Kira s\u00f6zle\u015fmesinde kirac\u0131 birden fazla ise davan\u0131n t\u00fcm kirac\u0131lara kar\u015f\u0131 a\u00e7\u0131lmas\u0131 gerekir.<\/p>\n<p style=\"text-align: justify;\">Davac\u0131 taraf ise kiraya verendir. E\u011fer ta\u015f\u0131nmaz elbirli\u011fi m\u00fclkiyete konu bir ta\u015f\u0131nmaz ise, b\u00fct\u00fcn maliklerin davay\u0131 birlikte a\u00e7malar\u0131 gerekir. \u015eayet malik, kira s\u00f6zle\u015fmesinin taraf\u0131 de\u011filse, yasal s\u00fcrelere uymak kayd\u0131yla kendisi, e\u015fi, \u00e7ocuklar\u0131 ve bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filer ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7abileceklerdir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015fyeri \u0130htiyac\u0131 Nedeniyle Tahliye Dava \u015eartlar\u0131<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li>Bu davay\u0131 kiraya verenin kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in i\u015fyeri ihtiyac\u0131 nedeniyle tahliye davas\u0131 a\u00e7abilir.<\/li>\n<li>Davan\u0131n s\u00fcresinde a\u00e7\u0131l\u0131p a\u00e7\u0131lmad\u0131\u011f\u0131 mahkemece re&#8217;sen (kendili\u011finden) takdir edilecektir.<\/li>\n<li>Birden fazla kirac\u0131 varsa, davan\u0131n kirac\u0131lar\u0131n hepsine kar\u015f\u0131 a\u00e7\u0131lmas\u0131 gerekir. \u0130\u015fyeri gereksinimi ile g\u00f6nderilen ihtarnamenin de her birine g\u00f6nderilmesi gerekir.<\/li>\n<li>\u0130htiya\u00e7 iddias\u0131n\u0131n ger\u00e7ekle\u015fmi\u015f veya yak\u0131n zamanda ger\u00e7ekle\u015fecek olmas\u0131 gerekmektedir. Ayn\u0131 zamanda dava s\u00fcresince de ihtiya\u00e7 iddias\u0131n\u0131n devam etmesi gerekmektedir.<\/li>\n<li>\u0130htiya\u00e7 iddias\u0131n\u0131n &#8220;ger\u00e7ek&#8221;, &#8220;zorunlu&#8221; ve &#8220;samimi&#8221; olmas\u0131 gerekir. \u00d6rne\u011fin ihtiya\u00e7 iddias\u0131 olan ki\u015finin i\u015fyeri yetecek durumda ise i\u015fyeri ihtiyac\u0131 ger\u00e7ek ve samimi kabul edilmez. Ancak e\u011fer \u015firket ihtiyac\u0131 i\u00e7in mevcut i\u015fyeri yetmemekte veya dar gelmekte ise ihtiya\u00e7 iddias\u0131 ger\u00e7ek ve samimi kabul edilir.<\/li>\n<li>Kiralananda yap\u0131lacak i\u015fin, ihtiya\u00e7 iddias\u0131n\u0131n kiralananda uygun ve elveri\u015fli olup olmad\u0131\u011f\u0131 tespit edilecektir. \u00d6rne\u011fin b\u00fcy\u00fck bir\u00a0 vb.<\/li>\n<li>Dava a\u00e7\u0131lmadan \u00f6nce kiralanan ta\u015f\u0131nmaz\u0131n sat\u0131\u015fa \u00e7\u0131kar\u0131lmas\u0131, ta\u015f\u0131nmaz\u0131n sat\u0131\u015f\u0131 i\u00e7in kiralanan ta\u015f\u0131nmaza emlak\u00e7\u0131 g\u00f6nderilmesi, ihtiya\u00e7 iddial\u0131s\u0131n\u0131n ba\u015fka bir \u015fehirde olmas\u0131 ve kiralanan\u0131n oldu\u011fu \u015fehre gelmek i\u00e7in \u00e7aba i\u00e7inde olmamas\u0131 halinde ihtiya\u00e7 iddias\u0131 ger\u00e7ek ve samimi kabul edilemez.