{"id":4938,"date":"2022-06-24T17:51:43","date_gmt":"2022-06-24T14:51:43","guid":{"rendered":"https:\/\/oner.av.tr\/?p=4938"},"modified":"2022-06-24T17:51:43","modified_gmt":"2022-06-24T14:51:43","slug":"kiracinin-evi-baskasina-kiralamasi","status":"publish","type":"post","link":"https:\/\/oner.av.tr\/en\/kiracinin-evi-baskasina-kiralamasi\/","title":{"rendered":"Kirac\u0131n\u0131n Evi Ba\u015fkas\u0131na Kiralamas\u0131"},"content":{"rendered":"<h1 style=\"text-align: justify;\"><strong>Kirac\u0131n\u0131n Evi Ba\u015fkas\u0131na Kiralamas\u0131<\/strong><\/h1>\n<p style=\"text-align: justify;\">T\u00fcrk Bor\u00e7lar Kanunun alt kira ve kullan\u0131m hakk\u0131n\u0131n devri ba\u015fl\u0131kl\u0131 322. maddesi \u015fu \u015fekildedir:<\/p>\n<p style=\"text-align: justify;\"><em>Kirac\u0131, kiraya verene zarar verecek bir de\u011fi\u015fikli\u011fe yol a\u00e7mamak ko\u015fuluyla, kiralanan\u0131 tamamen veya k\u0131smen ba\u015fkas\u0131na kiraya verebilece\u011fi gibi, kullan\u0131m hakk\u0131n\u0131 da ba\u015fkas\u0131na devredebilir. <\/em><\/p>\n<p style=\"text-align: justify;\"><em>Kirac\u0131, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda, kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a, kiralanan\u0131 ba\u015fkas\u0131na kiralayamayaca\u011f\u0131 gibi, kullan\u0131m hakk\u0131n\u0131 da devredemez.<\/em><\/p>\n<p><!--more--><\/p>\n<p style=\"text-align: justify;\"><em>Alt kirac\u0131, kiralanan\u0131 kirac\u0131ya tan\u0131nandan ba\u015fka bi\u00e7imde kulland\u0131\u011f\u0131 takdirde kirac\u0131, kiraya verene kar\u015f\u0131 sorumlu olur. Bu durumda kiraya veren, kirac\u0131s\u0131na kar\u015f\u0131 sahip oldu\u011fu haklar\u0131 alt kirac\u0131ya veya kullan\u0131m hakk\u0131n\u0131 devralana kar\u015f\u0131 da kullanabilir.<\/em><\/p>\n<p style=\"text-align: justify;\">Kirac\u0131 ancak, kiralananda de\u011fi\u015fiklik yapmamak ko\u015fuluyla kullan\u0131m hakk\u0131n\u0131 ba\u015fka bir kirac\u0131ya verebilir. Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda alt kiraya verebilmesi i\u00e7in yaz\u0131l\u0131 r\u0131za al\u0131nmas\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\">Adi kira s\u00f6zle\u015fmelerinde alt kira s\u00f6zle\u015fmesi kiraya verene zarar vermemek kayd\u0131yla (as\u0131l kira s\u00f6zle\u015fmesinde alt kira yasa\u011f\u0131na ili\u015fkin h\u00fck\u00fcm bulunmamas\u0131 halinde) yap\u0131labilir. Zarar vermeden anla\u015f\u0131lmas\u0131 gereken kiralanan\u0131n \u00f6ng\u00f6r\u00fclen kullanma amac\u0131 d\u0131\u015f\u0131nda yap\u0131lan de\u011fi\u015fikliklerin tamam\u0131d\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Alt Kira Nedir?<\/strong><\/h1>\n<p>Alt kira; kiralanan yerin kullan\u0131m hakk\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye devredilmesidir.