Kiraya verenin ayn\u0131 b\u00f6lgede davaya konu ta\u015f\u0131nmaza benzer nitelikte ba\u015fka bir ta\u015f\u0131nmaz\u0131n\u0131n olmas\u0131 durumunda bu ta\u015f\u0131nmaz\u0131n i\u00e7inde kirac\u0131 var m\u0131 yok mu ona bak\u0131lmas\u0131 gerekir. Kirac\u0131n\u0131n olmas\u0131 durumunda mahkeme neden bu ta\u015f\u0131nmaz i\u00e7in dava a\u00e7\u0131ld\u0131 diye bir soru sormamal\u0131d\u0131r. Kiraya veren istedi\u011fi ta\u015f\u0131nmaz i\u00e7in ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7abilir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiraya Veren Malik Olmak Zorunda M\u0131?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kiraya veren ve malik farkl\u0131 ki\u015filer olabilir. Malik ev veya i\u015fyerinin kiralanmas\u0131 i\u00e7in birine yetki verebilir. Kiraya veren ki\u015finin malik olmas\u0131 zorunlu de\u011fildir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiraya Veren ve Malikin Farkl\u0131 Ki\u015filer Olmas\u0131 Halinde Tahliye Davas\u0131n\u0131 Kim A\u00e7abilir?<\/strong><\/h1>\n<p style=\"text-align: justify;\">TBK 350. madde ve devam\u0131 maddelerinde kiraya veren kiralayan\u0131n dava a\u00e7ma hakk\u0131 mutlakt\u0131r. Malik kiraya veren de\u011filse bu malik \u00f6ncelikle kirac\u0131ya ihtar g\u00f6ndererek malik oldu\u011funu belirtmelidir. Ancak bundan sonra dava a\u00e7abilecektir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiraya Verenin Fesih Hakk\u0131<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kiraya verenin fesih hakk\u0131 vard\u0131r. Ancak bu fesih hakl\u0131 olmak zorundad\u0131r. Kiraya veren s\u00f6zle\u015fme s\u00fcresinin bitmesine dayanarak kira s\u00f6zle\u015fmesini feshedemez. Ancak 10 y\u0131ll\u0131k uzama s\u00fcresi bu durumun istisnas\u0131d\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Birden Fazla Kiraya Verenin Olmas\u0131 Halinde Dava Nas\u0131l A\u00e7\u0131l\u0131r?<\/strong><\/h1>\n<p style=\"text-align: justify;\">Tahliye davas\u0131 b\u00f6l\u00fcnemez bir davad\u0131r. Kiraya verenin birden fazla olmas\u0131 halinde kiraya verenler aras\u0131nda zorunlu dava arkada\u015fl\u0131\u011f\u0131 bulunur. T\u00fcm kiraya verenlerin ortak bir \u015fekilde dava a\u00e7mas\u0131 gerekir. Tek bir ki\u015finin dava a\u00e7mas\u0131 halinde di\u011fer kiraya verenler davaya kat\u0131larak davan\u0131n devam ettirilmesi sa\u011flanabilir. Ancak ihtar\u0131n mutlaka kiraya verenler taraf\u0131ndan birlikte \u00e7ekilmesi gerekir. Eksikli\u011fin sonradan giderilmesi m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kiraya Verenin Hapis Hakk\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">T\u00fcrk Bor\u00e7lar Kanunu 336. maddeye g\u00f6re;<\/p>\n<p style=\"text-align: justify;\">Ta\u015f\u0131nmaz kiralar\u0131nda kiraya veren, i\u015flemi\u015f bir y\u0131ll\u0131k ve i\u015flemekte olan alt\u0131 ayl\u0131k kira bedelinin g\u00fcvencesi olmak \u00fczere, kiralananda bulunan ve kiralanan\u0131n d\u00f6\u015fenmesine veya kullan\u0131lmas\u0131na yarayan ta\u015f\u0131n\u0131rlar \u00fczerinde hapis hakk\u0131na sahiptir. Kiraya verenin hapis hakk\u0131, alt kirac\u0131n\u0131n as\u0131l kirac\u0131ya olan kira borcunu a\u015fmamak \u00fczere, alt kirac\u0131n\u0131n kiralanana getirdi\u011fi ayn\u0131 nitelikteki ta\u015f\u0131n\u0131rlar\u0131 da kapsar. Hapis hakk\u0131, kirac\u0131n\u0131n haczedilemeyen mallar\u0131 \u00fczerinde kullan\u0131lamaz.