Meslek hastal\u0131klar\u0131, i\u015fyeri ortam\u0131nda bulunan fakt\u00f6rlerin etkisi ile meydana gelen hastal\u0131klar\u0131n ortak ad\u0131d\u0131r. Yani sigortal\u0131n\u0131n mesle\u011fini yaparken her g\u00fcn yerine getirdi\u011fi faaliyetler nedeniyle veya i\u015fin \u00f6zelli\u011finden veya i\u015f \u015fartlar\u0131ndan dolay\u0131 yapt\u0131\u011f\u0131 i\u015f ile ba\u011flant\u0131l\u0131 olarak meydana gelen hastal\u0131klar meslek hastal\u0131\u011f\u0131 olarak kabul edilmektedir.<\/p>\n<p style=\"text-align: justify;\">5510 say\u0131l\u0131 kanun, meslek hastal\u0131\u011f\u0131 nedeniyle hak sahibi olabilecek ki\u015fi olarak \u201csigortal\u0131\u201d olan i\u015f\u00e7iyi g\u00f6stermi\u015ftir. Ancak, i\u015f\u00e7inin sigortal\u0131 olmad\u0131\u011f\u0131 durumda da, meslek hastal\u0131\u011f\u0131 kurumca ba\u015fka t\u00fcrl\u00fc tespit edilmedi\u011fi takdirde, meslek hastal\u0131\u011f\u0131 tespit davas\u0131 a\u00e7\u0131larak hem sigortal\u0131l\u0131\u011f\u0131n hem de meslek hastal\u0131\u011f\u0131n\u0131n tespit edilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Meslek hastal\u0131\u011f\u0131, \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanununa g\u00f6re ise mesleki risklere maruz kalma sonucu ortaya \u00e7\u0131kan hastal\u0131\u011f\u0131 ifade etmektedir.<\/p>\n<p style=\"text-align: justify;\">Ayr\u0131ca bilinmelidir ki; Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan \u00a0\u00e7\u0131kar\u0131lan 2020\/12 say\u0131l\u0131 Genelgede,<em> \u201cCOVID-19 vir\u00fcs\u00fcn\u00fcn bula\u015f\u0131c\u0131 bir hastal\u0131k oldu\u011fu dikkate al\u0131nd\u0131\u011f\u0131nda s\u00f6z konusu salg\u0131na maruz kalan ve sa\u011fl\u0131k hizmet sunucular\u0131na m\u00fcracaat eden sigortal\u0131lara hastal\u0131k sigortas\u0131 kapsam\u0131nda provizyon al\u0131nmas\u0131 gerekmektedir.\u201d i<\/em>fadelerine yer verilerek s\u00f6z konusu durum &#8220;hastal\u0131k&#8221; olarak de\u011ferlendirilmi\u015ftir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131\u011f\u0131 Unsurlar\u0131<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li>Meslek hastal\u0131\u011f\u0131, i\u015f\u00e7inin y\u00fcr\u00fctt\u00fc\u011f\u00fc i\u015f sebebiyle ortaya \u00e7\u0131kmal\u0131d\u0131r. Yani sigortal\u0131n\u0131n u\u011frad\u0131\u011f\u0131 zarar ile meslek hastal\u0131\u011f\u0131 aras\u0131nda uygun nedensellik ba\u011f\u0131 bulunmal\u0131d\u0131r.<\/li>\n<li>Hastal\u0131\u011fa yakalanm\u0131\u015f ki\u015finin sigortal\u0131 olmas\u0131 gerekmektedir. Sigortal\u0131 de\u011filse o zaman sigortal\u0131l\u0131\u011f\u0131n tespiti davas\u0131 a\u00e7\u0131lmas\u0131 gerekir.<\/li>\n<li>Hastal\u0131k, i\u015fin niteli\u011fi veya i\u015fin y\u00fcr\u00fct\u00fcm \u015fartlar\u0131na ba\u011fl\u0131 olarak ortaya \u00e7\u0131kmal\u0131d\u0131r.<\/li>\n<li>Hastal\u0131k, i\u015f\u00e7iyi bedensel veya ruhsal a\u00e7\u0131dan etkileyerek bir engellili\u011fe yol a\u00e7mal\u0131d\u0131r.<\/li>\n<li>\u0130\u015fin y\u00fcr\u00fct\u00fclmesi s\u0131ras\u0131nda ger\u00e7ekle\u015fmi\u015f olmal\u0131d\u0131r.<\/li>\n<li>Meslek hastal\u0131\u011f\u0131, Sosyal Sigorta Sa\u011fl\u0131k \u0130\u015flemleri Y\u00f6netmeli\u011fi ve T\u00fcz\u00fc\u011f\u00fcnde yer alan hastal\u0131klardan olmal\u0131d\u0131r.<\/li>\n<li>Hastal\u0131k, SGK sa\u011fl\u0131k raporuyla veya mahkemede a\u00e7\u0131lan bir tespit davas\u0131yla saptanmal\u0131d\u0131r.