u00f6zle\u015fme s\u00fcresinin bitimine dayanarak s\u00f6zle\u015fmeyi sona erdiremez. Ancak, on y\u0131ll\u0131k uzama s\u00fcresi sonunda kiraya veren, bu s\u00fcreyi izleyen her uzama y\u0131l\u0131n\u0131n bitiminden en az \u00fc\u00e7 ay \u00f6nce bildirimde bulunmak ko\u015fuluyla herhangi bir sebep g\u00f6stermeksizin s\u00f6zle\u015fmeye son verebilir.<\/p>\n<p style=\"text-align: justify;\">Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde, kirac\u0131 her zaman, kiraya veren ise kiran\u0131n ba\u015flang\u0131c\u0131ndan on y\u0131l ge\u00e7tikten sonra, genel h\u00fck\u00fcmlere g\u00f6re fesih bildirimiyle s\u00f6zle\u015fmeyi sona erdirebilirler.<\/p>\n<p style=\"text-align: justify;\">6101 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanununun Y\u00fcr\u00fcrl\u00fc\u011f\u00fc ve Uygulama \u015eekli Hakk\u0131nda Kanunun Ge\u00e7ici 2.maddesi uyar\u0131nca, bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girmesinden \u00f6nce TBK.nun 347.maddesinin birinci f\u0131kras\u0131n\u0131n son c\u00fcmlesinde \u00f6ng\u00f6r\u00fclen kira s\u00f6zle\u015fmelerinde 10 y\u0131ll\u0131k uzama s\u00fcresi dolmam\u0131\u015f olmakla birlikte geri kalan s\u00fcre be\u015f y\u0131ldan daha k\u0131sa olanlar hakk\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren be\u015f y\u0131l, on y\u0131ll\u0131k uzama s\u00fcresi dolmu\u015f olanlar hakk\u0131nda da y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren 2 y\u0131l sonra uygulanaca\u011f\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p style=\"text-align: justify;\">Olay\u0131m\u0131za gelince; Davac\u0131 24.03.1994 ba\u015flang\u0131\u00e7 tarihli s\u00f6zl\u00fc kira s\u00f6zle\u015fmesine dayanarak TBK&#8217; nun 347. maddesi gere\u011fince s\u00f6zle\u015fmenin sona ermesi sebebiyle tahliye isteminde bulunmu\u015ftur. Daval\u0131 s\u00f6zle\u015fmenin ba\u015flang\u0131c\u0131na kar\u015f\u0131 \u00e7\u0131kmam\u0131\u015ft\u0131r. Bu durumda uyu\u015fmazl\u0131\u011f\u0131n TBK&#8217; nun 347\/2 maddesinde d\u00fczenlenen belirsiz s\u00fcreli kira s\u00f6zle\u015fmesinin sona ermesi h\u00fck\u00fcmlerine g\u00f6re \u00e7\u00f6z\u00fcmlenmesi gerekir.<\/p>\n<p style=\"text-align: justify;\">TBK&#8217; nun 347\/2. maddesi maddesi gere\u011fince belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde, kirac\u0131 her zaman, kiraya veren ise kiran\u0131n ba\u015flang\u0131c\u0131ndan on y\u0131l ge\u00e7tikten sonra, genel h\u00fck\u00fcmlere g\u00f6re fesih bildirimiyle s\u00f6zle\u015fmeyi sona erdirebilir. Davac\u0131 taraf\u0131ndan daval\u0131ya g\u00f6nderilen 05.01.2015 tarihli ihtar\u0131 daval\u0131ya 09.01.2015 tarihinde tebli\u011f edilmi\u015f dava ise 23.10.2015 tarihinde a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">TBK&#8217; nun 328\/son maddesinde; &#8220;S\u00f6zle\u015fmede veya kanunda belirtilen fesih d\u00f6nemine veya bildirim s\u00fcresine uyulmam\u0131\u015fsa, bildirim bir sonraki fesih d\u00f6nemi i\u00e7in ge\u00e7erli olur.