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiraya Verenin \u00d6l\u00fcm\u00fc Halinde Tahliye<\/strong><\/h1>\n<p style=\"text-align: justify;\">T\u00fcrk Bor\u00e7lar Kanunu madde 205\u2019e bak\u0131ld\u0131\u011f\u0131nda, kiraya verenin \u00f6l\u00fcm\u00fc halinde, miras\u00e7\u0131lar halef olaca\u011f\u0131ndan, kira s\u00f6zle\u015fmesinin taraf\u0131, herhangi bir yenilemeye gerek duyulmadan miras\u00e7\u0131lar olmaktad\u0131r. Miras\u00e7\u0131lar kira s\u00f6zle\u015fmesine devam etmek istemezlerse, s\u00f6zle\u015fmesinin feshi i\u00e7in \u015fartlar\u0131n olu\u015ftu\u011funa dair bir ihtarname d\u00fczenleyerek hukuki s\u00fcreci ba\u015flatabilirler. Kiraya verenin \u00f6l\u00fcm\u00fc halinde, miras\u00e7\u0131lar kira hakk\u0131na elbirli\u011fi halinde malik s\u0131fat\u0131yla sahip olduklar\u0131ndan birlikte hareket etmek zorundad\u0131rlar.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiraya Verenin \u00d6l\u00fcm\u00fc Halinde Kira S\u00f6zle\u015fmesi<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kiraya veren ki\u015finin \u00f6lmesi durumunda s\u00f6zle\u015fme ayn\u0131 \u015fekilde kiraya verenin miras\u00e7\u0131lar\u0131yla taraf olacak \u015fekilde devam etmektedir. Kiraya verenin \u00f6lmesi halinde yeni bir s\u00f6zle\u015fme yap\u0131lmas\u0131 zorunlu de\u011fildir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Ortak Giderleri \u00d6demeyen Kirac\u0131n\u0131n Tahliyesi<\/strong><\/h1>\n<p style=\"text-align: justify;\">Aidat \u00f6demeyen kirac\u0131y\u0131 tahliye edilir mi? Kirac\u0131 aidat\u0131 \u00f6demezse tahliye edebilir miyim?<\/p>\n<p style=\"text-align: justify;\">Kirac\u0131, aksine s\u00f6zle\u015fme ve yerel adet olmad\u0131k\u00e7a, kira bedelini ve gerekiyorsa yan giderleri, her ay\u0131n sonunda ve en ge\u00e7 kira s\u00fcresinin bitiminde \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr. (TBK m. 314)<\/p>\n<p style=\"text-align: justify;\">Kirac\u0131 aidat\u0131 \u00f6demek zorundad\u0131r. Hem ev sahibi hem de kirac\u0131 aidattan m\u00fcteselsil (birlikte) olarak sorumludur. Kirac\u0131 aidat\u0131 \u00f6demedi\u011fi takdirde ev sahibi \u00f6demek zorundad\u0131r. Ev sahibi aidat\u0131 \u00f6dedikten sonra kirac\u0131ya isterse ihtarname g\u00f6nderebilir isterse tahliye talepli icra takibi ba\u015flatabilir.<\/p>\n<p style=\"text-align: justify;\">Kat M\u00fclkiyeti Yasas\u0131&#8217;n\u0131n 20. maddesine g\u00f6re ana ta\u015f\u0131nmaz\u0131n ortak giderlerinden kat malikleri sorumludur. 22. madde h\u00fckm\u00fc gere\u011fince de kat malikinin 20. madde uyar\u0131nca pay\u0131na d\u00fc\u015fecek gider ve avans borcundan ve gecikme tazminat\u0131ndan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin birinde kira akdine, oturma (s\u00fckna) hakk\u0131na veya ba\u015fka bir nedene dayanarak devaml\u0131 bir \u015fekilde faydalananlar da m\u00fc\u015ftereken ve m\u00fcteselsilen sorumludur. Ancak, kirac\u0131n\u0131n sorumlulu\u011fu \u00f6demekle y\u00fck\u00fcml\u00fc oldu\u011fu kira tutar\u0131 ile s\u0131n\u0131rl\u0131d\u0131r. Yasa&#8217;n\u0131n