<\/li>\n<li>Meslek hastal\u0131\u011f\u0131, i\u015f\u00e7inin belli bir devaml\u0131l\u0131k arz eden \u00e7al\u0131\u015fma s\u00fcrecinde ortaya \u00e7\u0131kmal\u0131d\u0131r. Ani veya tesad\u00fcfi geli\u015fen olaylar neticesinde i\u015f\u00e7inin bedensel veya ruhsal zarar g\u00f6rmesi \u201ci\u015f kazas\u0131\u201d olarak kabul edilir. Bu durumda i\u015f kazas\u0131 nedeniyle tazminat davas\u0131 a\u00e7\u0131l\u0131r. Meslek hastal\u0131\u011f\u0131 ise belli bir s\u00fcre sonunda yava\u015f yava\u015f bedensel ve ruhsal zararlar\u0131n geli\u015fmesidir.<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131klar\u0131 Nelerdir?<\/strong><\/h3>\n<ul style=\"text-align: justify;\">\n<li>Kafada meydana gelen hasarlar<\/li>\n<li>G\u00f6z ar\u0131zalar\u0131<\/li>\n<li>Y\u00fczde meydana gelecek hasarlar<\/li>\n<li>Kulak ar\u0131zalar\u0131<\/li>\n<li>Boyun ar\u0131zalar\u0131<\/li>\n<li>G\u00f6\u011f\u00fcs hastal\u0131klar\u0131<\/li>\n<li>Omuz ar\u0131zalar\u0131<\/li>\n<li>Kol ar\u0131zalar\u0131<\/li>\n<li>El, el bile\u011fi, el parmaklar\u0131nda olu\u015fan ar\u0131zalar<\/li>\n<li>Omurga ar\u0131zalar\u0131<\/li>\n<li>Kar\u0131n hastal\u0131klar\u0131 veya ar\u0131zalar\u0131<\/li>\n<li>Pelvis ya da alt ekstremite ar\u0131zalar\u0131<\/li>\n<li>Endokrin, metabolizma ar\u0131zalar\u0131 vd.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131\u011f\u0131 Bildirim S\u00fcresi<\/strong><\/h2>\n<div class=\"d9FyLd\" style=\"text-align: justify;\">6331 Say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu Madde 14:<\/div>\n<div class=\"d9FyLd\" style=\"text-align: justify;\"><em>&#8220;\u0130\u015fveren, a\u015fa\u011f\u0131daki hallerde belirtilen s\u00fcrede Sosyal G\u00fcvenlik Kurumuna bildirimde <\/em><em>bulunur:<\/em><\/div>\n<p style=\"text-align: justify;\"><em>a) \u0130\u015f kazalar\u0131n\u0131 kazadan sonraki \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u00e7inde.<\/em><br \/>\n<em>b) Sa\u011fl\u0131k hizmeti sunucular\u0131 veya i\u015fyeri hekimi taraf\u0131ndan kendisine bildirilen meslek <\/em><em>hastal\u0131klar\u0131n\u0131, \u00f6\u011frendi\u011fi tarihten itibaren \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u00e7inde.&#8221;<\/em><\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Yani sigortal\u0131n\u0131n meslek hastal\u0131\u011f\u0131na tutuldu\u011funu \u00f6\u011frenen i\u015fverenin, bunu \u00f6\u011frendi\u011fi g\u00fcnden ba\u015flayarak \u00fc\u00e7 i\u015f g\u00fcn\u00fc i\u00e7inde \u0130\u015f Kazas\u0131 ve Meslek Hastal\u0131\u011f\u0131 Bildirgesi ile Sosyal G\u00fcvenlik Kurumuna bildirmesi zorunludur.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">Ki\u015fi Ba\u011fKur\u2019lu ise kendisi taraf\u0131ndan, bildirim yap\u0131l\u0131r.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><em>Bildirimler;<\/em><\/p>\n<p style=\"text-align: justify;\">a) Hastaneler veya i\u015fyeri hekimlerince meslek hastal\u0131\u011f\u0131 \u00f6n tan\u0131s\u0131 konulan ki\u015filer, SGK taraf\u0131ndan yetkilendirilen hastanelere sevk edilir.<\/p>\n<p style=\"text-align: justify;\">b) \u00c7al\u0131\u015fan veya emeklinin meslek hastal\u0131\u011f\u0131 iddias\u0131 ile SGK \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcne veya yetkili hastanelere \u015fahsi ba\u015fvurusu ile yap\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">c) \u015e\u00fcpheli vakalar\u0131n meslekte kazanma g\u00fcc\u00fc kayb\u0131 oranlar\u0131n\u0131n tespitinde esas al\u0131nacak sa\u011fl\u0131k kurulu raporlar\u0131; Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 Meslek Hastal\u0131klar\u0131 Hastaneleri, E\u011fitim ve Ara\u015ft\u0131rma Hastaneleri ile Devlet \u00dcniversite Hastaneleri taraf\u0131ndan d\u00fczenlenir.