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Yeni \u0130\u015f Yeri Ald\u0131m Kirac\u0131y\u0131 Nas\u0131l \u00c7\u0131karabilirim?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Ta\u015f\u0131nmaz\u0131 kazanan yeni malik, isterse, eski malikin kira s\u00f6zle\u015fmesinden kaynaklanan haklar\u0131na halef olaca\u011f\u0131ndan, eski malik ile kirac\u0131 aras\u0131nda imzalanan kira s\u00f6zle\u015fmesine dayal\u0131 dava a\u00e7abilece\u011fi gibi isterse kazanma tarihinden itibaren bir ay i\u00e7inde ihtar \u00e7ekerek, ta\u015f\u0131nmaz\u0131 kazanmas\u0131ndan itibaren 6 ayl\u0131k d\u00f6nem sonunda da tahliye davas\u0131 a\u00e7abilir.<\/p>\n<p dir=\"ltr\" style=\"text-align: justify;\">Bu konuda <em>Yarg\u0131tay 6.Hukuk Dairesinin 2015\/11558 Esas ve 2016\/4130 Karar say\u0131l\u0131 karar\u0131<\/em> gere\u011fince ihtiyac\u0131n ger\u00e7ek, zorunlu ve samimi olmas\u0131 gerekir. Ayr\u0131ca bu ihtiya\u00e7, dava s\u00fcresi boyunca devam etmelidir. Ger\u00e7ekle\u015fmemi\u015f veya ger\u00e7ekle\u015fmesi uzun bir s\u00fcre sonra olacak ihtiya\u00e7 iddias\u0131 kabul edilemez. Bunun yan\u0131 s\u0131ra, ihtiya\u00e7 unsurunun ger\u00e7ek olarak kabul edilmesi i\u00e7in yeni malik olarak kirada dahi olsan\u0131z, kulland\u0131\u011f\u0131n\u0131z i\u015fyerinin vasf\u0131 ile yeni sat\u0131n ald\u0131\u011f\u0131n\u0131z yerin vas\u0131flar\u0131 aras\u0131nda kar\u015f\u0131la\u015ft\u0131rma yap\u0131lmas\u0131 i\u00e7in bilirki\u015fi atanacak veya ke\u015fif yap\u0131lacakt\u0131r. Zira yeni sat\u0131n ald\u0131\u011f\u0131n\u0131z yer daha \u00fcst\u00fcn ve ayn\u0131 zamanda i\u015finize uygun olmas\u0131 gerekmektedir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015fyeri \u0130htiyac\u0131 Nedeniyle Tahliye Davas\u0131 A\u00e7ma S\u00fcresi<\/strong><\/h2>\n<p style=\"text-align: justify;\">6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanununun 350.maddesine g\u00f6re belirli s\u00fcreli kira s\u00f6zle\u015fmesinde tahliye davas\u0131n\u0131n s\u00f6zle\u015fmenin bitimini takip eden 1 ay i\u00e7erisinde a\u00e7\u0131lmas\u0131 gerekir. Ancak, dava a\u00e7ma s\u00fcresi i\u00e7inde ihtar \u00e7ekilmi\u015f ise d\u00f6nem sonuna kadar\u00a0 tahliye davas\u0131 a\u00e7\u0131labilir. (D\u00f6nem sonu ile kast edilen kira s\u00f6zle\u015fme s\u00fcresinin sonunu takip eden bir y\u0131ll\u0131k d\u00f6nem sonuna kadar olan d\u00f6nemdir.)<\/p>\n<p style=\"text-align: justify;\">\u00d6rnek verilecek olursa; kira s\u00f6zle\u015fmesi 01.01.2019 ba\u015flang\u0131\u00e7 tarihli ve bir y\u0131l s\u00fcreli ise ve ihtar \u00e7ekilmemi\u015f ise, davan\u0131n, s\u00f6zle\u015fmenin sonu olan 31.12.2019 tarihini takip eden 1 ayl\u0131k s\u00fcre i\u00e7erisinde (31.01.2020) a\u00e7\u0131lmas\u0131 gerekir. Ancak 31.01.2020 tarihine kadar ihtar \u00e7ekilmi\u015fse o zaman 31.12.2020 tarihine kadar dava a\u00e7\u0131labilir.