Bu davay\u0131 kiralayan ki\u015fi ve s\u00f6z konusu kiralanan yerin maliki a\u00e7abilecektir.<\/p>\n<p style=\"text-align: justify;\"><em><strong>Kiralanan y\u0131k\u0131lmayacak ise;<\/strong><\/em> elbirli\u011fi m\u00fclkiyete konu ta\u015f\u0131nmazda b\u00fct\u00fcn maliklerin davay\u0131 birlikte a\u00e7mas\u0131 gerekir. Payl\u0131 m\u00fclkiyete konu ta\u015f\u0131nmazda ise pay ve payda\u015f \u00e7o\u011funlu\u011fu sa\u011flanmas\u0131 halinde tahliye davas\u0131 a\u00e7\u0131labilir. Ancak gerek elbirli\u011fi m\u00fclkiyette gerekse payl\u0131 m\u00fclkiyette maliklerden herhangi biri kirac\u0131 ile s\u00f6zle\u015fme yapm\u0131\u015f ise malikin kanundan ve kira s\u00f6zle\u015fmesinin taraf\u0131 olmas\u0131ndan kaynaklanan dava a\u00e7ma hakk\u0131 vard\u0131r.<\/p>\n<p style=\"text-align: justify;\"><em><strong>Kiralanan y\u0131k\u0131lacak ise; <\/strong><\/em>elbirli\u011fi veya payl\u0131 m\u00fclkiyet fark etmeksizin t\u00fcm maliklerin r\u0131zas\u0131 olmas\u0131 gerekir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Tadilat Nedeniyle Kirac\u0131y\u0131 \u00c7\u0131karma<\/strong><\/h2>\n<p style=\"text-align: justify;\">TBK m.350\/2&#8217;ye g\u00f6re;<\/p>\n<p style=\"text-align: justify;\"><em>&#8220;Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da <\/em><em>de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise, belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak <strong>bir ay<\/strong> i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">Bu madde dikkate al\u0131nd\u0131\u011f\u0131nda kira konusu konut ve \u00e7at\u0131l\u0131 i\u015f yerinin &#8220;Yeniden \u0130n\u015fa&#8221; ve &#8220;Esasl\u0131 Onar\u0131m&#8221; nedeniyle tahliyesi talep edilebilir.<\/p>\n<p style=\"text-align: justify;\">Yeniden in\u015fa durumunda kira konusu ta\u015f\u0131nmaz y\u0131k\u0131larak yerine yeni bir yap\u0131 in\u015fa edilecektir. Kiralanan binan\u0131n ruhsats\u0131z olmas\u0131 in\u015fa ama\u00e7l\u0131 tahliye davas\u0131 a\u00e7\u0131lmas\u0131na engel te\u015fkil etmez.<\/p>\n<p style=\"text-align: justify;\">Ta\u015f\u0131nmaz\u0131n esasl\u0131 onar\u0131m\u0131nda ise yeni bir yap\u0131 in\u015fas\u0131 s\u00f6z konusu olmay\u0131p, yap\u0131n\u0131n ta\u015f\u0131y\u0131c\u0131 unsurlar\u0131 yerinde kalarak binada esasl\u0131 onar\u0131m yap\u0131lacakt\u0131r. Bundan dolay\u0131 da kira konusu ta\u015f\u0131nmaz\u0131n tahliyesi talep edilebilecektir. Esasl\u0131 tadilat ve onar\u0131mda, yap\u0131lacak onar\u0131m s\u0131ras\u0131nda kirac\u0131n\u0131n kiralanan ta\u015f\u0131nmazda bulunmas\u0131n\u0131n imkans\u0131z olmas\u0131 gerekir. Zira ufak tefek tadilatlar ancak ge\u00e7ici tahliye nedeni olabilir.<\/p>\n<p style=\"text-align: justify;\">Tahliyesi istenen ta\u015f\u0131nmaz\u0131n tarihi eser niteli\u011finde olmas\u0131 halinde in\u015fa ama\u00e7l\u0131 olarak tahliye davas\u0131 a\u00e7\u0131labilmesi i\u00e7in al\u0131nan ruhsat ve mimari projenin K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131n Koruma B\u00f6lge Kurulunca da onaylanmas\u0131 gerekir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Tadilat Nedeniyle Tahliye Davas\u0131 \u015eartlar\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\"><em>&#8220;Yeniden \u0130n\u015fa&#8221;<\/em> ve <em>&#8220;Esasl\u0131 Onar\u0131m&#8221;<\/em> nedeniyle tahliye davas\u0131 a\u00e7\u0131labilmesi i\u00e7in;<\/p>\n<ul style=\"text-align: justify;\">\n<li>Mimari ve tadilat projesi haz\u0131rlanmal\u0131d\u0131r.