<\/p>\n<p style=\"text-align: justify;\">Yetkilendirilen sa\u011fl\u0131k hizmeti sunucular\u0131 meslek hastal\u0131\u011f\u0131 tan\u0131s\u0131 koyduklar\u0131 vakalar\u0131 <strong>en ge\u00e7 on g\u00fcn<\/strong> i\u00e7inde Sosyal G\u00fcvenlik Kurumuna bildirmekle y\u00fck\u00fcml\u00fc k\u0131l\u0131nm\u0131\u015f, y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmeyenlere idari para cezas\u0131 uygulanaca\u011f\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<h2 style=\"text-align: justify;\"><span id=\"Meslek_Hastaliklari_Nasil_Tespit_Edilir\" class=\"ez-toc-section\"><\/span><strong>Meslek Hastal\u0131\u011f\u0131n\u0131n Tespiti<\/strong><\/h2>\n<p style=\"text-align: justify;\">Meslek hastal\u0131klar\u0131n\u0131n tespiti, meslek hastal\u0131\u011f\u0131 nedeniyle tazminat davas\u0131 sonucunda al\u0131nacak tazminat miktar\u0131n\u0131n hesaplanmas\u0131nda b\u00fcy\u00fck \u00f6nem arz etmektedir. Ayr\u0131ca meslek hastal\u0131klar\u0131 etkenle i\u015f\u00e7inin ilk temas\u0131ndan 1 hafta ile 40 y\u0131l sonra ortaya \u00e7\u0131kabilmektedir. Bu nedenle \u00e7al\u0131\u015f\u0131rken i\u015fyerindeki t\u00fcm kay\u0131tlar\u0131n d\u00fczenli tutulmas\u0131 ve do\u011fru tespit yap\u0131lmas\u0131 \u00f6nemli olacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Meslek hastal\u0131\u011f\u0131 bildirgesini al\u0131nd\u0131ktan sonra ger\u00e7ekle\u015ftirilen tefti\u015fler ve denetimler sonucunda meslek hastal\u0131\u011f\u0131 olup olmad\u0131\u011f\u0131na ve \u015fartlar\u0131n ger\u00e7ekle\u015fip ger\u00e7ekle\u015fmedi\u011fine ili\u015fkin haller Sosyal G\u00fcvenlik Kurumu Sa\u011fl\u0131k Kurulu taraf\u0131ndan tespit edilmektedir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131\u011f\u0131 Raporu<\/strong><\/h2>\n<p style=\"text-align: justify;\">Meslek hastal\u0131\u011f\u0131 sonucu meslekte kazanma g\u00fcc\u00fc kayb\u0131 oranlar\u0131 tespitinde esas al\u0131nacak sa\u011fl\u0131k kurulu raporlar\u0131n\u0131 d\u00fczenlemeye, Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 meslek hastal\u0131klar\u0131 hastaneleri ile e\u011fitim ve ara\u015ft\u0131rma hastaneleri ve Devlet \u00fcniversitesi hastaneleri yetkilidir.<\/p>\n<p style=\"text-align: justify;\">SGK Sa\u011fl\u0131k Kurulu, sigortal\u0131n\u0131n Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 \u00e7al\u0131\u015fan Meslek Hastal\u0131klar\u0131 Hastaneleri yahut di\u011fer tam te\u015fekk\u00fcll\u00fc devlet hastaneleri ve \u00fcniversite hastanelerinden d\u00fczenlenen usul\u00fcne uygun sa\u011fl\u0131k kurulu raporlar\u0131 ve tutulan t\u0131bbi belgeler ve gerekli g\u00f6r\u00fclmesi halinde \u00e7al\u0131\u015f\u0131lan i\u015fyeri \u015fartlar\u0131n\u0131n ve bunlara ili\u015fkin denetim raporlar\u0131n\u0131 inceler ve meslek hastal\u0131\u011f\u0131n\u0131n varl\u0131\u011f\u0131n\u0131 tespit eder. Bunun ard\u0131ndan da mesleki g\u00fc\u00e7 kay\u0131p oran\u0131 tespit edilir.<\/p>\n<p style=\"font-weight: 400; text-align: justify;\">\u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanununa g\u00f6re, meslek hastal\u0131\u011f\u0131, mesleki risklere maruz kalma sonucu ortaya \u00e7\u0131kan hastal\u0131\u011f\u0131 ifade etmektedir. Sigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015ften dolay\u0131 meslek hastal\u0131\u011f\u0131na tutuldu\u011funun; SGK taraf\u0131ndan yetkilendirilen hastane taraf\u0131ndan incelenerek raporlanmas\u0131 gerekir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131\u011f\u0131nda Tazminat<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015fverene kar\u015f\u0131 a\u00e7\u0131lacak olan maddi tazminatlar hakk\u0131nda TBK m.49 h\u00fckm\u00fc esas al\u0131n\u0131r. Buna g\u00f6re; <em>&#8220;Kusurlu ve hukuka ayk\u0131r\u0131 bir fiille ba\u015fkas\u0131na zarar veren, bu zarar\u0131 gidermekle y\u00fck\u00fcml\u00fcd\u00fcr.