&#8221; d\u00fczenlemesi bulunmaktad\u0131r. Bu durumda daval\u0131ya 09.01.2015 tarihinde tebli\u011f edilen ihtar TBK&#8217; nun 328\/son maddesi uyar\u0131nca bir sonraki fesih d\u00f6nemi i\u00e7in ge\u00e7erli olaca\u011f\u0131ndan, fesih bildiriminin alt\u0131 ayl\u0131k kira d\u00f6neminin sonu i\u00e7in \u00fc\u00e7 ayl\u0131k fesih bildirim s\u00fcresine uyularak yap\u0131ld\u0131\u011f\u0131 ve davan\u0131n s\u00fcresinde a\u00e7\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmakla i\u015fin esas\u0131n\u0131n incelenmesi gerekirken, davan\u0131n s\u00fcre y\u00f6n\u00fcnden reddine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015f, bozmay\u0131 gerektirmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\"><b>SONU\u00c7 :\u00a0<\/b>Yukar\u0131da a\u00e7\u0131klanan sebeplerle 6100 Say\u0131l\u0131 &#8230;ya 6217 Say\u0131l\u0131 Kanunla eklenen ge\u00e7ici 3.madde h\u00fckm\u00fc g\u00f6zetilerek HUMK.n\u0131n 428.maddesi uyar\u0131nca h\u00fckm\u00fcn BOZULMASINA ve pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istenmesi halinde temyiz edene iadesine, 6100 Say\u0131l\u0131 HMK&#8217;nun ge\u00e7ici madde 3 atf\u0131yla 1086 Say\u0131l\u0131 HUMK.nun 440.maddesi gere\u011fince karar d\u00fczeltme yolu kapal\u0131 olmak \u00fczere, 14.12.2017 tarihinde oybirli\u011fiyle karar verildi.<\/p>\n<h3 style=\"text-align: justify;\"><strong>2-) \u0130htarnamenin s\u00fcresinde ke\u015fide edilerek tebli\u011f edildi\u011fi, davan\u0131n da s\u00fcresinde a\u00e7\u0131lm\u0131\u015f oldu\u011fu anla\u015f\u0131ld\u0131\u011f\u0131ndan davan\u0131n kabul\u00fc ile kiralanan\u0131n tahliyesine karar verilmesi gerekir.<br \/>\n<\/strong><\/h3>\n<h4 style=\"text-align: justify;\"><strong>Yarg\u0131tay 3. Hukuk Dairesi <\/strong><strong>2018\/4013 Esas 2018\/6997 Karar\u00a0<\/strong><\/h4>\n<p style=\"text-align: justify;\">Taraflar aras\u0131ndaki kiralanan\u0131n tahliyesi davas\u0131n\u0131n mahkemece yap\u0131lan yarg\u0131lamas\u0131 sonucunda, davan\u0131n reddine y\u00f6nelik olarak verilen h\u00fckm\u00fcn s\u00fcresi i\u00e7erisinde davac\u0131 taraf\u0131ndan temyiz edilmesi \u00fczerine, temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra, dosya i\u00e7erisindeki ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p style=\"text-align: justify;\">Y A R G I T A Y K A R A R I<\/p>\n<p style=\"text-align: justify;\">Davac\u0131, daval\u0131 ile aralar\u0131nda 01.01.1985 ba\u015flang\u0131\u00e7 tarihli bir y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi bulundu\u011funu, daval\u0131n\u0131n on y\u0131ldan fazla s\u00fcredir dava konusu ta\u015f\u0131nmazda kirac\u0131 oldu\u011funu, daval\u0131ya ihtar g\u00f6nderdiklerini buna ra\u011fmen daval\u0131n\u0131n ta\u015f\u0131nmaz\u0131 tahliye etmedi\u011fini belirterek kiralanandan tahliyesini istemi\u015ftir.<br \/>\nDaval\u0131, davan\u0131n reddini dilemi\u015ftir.<br \/>\nMahkemece davan\u0131n reddine karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 taraf\u0131ndan temyiz edilmi\u015ftir.<br \/>\nKiralanan, niteli\u011fi itibariyle T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131na ili\u015fkin h\u00fck\u00fcmlere tabidir. 