bu 22. maddesi h\u00fckm\u00fcnce kirac\u0131n\u0131n ana ta\u015f\u0131nmaz\u0131n y\u00f6netimine kar\u015f\u0131 ortak giderlerden sorumlulu\u011fu onun kirac\u0131l\u0131k s\u0131fat\u0131n\u0131n devam etti\u011fi s\u00fcrece s\u00f6z konusu olup, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fc bo\u015faltt\u0131ktan ve kirac\u0131l\u0131k s\u0131fat\u0131 bittikten sonra ortak giderlerden sorumlulu\u011fu da sona erece\u011finden y\u00f6netici bu durumdaki ki\u015fi hakk\u0131nda dava a\u00e7amaz ve Kat M\u00fclkiyeti Yasas\u0131 h\u00fck\u00fcmlerine g\u00f6re ortak gider borcunu \u00f6demesini isteyemez.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiraya Verenin \u0130htiyac\u0131 Nedeniyle Tahliye<\/strong><\/h1>\n<p style=\"text-align: justify;\">TBK 350. maddeye g\u00f6re; Kiraya veren, kira s\u00f6zle\u015fmesini; Kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiraya Veren Annesi ve Babas\u0131 \u0130\u00e7in \u0130htiya\u00e7 Nedeniyle Tahliye Davas\u0131 A\u00e7abilir Mi?<\/strong><\/h1>\n<p style=\"text-align: justify;\">TBK m.350 g\u00f6re; kiraya veren kendisi, e\u015fi, altsoy, \u00fcstsoy ve kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filer i\u00e7in tahliye davas\u0131 a\u00e7abilir. Yani kiraya veren anne ve babas\u0131n\u0131n oturmas\u0131 i\u00e7in tahliye davas\u0131 a\u00e7abilir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiraya Verenin Tahliye Sebepleri<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kiraya veren \u00e7e\u015fitli sebeplerle kirac\u0131y\u0131 tahliye ettirebilir. Bunlar:<\/p>\n<ul style=\"text-align: justify;\">\n<li>\u0130htiya\u00e7 nedeniyle tahliye,<\/li>\n<li>\u0130mar ve in\u015fa sebebiyle tahliye,<\/li>\n<li>Yeni Sat\u0131n alma nedeniyle tahliye,<\/li>\n<li>Kirac\u0131n\u0131n kiray\u0131 \u00f6dememesi veya kiray\u0131 ge\u00e7 \u00f6demesi,<\/li>\n<li>Kirac\u0131n\u0131n veya e\u015finin ayn\u0131 belediye s\u0131n\u0131rlar\u0131 i\u00e7inde konutunun olmas\u0131,<\/li>\n<li>10 y\u0131ll\u0131k kira s\u00fcresinin dolmas\u0131<\/li>\n<\/ul>\n<h1><strong>Kirac\u0131m Kiray\u0131 \u00d6demiyor<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kirac\u0131m Kiray\u0131 \u00d6demiyor Ne Yapmal\u0131y\u0131m? T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 13.maddesine g\u00f6re,\u00a0<strong>kirac\u0131<\/strong>\u00a0kira bedelini \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.\u00a0<strong>Kirac\u0131\u00a0<\/strong>kira bedelini kira s\u00f6zle\u015fmesinde belirtilen tarihte ya da tarih aral\u0131\u011f\u0131nda eksiksiz olarak \u00f6demek zorundad\u0131r. Aksi halde kirac\u0131 temerr\u00fcde d\u00fc\u015fm\u00fc\u015f olur. <strong>Kiras\u0131n\u0131\u00a0<\/strong>\u00f6demeyen <strong>kirac\u0131y\u0131 tahliye davas\u0131 a\u00e7mak m\u00fcmk\u00fcnd\u00fcr.<\/strong><\/p>\n<p style=\"text-align: justify;\">Kirac\u0131 kiray\u0131 \u00f6dememesi durumunda; bir\u00a0kira\u00a0d\u00f6nemi i\u00e7inde kirac\u0131n\u0131n kiras\u0131n\u0131n \u00f6dememesi nedeniyle iki hakl\u0131 ihtar g\u00f6nderilmesi durumunda ta\u015f\u0131nmaz\u0131n bulundu\u011fu yerdeki Sulh Hukuk Mahkemesinde tahliye davas\u0131 a\u00e7\u0131lmas\u0131 suretiyle kirac\u0131y\u0131 tahliye etmek m\u00fcmk\u00fcnd\u00fcr.