&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">S\u00f6z konusu h\u00fck\u00fcmden de anla\u015f\u0131laca\u011f\u0131 \u00fczere, bu tazminat\u0131n miktar\u0131 u\u011fran\u0131lan zarar kadar olmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7i, u\u011frad\u0131\u011f\u0131 i\u015f kazas\u0131 ya da meslek hastal\u0131\u011f\u0131 sonucunda bedensel zarara u\u011frayabilir. Bedensel zarar, i\u015f\u00e7inin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn ihl\u00e2linin yan\u0131nda ruh b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn ihl\u00e2lini de kapsar. \u00d6rne\u011fin, i\u015f\u00e7inin ge\u00e7irmi\u015f oldu\u011fu i\u015f kazas\u0131ndan kaynakl\u0131 yayg\u0131n anksiyete bozuklu\u011fu ya da panik bozukluk gibi psikolojik bir hastal\u0131\u011fa yakalanmas\u0131 durumunda, bedensel zarar\u0131n\u0131n meydana geldi\u011fini kabul etmek gerekir.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f kazas\u0131 ya da meslek hastal\u0131\u011f\u0131na u\u011frayan i\u015f\u00e7inin malvarl\u0131\u011f\u0131ndaki e\u015fyaya ili\u015fkin bir zarar\u0131 da s\u00f6z konusu olabilir. \u00d6rne\u011fin i\u015f\u00e7inin, ara\u00e7 ile bir i\u015f kazas\u0131 ge\u00e7irmesi m\u00fcmk\u00fcnd\u00fcr. Bu durumda meydana gelen zarar, kusurlu olan i\u015fveren taraf\u0131ndan tazmin edilmelidir. Bunlar; tedavi giderleri, \u00e7al\u0131\u015f\u0131lmayan d\u00f6nemde u\u011fran\u0131lan kazan\u00e7 kayb\u0131, \u00e7al\u0131\u015fma g\u00fcc\u00fcn\u00fcn azalmas\u0131ndan ya da yitirilmesinden kaynaklanan kay\u0131plar ve ekonomik gelece\u011fin sars\u0131lmas\u0131ndan kaynaklanan kay\u0131plard\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 sonucunda meydana gelen zararlar, meydana gelmeleri bak\u0131m\u0131ndan ani bir olgu de\u011fil, s\u00fcreklilik arz eden olgulardand\u0131r. Bunun d\u0131\u015f\u0131nda, i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 sonucunda meydana gelen zararlar, ki\u015fi, ihtim\u00e2l ve olaydaki kusur gibi de\u011fi\u015fkenler oldu\u011fu i\u00e7in, hesaplanmas\u0131 olduk\u00e7a g\u00fc\u00e7 olan zararlard\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7i, bedensel zarar kalemlerinden ba\u015fkaca zarar\u0131n\u0131n da oldu\u011funu ispatlad\u0131\u011f\u0131 takdirde, o zarar\u0131n tazminini de i\u015fverenden talep edebilmektedir.<\/p>\n<p style=\"text-align: justify;\">Meslekte kazanma g\u00fcc\u00fc kayb\u0131 , i\u015f g\u00f6rebilme \u00e7a\u011f\u0131n\u0131n ve ya\u015fam s\u00fcresinin belirlenmesi, \u00fccretinin belirlenmesi ve taraflar\u0131n kusur durumu ve hakkaniyete etkisi, taraflar\u0131n ve i\u015f\u00e7inin ekonomik durumu gibi esaslar, bunlardan baz\u0131lar\u0131d\u0131r. Yarg\u0131tay bu esaslar\u0131 uygulamak suretiyle, i\u015f\u00e7inin u\u011frad\u0131\u011f\u0131 zarar\u0131 ger\u00e7e\u011fe en yak\u0131n bi\u00e7imde belirlemeye \u00e7al\u0131\u015fmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">K\u0131smen veya tamamen r\u00fccu edilemeyen sosyal g\u00fcvenlik \u00f6demeleri ile ifa amac\u0131n\u0131 ta\u015f\u0131mayan \u00f6demeler, bu zararlar\u0131n belirlenmesinde g\u00f6zetilemez; zarar veya tazminattan indirilemez. Hesaplanan tazminat, miktar esas al\u0131narak hakkaniyet d\u00fc\u015f\u00fcncesi ile art\u0131r\u0131lamaz veya azalt\u0131lamaz. Bu h\u00fck\u00fcmden anla\u015f\u0131laca\u011f\u0131 \u00fczere, Sosyal g\u00fcvenlik Kurumu taraf\u0131ndan kar\u015f\u0131lanmayan ve ayr\u0131ca, kar\u015f\u0131lansa bile i\u015fverene r\u00fccu edilemeyen tazminat miktar\u0131ndan i\u015fveren sorumlu olmaktad\u0131r.