<\/p>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesi belirsiz s\u00fcreli ise; dava a\u00e7\u0131lma zaman\u0131 TBK m.329 gere\u011fi, alt\u0131\u015far ayl\u0131k d\u00f6nemler i\u00e7in \u00fc\u00e7 ay \u00f6nceden gereksinim iddias\u0131n\u0131n kirac\u0131ya bildirilmesi alt\u0131nc\u0131 ay\u0131n sonunda ise tahliye davas\u0131n\u0131n a\u00e7\u0131lmas\u0131 ile ger\u00e7ekle\u015fir. Alt\u0131\u015far ayl\u0131k d\u00f6nemin ba\u015flang\u0131c\u0131 i\u00e7in kira ba\u015flang\u0131\u00e7 tarihi esas al\u0131n\u0131r.<\/p>\n<p>Ta\u015f\u0131nmaz\u0131 yeni alan malik, iktisap tarihinden itibaren 1 ay i\u00e7inde ihtar \u00e7ekerse, iktisap tarihinden itibaren 6 ay ge\u00e7tikten sonra tahliye davas\u0131 a\u00e7abilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015fyeri \u0130htiyac\u0131 Nedeniyle Tahliye \u0130htarname \u00d6rne\u011fi<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f yeri ihtiyac\u0131 nedeniyle tahliye ihtarname \u00f6rne\u011fine <a href=\"https:\/\/oner.av.tr\/is-yeri-ihtiyaci-nedeniyle-tahliye-ihtarname-ornegi\/\">BURADAN<\/a> ula\u015fabilirsiniz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015fyeri \u0130htiyac\u0131 Nedeniyle Tahliye Davas\u0131 Dilek\u00e7esi<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015fyeri ihtiyac\u0131 nedeniyle tahliye dava dilek\u00e7esi konunun uzman\u0131 bir avukat taraf\u0131ndan haz\u0131rlanmal\u0131d\u0131r. Zira bu konu uzmanl\u0131k gerektirir. Kira hukuku uzman avukatlar\u0131m\u0131z ile ileti\u015fime ge\u00e7ebilirsiniz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015fyeri \u0130htiyac\u0131 Nedeniyle Tahliye Davas\u0131 Yarg\u0131tay Kararlar\u0131\u00a0<\/strong><\/h2>\n<p style=\"font-weight: 400; text-align: justify;\"><b><strong>Yarg\u0131tay 6. Hukuk Dairesi 2005\/752 Esas, 2005\/2693 Karar Say\u0131l\u0131 Karar<\/strong><\/b><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><em>\u201cDava, i\u015fyeri ihtiyac\u0131 nedeniyle kiralanan\u0131n tahliyesine ili\u015fkindir. Mahkemece davan\u0131n reddine karar verilmi\u015f, h\u00fckm\u00fc davac\u0131 vekili temyiz etmi\u015ftir.<\/em><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><em>Davac\u0131 vekili, m\u00fcvekkilinin o\u011flunun halen kirada tekstil makineleri ticareti ve tamiri i\u015fini yapt\u0131\u011f\u0131n\u0131, kiralayan taraf\u0131ndan i\u015fyerinden tahliyesinin talep edildi\u011fini, davac\u0131n\u0131n kirac\u0131 oldu\u011fu yer ile biti\u015fikteki bo\u015f d\u00fckkan\u0131n birle\u015ftirilerek ayn\u0131 i\u015finin o\u011flunun burada yapmaya devam edece\u011fini bildirerek daval\u0131n\u0131n tahliyesini istemi\u015f, daval\u0131 vekili ise ihtiyac\u0131n samimi olmad\u0131\u011f\u0131 iddias\u0131 ile davan\u0131n reddini savunmu\u015ftur.