6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 347. maddesi h\u00fckm\u00fc gere\u011fince konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda kirac\u0131, belirli s\u00fcreli s\u00f6zle\u015fmelerin s\u00fcresinin bitiminden en az onbe\u015f g\u00fcn \u00f6nce bildirimde bulunmad\u0131k\u00e7a, s\u00f6zle\u015fme ayn\u0131 ko\u015fullarla bir y\u0131l i\u00e7in uzat\u0131lm\u0131\u015f say\u0131l\u0131r. Kiraya veren, s\u00f6zle\u015fme s\u00fcresinin bitimine dayanarak s\u00f6zle\u015fmeyi sona erdiremez. Ancak, on y\u0131ll\u0131k uzama s\u00fcresi sonunda kiraya veren, bu s\u00fcreyi izleyen her uzama y\u0131l\u0131n\u0131n bitiminden en az \u00fc\u00e7 ay \u00f6nce bildirimde bulunmak ko\u015fuluyla, herhangi bir sebep g\u00f6stermeksizin s\u00f6zle\u015fmeye son verebilir.<br \/>\n6101 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun Y\u00fcr\u00fcrl\u00fc\u011f\u00fc ve Uygulama \u015eekli Hakk\u0131ndaki Kanunu&#8217;nun Ge\u00e7ici 2. maddesinde bu kanunun y\u00fcr\u00fcrl\u00fc\u011fe girmesinden \u00f6nce T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 347. maddesinin son c\u00fcmlesinde \u00f6ng\u00f6r\u00fclen kira s\u00f6zle\u015fmelerinden on y\u0131ll\u0131k uzama s\u00fcresi dolmam\u0131\u015f olmakla birlikte geri kalan s\u00fcre be\u015f y\u0131ldan daha k\u0131sa olanlar hakk\u0131nda, y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren be\u015f y\u0131l, on y\u0131ll\u0131k uzama s\u00fcresi dolmu\u015f olanlar hakk\u0131nda da y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren iki y\u0131l sonra uygulanaca\u011f\u0131 belirlenmi\u015ftir.<br \/>\nBelirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde, kirac\u0131 her zaman, kiraya veren ise kiran\u0131n ba\u015flang\u0131c\u0131ndan on y\u0131l ge\u00e7tikten sonra, genel h\u00fck\u00fcmlere g\u00f6re fesih bildirimiyle s\u00f6zle\u015fmeyi sona erdirebilirler.<br \/>\nSomut olayda; Taraflar aras\u0131nda 01.01.1985 ba\u015flang\u0131\u00e7 tarihli bir y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi hususunda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Kiralanan, niteli\u011fi itibariyle T\u00fcrk Bor\u00e7lar Kanununun konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131na ili\u015fkin h\u00fck\u00fcmlere tabidir. 6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 347. maddesi h\u00fckm\u00fc gere\u011fince konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda kirac\u0131, belirli s\u00fcreli s\u00f6zle\u015fmelerin s\u00fcresinin bitiminden en az onbe\u015f g\u00fcn \u00f6nce bildirimde bulunmad\u0131k\u00e7a, s\u00f6zle\u015fme ayn\u0131 ko\u015fullarla bir y\u0131l i\u00e7in uzat\u0131lm\u0131\u015f say\u0131l\u0131r. Kiraya veren, s\u00f6zle\u015fme s\u00fcresinin bitimine dayanarak s\u00f6zle\u015fmeyi sona erdiremez. Noterli\u011fi\u2019nin 29.04.2014 tarih ve 06236 yevmiye nolu fesih ihbarnamesi ile s\u00f6zle\u015fmenin fesih edildi\u011fini, ancak daval\u0131n\u0131n kiralanan\u0131 tahliye ve teslim etmedi\u011fini, &#8230; 9.Noterli\u011finin 30.04.2015 tarih, 05265 yevmiye nolu ihtarnamesi ile