<\/p>\n<div class=\"vc_message_box vc_message_box-outline vc_message_box-rounded vc_color-blue\" style=\"text-align: justify;\">\n<div class=\"vc_message_box vc_message_box-outline vc_message_box-rounded vc_color-blue\" style=\"text-align: justify;\">\n<p>\u0130\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 sonucunda i\u015f\u00e7inin \u00f6l\u00fcm\u00fc s\u00f6z konusuysa, bu takdirde, i\u015f\u00e7inin yak\u0131nlar\u0131n\u0131n talep edebilecekleri tazminata ili\u015fkin zarar kalemleri; cenaze giderleri, \u00f6l\u00fcm hemen ger\u00e7ekle\u015fmemi\u015fse tedavi giderleri ile \u00e7al\u0131\u015fma g\u00fcc\u00fcn\u00fcn azalmas\u0131ndan ya da yitirilmesinden do\u011fan kay\u0131plar ve \u00f6lenin deste\u011finden yoksun kalan ki\u015filerin bu sebeple u\u011frad\u0131klar\u0131 kay\u0131plar (destekten yoksun kalma tazminat\u0131) i\u015f\u00e7inin yak\u0131nlar\u0131 taraf\u0131ndan talep edilebilir. \u0130\u015f\u00e7inin yak\u0131nlar\u0131, bu zarar kalemlerinden ba\u015fkaca zarar\u0131n\u0131n da oldu\u011funu ispatlad\u0131\u011f\u0131 takdirde, o zarar\u0131n tazminini de i\u015fverenden talep edebilmektedir.<\/p>\n<\/div>\n<p style=\"text-align: justify;\">\u00c7al\u0131\u015fanlar uzun s\u00fcre ayn\u0131 i\u015fi yapmakta, ayn\u0131 \u015fekilde \u00e7al\u0131\u015fmakta, i\u015fin yap\u0131lma \u015fekli veya niteli\u011fi nedeniyle belirli bir zaman sonra yapt\u0131\u011f\u0131 i\u015ften etkilenmekte ve meslek hastal\u0131\u011f\u0131na yakalanmaktad\u0131r. Meslek hastal\u0131\u011f\u0131na yakalanan i\u015f\u00e7inin ise maddi ve manevi tazminat talep etme hakk\u0131 do\u011fmaktad\u0131r;<\/p>\n<h3 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131\u011f\u0131 Maddi Tazminat<\/strong><\/h3>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin bu tazminat\u0131 alabilmesi i\u00e7in meslek hastal\u0131\u011f\u0131 raporunu almas\u0131 gerekir. Al\u0131nan rapordan sonra, yine hastane taraf\u0131ndan i\u015f\u00e7inin meslekte kazanma kayb\u0131n\u0131n oran\u0131, y\u00fczde olarak belirlenir. Yarg\u0131lama s\u00fcreci ba\u015flad\u0131ktan sonra s\u00fcre\u00e7 kapsam\u0131nda, i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 yer hakim ve bilirki\u015fi taraf\u0131ndan incelemeye gidilir. Bu incelemenin amac\u0131, i\u015fverenin i\u015f g\u00fcvenli\u011fi ve i\u015f sa\u011fl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan kanunlara uyulup uyulmamas\u0131 durumuna bakmakt\u0131r.\u00a0 \u0130\u015fyerini inceleme sonucunda bilirki\u015fi, i\u015fverenin kusur oran\u0131n\u0131 belirleyecektir. \u0130\u015f g\u00f6remezlik oran\u0131na g\u00f6re ve i\u015fverenin de kusur oran\u0131na g\u00f6re bilirki\u015fi hesab\u0131 yapar. Bunun sonucunda da i\u015f\u00e7iye verilecek olan maddi tazminat miktar\u0131 belirlenmi\u015f olur.<\/p>\n<p>\u0130\u015fverenin, i\u015f\u00e7iye \u00f6deyece\u011fi madd\u00ee tazminat belirlenirken, sosyal g\u00fcvenlik yard\u0131mlar\u0131ndan kendisine r\u00fccu edilebilecek olan miktar\u0131n indirilmesi, tazminat\u0131n i\u015f\u00e7i i\u00e7in bir zenginle\u015fme arac\u0131 olarak kullan\u0131lmamas\u0131yla da ilgilidir. \u00d6te yandan, hakim taraf\u0131ndan bu indirimin yap\u0131labilecek olmas\u0131 i\u00e7in sosyal g\u00fcvenlik giderlerinin belirlenmesinin gerekmesi, mahkemenin, i\u015f kazas\u0131 veya meslek hastal\u0131\u011f\u0131na ili\u015fkin dosyan\u0131n Sosyal G\u00fcvenlik Kurumundan resmi yollarla talep edilmesini de zorunlu k\u0131lar.<\/p>\n<p style=\"text-align: justify;\">Maddi tazminat davas\u0131, i\u015f\u00e7inin meslek hastal\u0131\u011f\u0131 nedeniyle u\u011frad\u0131\u011f\u0131 meslekte g\u00fc\u00e7 kayb\u0131 ve di\u011fer zararlar\u0131n\u0131 kar\u015f\u0131lamak \u00fczere a\u00e7\u0131l\u0131r. Maddi tazminat\u0131n kapsam\u0131n\u0131 belirleyen temel unsurlar \u015funlard\u0131r:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Taraflar\u0131n kusur oranlar\u0131,<\/li>\n<li>Maluliyet varsa maluliyet oran\u0131,<\/li>\n<li>\u0130\u015f\u00e7inin en son geliri.