<\/li>\n<li>Mimari proje o yere ait olmal\u0131d\u0131r.<\/li>\n<li>Mimari proje gere\u011fi tadilat s\u0131ras\u0131nda ta\u015f\u0131nmazda oturman\u0131n m\u00fcmk\u00fcn olmamas\u0131 gerekir.<\/li>\n<li>Kiralananda yap\u0131lmak istenen tadilatlar\u0131n imar ama\u00e7l\u0131 ve esasl\u0131 nitelikte olup olmad\u0131klar\u0131 ayr\u0131nt\u0131l\u0131 olarak belirlenip, bu tadilatlar\u0131n yap\u0131m\u0131 s\u0131ras\u0131nda ta\u015f\u0131nmaz\u0131n\u0131n kullan\u0131m\u0131n\u0131n can ve mal g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan sak\u0131ncas\u0131 bulunup bulunmad\u0131\u011f\u0131 tespit edilmelidir.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Tadilat Nedeniyle Tahliye Davas\u0131 A\u00e7\u0131lma Zaman\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">Davan\u0131n, s\u00f6zle\u015fmenin bitimini izleyen 1 ay i\u00e7inde veya davan\u0131n en ge\u00e7 a\u00e7\u0131lmas\u0131 gereken s\u00fcre i\u00e7inde ihtar tebli\u011f edilerek \u00f6nceden ihtar ke\u015fide edilmi\u015fse dava kira s\u00f6zle\u015fmesinin d\u00f6nem sonuna kadar a\u00e7\u0131lmas\u0131 gerekir.<\/p>\n<p style=\"text-align: justify;\">Ba\u015flang\u0131c\u0131 ve s\u00fcresi belli olmayan kira s\u00f6zle\u015fmelerine dayan\u0131larak tahliye davas\u0131 a\u00e7\u0131lamaz. Zira kira s\u00f6zle\u015fmesinin ba\u015flang\u0131c\u0131 ve s\u00fcresi kiralayan taraf\u0131ndan ispat edilmelidir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Tadilat Nedeniyle Tahliye \u0130htarname\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesi belirsiz s\u00fcreli ise; sonu belli olmayan s\u00f6zle\u015fme dava a\u00e7\u0131lma zaman\u0131 6&#8217;\u015far d\u00f6nemler i\u00e7in \u00fc\u00e7 ay \u00f6nceden gereksinim iddias\u0131n\u0131n kirac\u0131ya bildirilmesi, alt\u0131nc\u0131 ay\u0131n sonunda da davan\u0131n a\u00e7\u0131lmas\u0131 gerekir. Alt\u0131\u015far ayl\u0131k d\u00f6nemin ba\u015flang\u0131c\u0131 i\u00e7in kira ba\u015flang\u0131\u00e7 tarihi esas al\u0131n\u0131r.<\/p>\n<p style=\"text-align: justify;\">Taraflar aras\u0131ndaki s\u00f6zle\u015fmede fesih ihbar \u015fart\u0131na ili\u015fkin d\u00fczenleme var ise, fesih ihbar\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7\u0131lmal\u0131d\u0131r. \u00d6rnek verilmesi gerekirse; kira s\u00f6zle\u015fmesinde ta\u015f\u0131nmaz\u0131n tahliyesi i\u00e7in kira d\u00f6nem sonu gelmeden \u00fc\u00e7 ay \u00f6nceden fesih i\u00e7in ihbarda bulunulmas\u0131 kararla\u015ft\u0131r\u0131lm\u0131\u015fsa, d\u00f6nem sonu gelmeden fesih ihbar\u0131 gelmedi\u011fi durumda, bu ihbarda bulunulmad\u0131\u011f\u0131 gerek\u00e7esiyle a\u00e7\u0131lan dava reddedilecektir. Bu durumda da kira s\u00f6zle\u015fmesi kira bedeli hari\u00e7 ayn\u0131 \u015fartlarla bir y\u0131l uzam\u0131\u015f olur.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Tadilat Nedeniyle Tahliye Davas\u0131 Ne Kadar S\u00fcrer?