<\/em><\/p>\n<p style=\"font-weight: 400; text-align: justify;\"><em>6570 say\u0131l\u0131 Yasan\u0131n 7\/c maddesine g\u00f6re i\u015fyerine ihtiyac\u0131na dayal\u0131 olarak a\u00e7\u0131lan tahliye davalar\u0131nda ihtiya\u00e7l\u0131n\u0131n kirada olmas\u0131 halinde ihtiyac\u0131n varl\u0131\u011f\u0131n\u0131n kabul\u00fc i\u00e7in ihtiya\u00e7l\u0131n\u0131n ya tahliye tehdidi alt\u0131nda bulunmas\u0131 veya kiralanan\u0131n yap\u0131lacak i\u015f i\u00e7in daha \u00fcst\u00fcn nitelikte olmas\u0131, en az\u0131ndan halen i\u015f yap\u0131lan yerle e\u015fde\u011fer nitelikte bulunmas\u0131 gerekir. E\u015fde\u011ferlik durumu varsa m\u00fclkiyet hakk\u0131na \u00fcst\u00fcnl\u00fck tan\u0131nmal\u0131d\u0131r. Bu iki halden birisinin varl\u0131\u011f\u0131 ihtiyac\u0131n kabul\u00fc i\u00e7in yeterlidir. Her iki halin birlikte olmas\u0131 gerekmez.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Tahliye tehdidinin varl\u0131\u011f\u0131 davac\u0131 taraf\u0131ndan ileri s\u00fcr\u00fclmemi\u015f ise mahkemece kendili\u011finden nazara al\u0131namaz. Oysa kiralanan\u0131n halen i\u015f yap\u0131lan yerden \u00fcst\u00fcn oldu\u011fu ileri s\u00fcr\u00fclmemi\u015f olsa bile ihtiya\u00e7 iddias\u0131n\u0131n i\u00e7inde bu husus da mevcut oldu\u011fundan\u00a0mahkemece uzman bilirki\u015fi arac\u0131l\u0131\u011f\u0131yla ke\u015fif yap\u0131larak k\u0131yaslama suretiyle bu hususun belirlenmesi gerekir.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Olay\u0131m\u0131za gelince; davac\u0131 vekilinin davas\u0131n\u0131 tahliye tehdidine dayand\u0131rd\u0131\u011f\u0131, yarg\u0131lama s\u0131ras\u0131nda ihtiya\u00e7l\u0131n\u0131n 8.4.2004 tarihli karar ile kirac\u0131 bulundu\u011fu yeri tahliye etmesine karar verildi\u011fi ve \u00c7ankaya&#8217;da 3.3.2004 tarihinden itibaren ba\u015fka bir yerde kirac\u0131 olarak faaliyete ge\u00e7ti\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r. Davac\u0131 tan\u0131klar\u0131 ihtiyac\u0131 do\u011frulam\u0131\u015flard\u0131r. Tahliye tehdidi her ne kadar ba\u015fl\u0131 ba\u015f\u0131na bir tahliye sebebi ise de ihtiya\u00e7l\u0131 yarg\u0131lama s\u0131ras\u0131nda ba\u015fka bir yere kirac\u0131 olarak ta\u015f\u0131nd\u0131\u011f\u0131ndan ve kiralanan\u0131n biti\u015fi\u011finde bo\u015f yer oldu\u011fundan ihtiya\u00e7l\u0131n\u0131n halen kirada bulundu\u011fu yer ile bo\u015f olan davac\u0131ya ait yer ve\u00a0kiralananda mukayeseli ke\u015fif yap\u0131larak bo\u015f yerin tek ba\u015f\u0131na ihtiya\u00e7 i\u00e7in yeterli olup olmad\u0131\u011f\u0131n\u0131n, yetersiz ise iki d\u00fckkan\u0131n birle\u015ftirilmesinin m\u00fcmk\u00fcn bulunup bulunmad\u0131\u011f\u0131n\u0131n ve kirada faaliyette bulunan yer ile kiralanan\u0131n nitelik ve nicelikleri bak\u0131m\u0131ndan mukayesenin yap\u0131larak sonucuna g\u00f6re bir karar vermek gerekirken, eksik inceleme il<u>e<\/u>\u00a0ve en son 2001 y\u0131l\u0131nda a\u00e7\u0131lan ve reddedilen tahliye davalar\u0131 esas al\u0131narak davan\u0131n reddine karar verilmesi hatal\u0131 oldu\u011fundan h\u00fckm\u00fcn bozulmas\u0131 gerekmi\u015ftir.