<\/li>\n<\/ul>\n<p>Meslek hastal\u0131\u011f\u0131 sonucu \u00f6l\u00fcm halinde; \u00f6len i\u015f\u00e7inin deste\u011finden yoksun kalan ki\u015filer maddi tazminat davas\u0131 a\u00e7abilir. \u00d6len ki\u015finin e\u015fi, \u00e7ocuklar\u0131, anne babas\u0131 veya \u00f6lenin kendisine destekte bulundu\u011funu ispat edebilen herkes maddi ve manevi tazminat davas\u0131 a\u00e7abilir.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131\u011f\u0131 Manevi Tazminat<\/strong><\/h3>\n<p>Manevi tazminat, ki\u015filik de\u011ferleri sald\u0131r\u0131ya u\u011frayan ki\u015finin isteyebilece\u011fi bir tazminat t\u00fcr\u00fcd\u00fcr. Yarg\u0131tay kararlar\u0131na g\u00f6re ki\u015finin ya\u015fam\u0131, sa\u011fl\u0131\u011f\u0131, ruh ve v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fc bozulan herkes manevi tazminat isteyebilir.<\/p>\n<p style=\"text-align: justify;\">Manevi tazminat, bir ki\u015finin hukuka ayk\u0131r\u0131 bir fiille ki\u015filik haklar\u0131n\u0131n zarar g\u00f6rmesi durumunda, bu zarara kar\u015f\u0131l\u0131k olarak verilen tazminatt\u0131r. Manevi zarar ise, bedensel ya da ruhsal anlamda zarar g\u00f6renin, kendi i\u00e7 d\u00fcnyas\u0131nda ya\u015fad\u0131\u011f\u0131 elem, keder ve \u0131st\u0131rap gibi manevi hislerden dolay\u0131 meydana gelen zarara kar\u015f\u0131l\u0131k gelmek \u00fczere kullan\u0131l\u0131r.<\/p>\n<p style=\"text-align: justify;\">Manev\u00ee tazminat, T\u00fcrk Hukukunda, hem bedensel zararlardan hem de ki\u015filik haklar\u0131na verilen zararlardan\u00a0 kaynaklanarak talep edilebilir.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin ya da yak\u0131nlar\u0131n\u0131n, i\u015fverenden manev\u00ee tazminat talep edebilmeleri i\u00e7in kural olarak i\u015fverenin kusurunun bulunmas\u0131 \u015fartt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Bunlar, kusursuz sorumluluk h\u00e2lleri ile i\u015f kazas\u0131n\u0131n \u201cfeci\u201d \u015fekilde ger\u00e7ekle\u015fmesi, uzun s\u00fcren ve \u00e7ok ac\u0131 veren ameliyatlar ya da tedaviler, i\u015f\u00e7ide olu\u015fan maluliyet oran\u0131n\u0131n y\u00fcksekli\u011fi gibi \u00f6zel durumlard\u0131r.<\/p>\n<p style=\"text-align: justify;\">Manev\u00ee tazminat\u0131n \u00f6denip \u00f6denmemesi ve \u00f6denecekse miktar\u0131n\u0131n ne olaca\u011f\u0131n\u0131n belirlenmesi olduk\u00e7a g\u00fc\u00e7 bir durumu ifade eder. Zira, ki\u015finin i\u00e7 d\u00fcnyas\u0131nda meydana gelen ac\u0131, keder, utanma, \u0131st\u0131rap gibi manev\u00ee hislerin rakamsal olarak kar\u015f\u0131l\u0131\u011f\u0131n\u0131n ne oldu\u011funun kesin olarak belirlenmesi olanaks\u0131zd\u0131r56. Bu durumun do\u011fal bir sonucu olarak, manevi tazminat\u0131n zarar g\u00f6renin tatmin edilmesine, ac\u0131s\u0131n\u0131n bir nebze de olsa hafifletilmesine hizmet etti\u011fi ifade edilmektedir.<\/p>\n<p style=\"text-align: justify;\">Hastal\u0131k sonucunda \u00e7ekilen ruhsal ac\u0131, \u0131zd\u0131rap ve elem sebebiyle i\u015f\u00e7i taraf\u0131ndan i\u015fverenden manevi tazminat talep edilebilir. Manevi tazminat yaln\u0131zca hastal\u0131\u011fa yakalanan sigortal\u0131 taraf\u0131ndan de\u011fil bu hastal\u0131k sebebiyle manevi olarak zarar g\u00f6ren yak\u0131nlar\u0131 taraf\u0131ndan da\u00a0 talep edilebilir. Manevi tazminat\u0131n hesaplanmas\u0131nda hastal\u0131\u011f\u0131n olu\u015fmas\u0131ndaki kusurlar\u0131n oran\u0131, taraflar\u0131n gelirleri, ki\u015finin \u00e7ekti\u011fi ac\u0131 gibi unsurlar g\u00f6z \u00f6n\u00fcnde tutulur. Bu tazminat, i\u015f\u00e7i hastal\u0131k dolay\u0131s\u0131yla ac\u0131, \u0131st\u0131rap \u00e7ekiyorsa al\u0131nmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u00d6denecek olan miktar, hakim taraf\u0131ndan belirlenir. \u0130lgili i\u015f\u00e7i, mahkemede davas\u0131n\u0131 ispat etmek i\u00e7in tan\u0131k dahil olmak \u00fczere her t\u00fcrl\u00fc delili kullanabilmektedir.