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Tadilat nedeniyle tahliye davas\u0131 basit yarg\u0131lama usul\u00fcne g\u00f6re g\u00f6r\u00fcl\u00fcr. Dava dilek\u00e7esi ile dava a\u00e7\u0131ld\u0131ktan sonra daval\u0131 tarafa tebli\u011f edilir. Daval\u0131 taraf 2 hafta i\u00e7inde cevap dilek\u00e7esini sunmal\u0131d\u0131r. Taraflar cevaba cevap ve ikinci cevap dilek\u00e7esi veremezler.<\/p>\n<p style=\"text-align: justify;\">Mahkeme, taraflar\u0131n dinlenmesi, delillerin incelenmesi ve tahkikat i\u015flemlerinin yap\u0131lmas\u0131n\u0131 yukar\u0131daki f\u0131krada belirtilen duru\u015fma hari\u00e7, iki duru\u015fmada tamamlar. Duru\u015fmalar aras\u0131ndaki s\u00fcre bir aydan daha uzun olamaz. \u0130\u015fin niteli\u011fi gere\u011fi bilirki\u015fi incelemesinin uzamas\u0131, istinabe yoluyla tahkikat i\u015flemlerinin y\u00fcr\u00fct\u00fclmesi gibi zorunlu h\u00e2llerde, h\u00e2kim gerek\u00e7esini belirterek bir aydan sonras\u0131 i\u00e7in de duru\u015fma g\u00fcn\u00fc belirleyebilir ve ikiden fazla duru\u015fma yapabilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Tadilat Nedeniyle Tahliye Davas\u0131 G\u00f6revli ve Yetkili Mahkeme<\/strong><\/h2>\n<p style=\"text-align: justify;\">Tadilat nedeniyle kirac\u0131n\u0131n tahliyesi davas\u0131nda davada g\u00f6revli mahkeme Sulh Hukuk Mahkemesi, yetkili mahkeme ise kiralanan ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesidir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Yeni Hali ile Ta\u015f\u0131nmaz\u0131n Yeniden Kiraya Verilmesi<\/strong><\/h2>\n<p style=\"text-align: justify;\">Yeniden in\u015fa edilen veya imar\u0131 ger\u00e7ekle\u015ftirilen ta\u015f\u0131nmazda eski kirac\u0131n\u0131n (yeni kira bedeli ile olmak \u015fart\u0131yla) kiralamada \u00f6ncelik hakk\u0131 mevcuttur. M\u00fclkiyet sahibinin ta\u015f\u0131nmaz\u0131n yeni hali i\u00e7in, belirlenmi\u015f g\u00fcncel kira bedeliyle ilk olarak ilgili ta\u015f\u0131nmazdan tahliye edilmi\u015f eski kirac\u0131ya teklif g\u00f6t\u00fcrme zorunlulu\u011fu vard\u0131r. Bunun i\u00e7in kiraya veren, eski kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunur.<\/p>\n<p style=\"text-align: justify;\">Kiraya verenin kirac\u0131ya yapaca\u011f\u0131 bu yaz\u0131l\u0131 bildirim ile ta\u015f\u0131nmaz\u0131 tekrar kiralay\u0131p kiralamayaca\u011f\u0131 sorulacakt\u0131r. Eski kirac\u0131, s\u00f6z konusu bu yaz\u0131l\u0131 bildirimden sonra <strong>1 ay<\/strong> i\u00e7erisinde ilgili ta\u015f\u0131nmaz\u0131 kiralamak i\u00e7in \u00f6ncelikli olan hakk\u0131n\u0131 kullanmaz ise ta\u015f\u0131nmaz ba\u015fkas\u0131na kiralanabilir.<\/p>\n<p style=\"text-align: justify;\">Kiraya veren, yeniden in\u015fa ya da imar yapt\u0131rd\u0131\u011f\u0131 ta\u015f\u0131nmaz\u0131, eski kirac\u0131y\u0131 tahliye etmesinin ard\u0131ndan 3 y\u0131l i\u00e7inde ba\u015fkas\u0131na kiraya verirse ya da eski kirac\u0131ya yap\u0131lmas\u0131 gereken yaz\u0131l\u0131 bildirimi yapmadan ta\u015f\u0131nmaz\u0131 bir ba\u015fkas\u0131na kiraya vermesi durumunda; eski kirac\u0131ya <em>son kira senesinde kirac\u0131n\u0131n \u00f6dedi\u011fi bir senelik kira bedelinden az olmamak \u015fart\u0131 ile<\/em> tazminat \u00f6demekle y\u00fck\u00fcml\u00fc hale gelir.<\/p>\n<p style=\"text-align: justify;\">\n","protected":false},"excerpt":{"rendered":"<p>Tadilat Nedeniyle Tahliye Davas\u0131 Kiralanan yerin imar ve in\u015fas\u0131 nedeniyle tahliye davas\u0131 a\u00e7\u0131labilir.