\u201d<\/em><\/p>\n<p><strong>Yarg\u0131tay 3. Hukuk Dairesi 2017\/8919 Esas, 2018\/4322 Karar Say\u0131l\u0131 Karar<\/strong><\/p>\n<p style=\"text-align: justify;\"><em>&#8220;Mahkemece, davac\u0131n\u0131n ihtiya\u00e7\u00a0iddias\u0131n\u0131n zorunlu olmad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Dava konusu yap\u0131lan i\u015fyerinin \u00f6nceki malik taraf\u0131ndan daval\u0131ya 17\/10\/2011 ba\u015flang\u0131\u00e7 tarihli ve 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi ile kiraya verildi\u011fi konusunda taraflar aras\u0131nda bir uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Davac\u0131, kiralanan\u0131n da i\u00e7inde bulundu\u011fu iki katl\u0131 kargir at\u00f6lye vasf\u0131ndaki ta\u015f\u0131nmaz\u0131 \u00f6nceki malikten 23\/12\/2014 tarihinde sat\u0131n alm\u0131\u015ft\u0131r. \u0130htiya\u00e7l\u0131 davac\u0131 , halen &#8230; il\u00e7esinde z\u00fcccaciye ve hediyelik e\u015fya ticareti ile u\u011fra\u015fmakta olup a\u00e7t\u0131\u011f\u0131 i\u015fbu dava ile &#8230; il merkezinde bulunan dava konusu kiralanan ta\u015f\u0131nmazda bebe giyimi a\u011f\u0131rl\u0131kta olmak \u00fczere her t\u00fcrl\u00fc giyime ili\u015fkin imalat ile toptan ve perakende sat\u0131\u015f i\u015fi ile i\u015ftigal etmek amac\u0131nda oldu\u011funu belirterek ihtiya\u00e7 nedeniyle tahliye isteminde bulunmu\u015ftur. <\/em><\/p>\n<p style=\"text-align: justify;\"><em>Dosya kapsam\u0131nda ald\u0131r\u0131lan bilirki\u015fi raporlar\u0131 ile dava konusu mecurun alt kat\u0131 ile birlikte birle\u015ftirilmek suretiyle ihtiya\u00e7 iddias\u0131na uygun, yeterli ve elveri\u015fli oldu\u011fu ve yine davac\u0131n\u0131n \u00f6denmi\u015f sermaye ile aktif b\u00fcy\u00fckl\u00fck olarak yeni bir i\u015fyeri kurabilecek kapasitesi bulundu\u011fu anla\u015f\u0131lmaktad\u0131r. Yarg\u0131tay Hukuk Genel Kurulu&#8217;nun 01\/10\/1997 tarih 1997\/6-630 Esas 1997\/762 Karar say\u0131l\u0131 ilam\u0131nda da belirtildi\u011fi \u00fczere \u00f6zel te\u015febb\u00fcs\u00fcn ticaretini geni\u015fletme amac\u0131 ve bu do\u011frultudaki gereksinimlerinin T\u00fcrk Bor\u00e7lar Kanununda tahliye sebebi olarak tan\u0131mlanan zorunlu ihtiya\u00e7 kapsam\u0131nda de\u011ferlendirilmesi gerekmektedir. Mahkemece, her ne kadar davac\u0131n\u0131n farkl\u0131 bir i\u015f koluna ge\u00e7mek istedi\u011fi ancak i\u015f kolu de\u011fi\u015fikli\u011finin zorunlu ihtiya\u00e7 olmad\u0131\u011f\u0131 belirtilerek davan\u0131n reddine karar verilmi\u015f ise de davac\u0131n\u0131n dava konusu ta\u015f\u0131nmazda halen s\u00fcrd\u00fcrd\u00fc\u011f\u00fc i\u015f kolundan farkl\u0131 bir i\u015f kolunda faaliyet g\u00f6stermek istemesinde hukuki bir engel bulunmad\u0131\u011f\u0131 gibi bu durum \u00f6zel te\u015febb\u00fcs\u00fcn ticaretini geni\u015fletme amac\u0131 kapsam\u0131nda kalmaktad\u0131r.