<\/p>\n<p style=\"text-align: justify;\">\u00d6lenin herhangi bir deste\u011fi olmamas\u0131na ra\u011fmen \u00f6l\u00fcmden \u00fcz\u00fcnt\u00fc duyan birinci derece yak\u0131nlar da manevi tazminat davas\u0131 a\u00e7abilirler. Yaralanma halinde, yaralanan\u0131n yak\u0131nlar\u0131n\u0131n maddi tazminat isteme haklar\u0131 yoktur. Ancak, yaralanma a\u011f\u0131r bedensel zarar meydana getirmi\u015fse (\u00f6rne\u011fin, bir g\u00f6z\u00fcn g\u00f6z\u00fcn k\u00f6r olmas\u0131, bacak veya kolun kopmas\u0131), \u00f6zellikle uzuv kayb\u0131 meydana gelmi\u015fse yaralanan\u0131n yak\u0131nlar\u0131 da manevi tazminat talep edebilir.<\/p>\n<\/div>\n<h2 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131\u011f\u0131 Nedeniyle Tazminat Davas\u0131 Zamana\u015f\u0131m\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">T\u00fcrk Bor\u00e7lar Kanunu m.146&#8217;ya g\u00f6re Meslek hastal\u0131\u011f\u0131 tazminat davas\u0131 zamana\u015f\u0131m\u0131 s\u00fcresi <strong>10 y\u0131ld\u0131r.<\/strong><\/p>\n<p style=\"text-align: justify;\">Tazminat davas\u0131 zamana\u015f\u0131m\u0131 s\u00fcresi failin ve zarar\u0131n \u00f6\u011frenildi\u011fi tarihten itibaren ba\u015flayacakt\u0131r. Zarar\u0131n \u00f6\u011frenilmesinden kastedilen; b\u00fct\u00fcn hal ve \u015fartlar\u0131 ile zarar\u0131n \u00f6\u011frenilmi\u015f olmas\u0131 demektir.<\/p>\n<p style=\"text-align: justify;\">\u00d6rne\u011fin bedensel zararlar ancak bak\u0131m ve tedavi neticesinde d\u00fczenlenen doktor raporuyla zarar belirli bir netli\u011fe ula\u015f\u0131r. Dolay\u0131s\u0131yla bedensel zarar\u0131n geli\u015fim g\u00f6sterdi\u011fi hallerde zamana\u015f\u0131m\u0131 ba\u015flang\u0131c\u0131 olarak geli\u015fimin tamamland\u0131\u011f\u0131 tarih dikkate al\u0131n\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131\u011f\u0131 Tazminat Dilek\u00e7e \u00d6rne\u011fi<\/strong><\/h2>\n<p style=\"text-align: justify;\">Meslek hastal\u0131\u011f\u0131 nedeniyle tazminat dilek\u00e7e \u00f6rne\u011fine <a href=\"https:\/\/oner.av.tr\/meslek-hastaligi-nedeniyle-tazminat-dilekce-ornegi\/\"><strong>BURADAN<\/strong><\/a> ula\u015fabilirsiniz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Meslek Hastal\u0131\u011f\u0131 Nedeniyle Tazminat Yarg\u0131tay Kararlar\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>Yarg\u0131tay 21. Hukuk Dairesi 2010\/5628-11845 Karar Say\u0131l\u0131 ilam\u0131na g\u00f6re<\/strong>; <em>\u201cSigortal\u0131 sa\u011fl\u0131nda a\u00e7t\u0131\u011f\u0131 davada verdi\u011fi k\u0131smi dava dilek\u00e7esinde i\u015f kazas\u0131 sonucu s\u00fcrekli i\u015f g\u00f6rmezlik nedeniyle maddi tazminat\u0131n fazlaya ili\u015fkin istem hakk\u0131n\u0131 ve manevi tazminat istem hakk\u0131n\u0131 sakl\u0131 tutmu\u015ftur. Bu nedenle \u00f6l\u00fcm\u00fcnden sonra miras\u00e7\u0131lar\u0131 manevi tazminat isteminde bulunabilirler.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>Yarg\u0131tay Hukuk Genel Kurulu 2015\/ 1100 Esas, 2018\/1185 Karar Say\u0131l\u0131 Karar<\/strong><\/p>\n<p style=\"text-align: justify;\"><em>&#8220;Yine meslek hastal\u0131\u011f\u0131 i\u00e7in aranacak \u015fartlardan baz\u0131lar\u0131 meslek hastal\u0131\u011f\u0131n\u0131n y\u00f6netmelikte yer almas\u0131, belirtilen s\u00fcre i\u00e7erisinde meydana gelmesi ve Kurum sa\u011fl\u0131k raporu ile saptanmas\u0131d\u0131r. <\/em><em>5510 say\u0131l\u0131 Kanun\u2019un 14\u2019\u00fcnc\u00fc maddesinin son f\u0131kras\u0131nda; <\/em><em>\u201cHangi h\u00e2llerin meslek hastal\u0131\u011f\u0131 say\u0131laca\u011f\u0131, i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 bildirgesinin \u015fekli ve i\u00e7eri\u011fi, verilme us\u00fbl\u00fc ile bu maddenin uygulanmas\u0131na ili\u015fkin di\u011fer us\u00fbl ve esaslar, Kurum taraf\u0131ndan \u00e7\u0131kar\u0131lacak y\u00f6netmelikte d\u00fczenlenir.