yasal yollara ba\u015fvurulaca\u011f\u0131n\u0131n daval\u0131ya ihtar edildi\u011fini belirterek T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 347. maddesi gere\u011fince ta\u015f\u0131nmaz\u0131n tahliyesine karar verilmesini istemi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Daval\u0131; dava konusu ta\u015f\u0131nmazda 01.04.2004 ba\u015flang\u0131\u00e7 tarihli, on y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi ile kirac\u0131 olarak bulundu\u011funu, davac\u0131n\u0131n tahliye davas\u0131 dayanak olarak g\u00f6sterdi\u011fi T\u00fcrk Bor\u00e7lar Kanunu 347. maddesi gere\u011fince kira s\u00f6zle\u015fmesinin s\u00fcre bak\u0131m\u0131ndan feshine ili\u015fkin hukuki \u015fartlar\u0131n olu\u015fmad\u0131\u011f\u0131n\u0131 belirterek davan\u0131n reddini savunmu\u015ftur.<\/p>\n<p style=\"text-align: justify;\">Mahkemece; \u201c\u2026kira s\u00f6zle\u015fmesinin ba\u015flang\u0131\u00e7 tarihinin 01.04.2004 tarihi oldu\u011fu, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi 01.07.2012 tarihi itibariyle 10 y\u0131l\u0131n dolmad\u0131\u011f\u0131, bu durumda ge\u00e7ici ikinci maddeye g\u00f6re y\u00fcr\u00fcrl\u00fck tarihinin 5 y\u0131l ertelendi\u011fi ve 01.07.2017 &#8216;den sonra dava konusu s\u00f6zle\u015fme ile ilgili T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 347. maddesinin y\u00fcr\u00fcrl\u00fc\u011fe girmesi sebebiyle davan\u0131n reddine karar vermek gerekti\u011fi..\u201d gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015f, h\u00fckm\u00fcn davac\u0131 taraf\u00e7a temyiz edilmesi \u00fczerine Dairemizin 20.09.2017 tarih 2017\/4387 E-2017\/12331 K say\u0131l\u0131 ilam\u0131 ile onanmas\u0131na karar verilmi\u015f, bunun \u00fczerine davac\u0131 ve daval\u0131 taraf\u00e7a karar d\u00fczeltme talebinde bulunulmu\u015ftur.<\/p>\n<p style=\"text-align: justify;\">1-) Dosyadaki yaz\u0131lara, karar\u0131n dayand\u0131\u011f\u0131 delillerle kanuni gerektirici sebeplere, delillerin takdirinde bir isabetsizlik g\u00f6r\u00fclmemesine g\u00f6re, davac\u0131 taraf\u0131n Dairemizin 20.09.2017 tarih 2017\/4387 E-2017\/12331 K say\u0131l\u0131 ilam\u0131na kar\u015f\u0131 sair d\u00fczeltme istemleri yerinde de\u011fildir.<\/p>\n<p style=\"text-align: justify;\">2-) Daval\u0131n\u0131n karar d\u00fczeltme istemi \u00fczerine yap\u0131lan incelemede;<\/p>\n<p style=\"text-align: justify;\">Kiralanan, niteli\u011fi itibariyle T\u00fcrk Bor\u00e7lar Kanunu\u2019nun konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131na ili\u015fkin h\u00fck\u00fcmlere tabidir. 6098 Say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 347. maddesi h\u00fckm\u00fc gere\u011fince konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda kirac\u0131, belirli s\u00fcreli s\u00f6zle\u015fmelerin s\u00fcresinin bitiminden en az on be\u015f g\u00fcn \u00f6nce bildirimde bulunmad\u0131k\u00e7a, s\u00f6zle\u015fme ayn\u0131 ko\u015fullarla bir y\u0131l i\u00e7in uzat\u0131lm\u0131\u015f say\u0131l\u0131r. Kiraya veren, s\u00f6zle\u015fme s\u00fcresinin bitimine dayanarak s\u00f6zle\u015fmeyi sona erdiremez.