<\/p>\n<p style=\"text-align: justify;\">Alt kira s\u00f6zle\u015fmesi, as\u0131l kira s\u00f6zle\u015fmesiyle fiili ili\u015fki i\u00e7inde bulunan fakat ondan ba\u011f\u0131ms\u0131z olan s\u00f6zle\u015fmedir. Gerek as\u0131l s\u00f6zle\u015fmede gerekse alt s\u00f6zle\u015fmede iki taraf vard\u0131r. Ancak, bu s\u00f6zle\u015fmelerin aralar\u0131ndaki fiili ili\u015fki, bir taraf\u0131n ayn\u0131 anda her iki s\u00f6zle\u015fmeye de taraf olmas\u0131 ve her iki s\u00f6zle\u015fmeye konu olan edimlerin k\u0131smen de olsa uyum i\u00e7inde olmas\u0131ndan kaynaklanmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Alt kira s\u00f6zle\u015fmesi, hukuki niteli\u011fi itibariyle bir kira s\u00f6zle\u015fmesidir. Alt kira s\u00f6zle\u015fmesinin, as\u0131l kira s\u00f6zle\u015fmesinden fark\u0131 as\u0131l kira s\u00f6zle\u015fmesinde \u201cas\u0131l kirac\u0131\u201d, alt kira s\u00f6zle\u015fmesinde ise \u201calt kiralayan\u201d konumunda olan ki\u015finin, kira konusu \u00fczerindeki hakk\u0131n\u0131n as\u0131l kira s\u00f6zle\u015fmesinden kaynaklanmas\u0131d\u0131r. Bunun sonucu olarak, alt kira s\u00f6zle\u015fmeleri de kira s\u00f6zle\u015fmeleri gibi taraflar\u0131n kar\u015f\u0131l\u0131kl\u0131 ve birbirine uygun irade beyanlar\u0131 ile kurulur, kira konusu e\u015fyan\u0131n s\u00f6zle\u015fmenin kuruldu\u011fu anda teslimi gerekmedi\u011finden r\u0131zaya dayal\u0131 bir s\u00f6zle\u015fmedir, her iki tarafa da bor\u00e7 y\u00fckler, bu nedenle ivazl\u0131d\u0131r ve belli veya belirsiz bir s\u00fcre bor\u00e7 ili\u015fkisinin devam\u0131n\u0131 gerektirdi\u011finden s\u00fcrekli veya s\u00fcrekli benzeri bir s\u00f6zle\u015fmedir.<\/p>\n<p style=\"text-align: justify;\">Alt kira s\u00f6zle\u015fmesi kurulsa da, as\u0131l kirac\u0131n\u0131n (alt kiralayan) kiraya verene kar\u015f\u0131 s\u00f6zle\u015fmeden kaynaklanan sorumluluklar\u0131 devam etmektedir. \u00d6rne\u011fin; kira verme borcu gibi. Kiraya veren alt kirac\u0131dan borcunu isteyemez.<\/p>\n<p style=\"text-align: justify;\">Kiralanan\u0131n as\u0131l kirac\u0131dan daha fazla kullan\u0131lmas\u0131 halinde de kiralanan \u015feyin zarar g\u00f6rece\u011fi kabul edilmelidir. Kiralayan ile as\u0131l kirac\u0131 aras\u0131nda kira s\u00f6zle\u015fmesinin (\u00f6rne\u011fin tahliye karar\u0131 al\u0131nmas\u0131) feshi halinde, alt kira s\u00f6zle\u015fmesi de fesholunur. Ta\u015f\u0131nmaz\u0131n icra yolu ile tahliyesine gidildi\u011finde alt kirac\u0131 ta\u015f\u0131nmazda kirac\u0131l\u0131k s\u0131fat\u0131n\u0131n devam etti\u011fi iddias\u0131nda bulunamaz. Zira \u0130cra \u0130flas Kanunu madde 276\/1 gere\u011fince; tahliyesi istenen yerde kirac\u0131dan ba\u015fka bir \u015fah\u0131s bulunur ve i\u015fgalde hakl\u0131 oldu\u011funa dair resmi bir belge g\u00f6stermezse derhal tahliye olunur.