<\/em><\/p>\n<p style=\"text-align: justify;\"><em> Y\u00f6netmelikte belirlenmi\u015f hastal\u0131klar d\u0131\u015f\u0131nda herhangi bir hastal\u0131\u011f\u0131n meslek hastal\u0131\u011f\u0131 say\u0131l\u0131p say\u0131lmamas\u0131 hususunda \u00e7\u0131kabilecek uyu\u015fmazl\u0131klar, Sosyal Sigorta Y\u00fcksek Sa\u011fl\u0131k Kurulunca karara ba\u011flan\u0131r.\u201d <\/em><em>d\u00fczenlemesi getirilmi\u015ftir. <\/em><em>Kanunda bahsi ge\u00e7en y\u00f6netmelik ise \u00c7al\u0131\u015fma G\u00fcc\u00fc ve Meslekte Kazanma G\u00fcc\u00fc Kayb\u0131 Oran\u0131 Tespit \u0130\u015flemleri Y\u00f6netmeli\u011fi\u2019dir. \u0130lgili Y\u00f6netmelik ekinde meslek hastal\u0131klar\u0131 listesi yer almakta olup bir hastal\u0131\u011f\u0131n meslek hastal\u0131\u011f\u0131 olarak kabul\u00fc i\u00e7in bu listede yer al\u0131yor olmas\u0131 gerekmektedir. Listede yer almayan ancak meslek hastal\u0131\u011f\u0131 oldu\u011fu d\u00fc\u015f\u00fcn\u00fclen durumlarda ise ortaya \u00e7\u0131kan uyu\u015fmazl\u0131k Y\u00fcksek Sa\u011fl\u0131k Kurulunun karar\u0131 ile giderilecektir.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>\u00d6te yandan 5510 say\u0131l\u0131 Kanunun 14\u2019\u00fcnc\u00fc maddesi ve Sosyal Sigortalar \u0130\u015flemleri Y\u00f6netmeli\u011fi 36\/1\u2019inci maddesinde belirtildi\u011fi \u00fczere sigortal\u0131n\u0131n meslek hastal\u0131\u011f\u0131na tutuldu\u011funun Kurum sa\u011fl\u0131k raporu ile saptanmas\u0131 gerekmektedir. Kanun\u2019un 14\u2019\u00fcnc\u00fc maddesinde; <\/em><em>\u201cSigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015ften dolay\u0131 meslek hastal\u0131\u011f\u0131na tutuldu\u011funun;<\/em><br \/>\n<em>a) Kurumca yetkilendirilen sa\u011fl\u0131k hizmet sunucular\u0131 taraf\u0131ndan us\u00fbl\u00fcne uygun olarak d\u00fczenlenen sa\u011fl\u0131k kurulu raporu ve dayana\u011f\u0131 t\u0131bb\u00ee belgelerin incelenmesi,<\/em><br \/>\n<em>b) Kurumca gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fc hallerde, i\u015fyerindeki \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131 ve buna ba\u011fl\u0131 t\u0131bb\u00ee sonu\u00e7lar\u0131n\u0131 ortaya koyan denetim raporlar\u0131 ve gerekli di\u011fer belgelerin incelenmesi, <\/em><em>sonucu Kurum Sa\u011fl\u0131k Kurulu taraf\u0131ndan tespit edilmesi zorunludur.\u201d <\/em><em>d\u00fczenlemesine yer verilmi\u015f, b\u00f6ylece meslek hastal\u0131\u011f\u0131n\u0131n kabul\u00fcnde Kurum Sa\u011fl\u0131k Kurulunun tespiti aranm\u0131\u015ft\u0131r.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Nihayet hastal\u0131\u011f\u0131n ya da bedensel veya ruhsal engellilik h\u00e2linin meslek hastal\u0131\u011f\u0131 olarak nitelendirilebilmesi i\u00e7in aranan di\u011fer bir \u015fart sigortal\u0131n\u0131n beden veya ruh\u00e7a bir zarara u\u011framas\u0131d\u0131r. Sigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 veya yapt\u0131\u011f\u0131 i\u015fin niteli\u011finden dolay\u0131 tekrarlanan bir sebeple veya i\u015fin y\u00fcr\u00fct\u00fcm\u00fc sonucu meslek hastal\u0131\u011f\u0131na neden olan etkilerle kar\u015f\u0131la\u015fmas\u0131 elbette meslek hastal\u0131\u011f\u0131n\u0131n varl\u0131\u011f\u0131 i\u00e7in yeterli de\u011fildir.