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/oner.av.tr\/aile-konutu-serhi\/\">Aile konutu<\/a> niteli\u011finde olan bir yer ayn\u0131 zamanda aile konutu niteli\u011fi ta\u015f\u0131yorsa bu halde, kiraya verenin e\u015finin de alt kira i\u00e7in yaz\u0131l\u0131 onay vermesi \u015fartt\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kirac\u0131n\u0131n Alt Kiraya Verme Hakk\u0131<\/strong><\/h1>\n<p>Kirac\u0131n\u0131n, evi veya i\u015fyerini alt kiraya verebilmesi i\u00e7in kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131n\u0131 almak zorundad\u0131r. R\u0131za al\u0131nmadan alt kiraya verilemez. Yaz\u0131l\u0131 r\u0131za alt kira s\u00f6zle\u015fmesi a\u00e7\u0131s\u0131ndan ge\u00e7erlilik \u015fart\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesi imzaland\u0131ktan sonra, el yaz\u0131s\u0131 ile konut veya i\u015fyerinin kiraya verilebilece\u011fi yaz\u0131lm\u0131\u015f ve kira s\u00f6zle\u015fmesine sonradan eklenmi\u015f ise bu maddenin kabul edilebilmesi i\u00e7in el yaz\u0131s\u0131 ile eklenen maddenin yan\u0131nda &#8220;kiralayan taraf\u0131ndan paraf at\u0131lmas\u0131 gerekmektedir.&#8221; Paraf at\u0131lmad\u0131\u011f\u0131 takdirde bu madde ge\u00e7erli olmayacakt\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kiralayan\u0131n Alt Kirac\u0131ya Kar\u015f\u0131 Sahip Oldu\u011fu Haklar<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kiraya verenin alt kirac\u0131dan kiralanana \u00f6zen g\u00f6stermesini isteme hakk\u0131 ve yetkisi bulunmaktad\u0131r. Alt kira s\u00f6zle\u015fmesi as\u0131l kira s\u00f6zle\u015fmesinin s\u00fcresi ile ba\u011fl\u0131 olup, as\u0131l kira ili\u015fkisi sona erdi\u011finde alt kirac\u0131 durumundaki kirac\u0131n\u0131n da kirac\u0131l\u0131k s\u0131fat\u0131 sona erer.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Kiralanan\u0131n S\u00f6zle\u015fmeye Uygun Bi\u00e7imde Kullan\u0131lmas\u0131n\u0131 \u0130steme Hakk\u0131<\/strong><\/h3>\n<p style=\"text-align: justify;\">Alt kira s\u00f6zle\u015fmesi alt kirac\u0131 ve kirac\u0131 aras\u0131nda akdedilen bir s\u00f6zle\u015fme olmas\u0131 nedeniyle burada s\u00f6zle\u015fmenin nisbili\u011fi (herkese kar\u015f\u0131 de\u011fil belli bir ki\u015fiye kar\u015f\u0131 ileri s\u00fcr\u00fclebilen hak) ilkesinden s\u00f6z edilir.<\/p>\n<p style=\"text-align: justify;\">Ancak, alt kira s\u00f6zle\u015fmesi her ne kadar as\u0131l kira s\u00f6zle\u015fmesinden ba\u011f\u0131ms\u0131z bir nitelikte olsa da, kiralayan\u0131n baz\u0131 hallerde s\u00f6zle\u015fmenin taraf\u0131 olmamas\u0131na ra\u011fmen alt kirac\u0131ya kar\u015f\u0131 do\u011frudan talep hakk\u0131 do\u011far. Bu hallerden birisini de, kiralayan\u0131n alt kirac\u0131ya do\u011frudan do\u011fruya ba\u015fvurarak, s\u00f6zle\u015fmeye uygun bi\u00e7imde davranmas\u0131n\u0131 isteme hakk\u0131 olu\u015fturur.<\/p>\n<p style=\"text-align: justify;\">T\u00fcrk Bor\u00e7lar Kanunu\u2019nun 322\/3. maddesinde bu konu \u015fu \u015fekilde ifade edilmi\u015ftir; <em>\u201cAlt kirac\u0131, kiralanan\u0131 kirac\u0131ya tan\u0131nandan ba\u015fka bi\u00e7imde kulland\u0131\u011f\u0131 takdirde kirac\u0131, kiraya verene kar\u015f\u0131 sorumlu olur. Bu durumda kiraya veren, kirac\u0131s\u0131na kar\u015f\u0131 sahip oldu\u011fu haklar\u0131 alt kirac\u0131ya veya kullan\u0131m hakk\u0131n\u0131 devralana kar\u015f\u0131 da kullanabilir.\u201d<\/em><\/p>\n<h3 style=\"text-align: justify;\"><strong>Hapis Hakk\u0131<\/strong><\/h3>\n<p style=\"text-align: justify;\">Bor\u00e7lar Kanununun 267\/2. maddesine g\u00f6re; <em>\u201cKiralayan\u0131n hapis hakk\u0131, alt kirac\u0131n\u0131n kirac\u0131ya kar\u015f\u0131 borcu olan miktar nispetinde alt kirac\u0131 taraf\u0131ndan kiralanan dahiline getirilen e\u015fyaya da \u015famildir.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">Bu d\u00fczenlemeye g\u00f6re, kiralayan\u0131n hapis hakk\u0131n\u0131 kullanabilmesinin \u015fartlar\u0131 \u015f\u00f6yle s\u0131ralanabilir;<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\">Kiralayan\u0131n kirac\u0131dan kira bedeli alaca\u011f\u0131 olmal\u0131d\u0131r.<\/li>\n<li style=\"text-align: justify;\">Kiralayan s\u00f6z konusu alaca\u011f\u0131n\u0131 kirac\u0131dan k\u0131smen veya tamamen kar\u015f\u0131layamam\u0131\u015f olmal\u0131d\u0131r.<\/li>\n<li style=\"text-align: justify;\">Alt kirac\u0131n\u0131n, kirac\u0131ya kira bedeline ili\u015fkin borcu olmal\u0131d\u0131r.<\/li>\n<li style=\"text-align: justify;\">Alt kirac\u0131ya ait olmak \u015fart\u0131yla, kiralanan\u0131n d\u00f6\u015fenmesi veya kiralanandan yararlanmaya ili\u015fkin ta\u015f\u0131n\u0131r e\u015fyalar bulunmal\u0131d\u0131r.<\/li>\n<\/ul>\n<h1 style=\"text-align: justify;\"><strong>Alt Kira Yasa\u011f\u0131na Ayk\u0131r\u0131l\u0131k<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesinde evin veya i\u015fyerinin ba\u015fkas\u0131na kiraya verme yasa\u011f\u0131 olmas\u0131na ra\u011fmen s\u00f6z konusu ta\u015f\u0131nmaz 3. ki\u015fiye kiraya verilmi\u015f ise as\u0131l kirac\u0131ya kar\u015f\u0131 ihtar g\u00f6nderilerek 30 g\u00fcn i\u00e7inde s\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131\u011f\u0131n giderilmesi ve s\u00f6zle\u015fmenin maddelerine uygun davran\u0131lmas\u0131 istenmelidir. G\u00f6nderilen ihtara ra\u011fmen s\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131k giderilmez ise o zaman TBK 316. madde gere\u011fince s\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131k nedeniyle tahliye davas\u0131 a\u00e7\u0131labilir. 3. ki\u015fiye kar\u015f\u0131 a\u00e7\u0131lacak davada ihtara gerek yoktur.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kirac\u0131n\u0131n Evi Ba\u015fkas\u0131na Kulland\u0131rmas\u0131<\/strong><\/h1>\n<p>Konut ve \u00e7at\u0131l\u0131 i\u015fyerine ait ta\u015f\u0131nmaz\u0131n kiralayan\u0131n izni olmadan devredilir ise, kiralayan fuzuli i\u015fgal sebebine dayal\u0131 her birine kar\u015f\u0131 ayr\u0131 ayr\u0131 dava a\u00e7abilece\u011fi gibi birlikte de dava a\u00e7abilecektir.
