Bu d\u00fczenleme 08.06.2022 tarihinde kabul edilmi\u015f ve 11.06.2022 tarihinde de Resmi Gazete&#8217;de yay\u0131mlanm\u0131\u015ft\u0131r.<\/p>\n<p class=\"Metin\" style=\"text-align: justify;\"><strong>11.06.2022 tarihinde 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanununa eklenen ge\u00e7ici madde \u015fu \u015fekildedir;<\/strong><\/p>\n<p class=\"Metin\" style=\"text-align: justify;\"><em>\u201cGE\u00c7\u0130C\u0130 MADDE 1- Konut kiralar\u0131 bak\u0131m\u0131ndan bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih il\u00e2\u00a0<span class=\"GramE\">1\/7\/2023<\/span>\u00a0(bu tarih d\u00e2hil) tarihleri aras\u0131nda yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar, bir \u00f6nceki kira y\u0131l\u0131na ait kira bedelinin y\u00fczde yirmi be\u015fini ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir. Bir \u00f6nceki kira y\u0131l\u0131n\u0131n t\u00fcketici fiyat endeksindeki\u00a0<span class=\"SpellE\">on iki<\/span>\u00a0ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131n y\u00fczde yirmi be\u015fin alt\u0131nda kalmas\u0131 halinde de\u011fi\u015fim oran\u0131 ge\u00e7erlidir. Bu kural, bir y\u0131ldan daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde de uygulan\u0131r. Bu oranlar\u0131 ge\u00e7ecek \u015fekilde yap\u0131lan s\u00f6zle\u015fmeler, fazla miktar y\u00f6n\u00fcnden ge\u00e7ersizdir. Bu f\u0131kra h\u00fckm\u00fc, 344 \u00fcnc\u00fc maddenin ikinci f\u0131kras\u0131 uyar\u0131nca h\u00e2kim taraf\u0131ndan verilecek kararlar bak\u0131m\u0131ndan da uygulan\u0131r.\u201d<\/em><\/p>\n<p id=\"405a\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">TBK&#8217;ya eklenen ge\u00e7ici maddede kira art\u0131\u015f oran\u0131nda bir &#8220;\u00fcst s\u0131n\u0131r&#8221; belirlenmi\u015ftir. Yap\u0131lan Kanun de\u011fi\u015fikli\u011fi ile azami art\u0131\u015f oran\u0131 %25 olarak belirlenmi\u015ftir. Dolay\u0131s\u0131yla art\u0131k bir \u00f6nceki kira y\u0131l\u0131n\u0131n t\u00fcketici fiyat endeksindeki (T\u00dcFE) 12 ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131n %25\u2019ten fazla oldu\u011fu hallerde T\u00dcFE de\u011fi\u015fim oran\u0131n\u0131n kira art\u0131\u015f\u0131nda baz al\u0131nmayacakt\u0131r.<\/p>\n<p id=\"e427\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">Konut kira s\u00f6zle\u015fmesinde \u00f6nceden belirlenmi\u015f bir art\u0131\u015f oran\u0131n\u0131n varl\u0131\u011f\u0131 halinde veya T\u00dcFE\u2019nin 12 ayl\u0131k ortalamaya g\u00f6re de\u011fi\u015fim oran\u0131n\u0131n %25\u2019in alt\u0131nda olmas\u0131 halinde d\u00fc\u015f\u00fck olan art\u0131\u015f oran\u0131 uygulanacakt\u0131r. \u00d6rne\u011fin kira s\u00f6zle\u015fmesinde kira art\u0131\u015f\u0131n\u0131n %40 oran\u0131nda yap\u0131laca\u011f\u0131 belirlenmi\u015fse ve kira art\u0131\u015f ay\u0131nda T\u00dcFE %15 olarak a\u00e7\u0131klanm\u0131\u015f ise burada %15 oran\u0131nda art\u0131\u015f yap\u0131lacakt\u0131r.<\/p>\n<h1 id=\"1659\" class=\"mk ml jk fc mm mn mo mp mq mr ms mt mu mv mw mx my mz na nb nc nd ne nf ng nh hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\"><strong class=\"ba\">Bor\u00e7lar Kanununda \u00d6nceki D\u00fczenleme<\/strong><\/h1>\n<p id=\"abf0\" class=\"pw-post-body-paragraph kw kx jk fc b ky ni la lb lc nj le lf lg nk li lj lk nl lm ln lo nm lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">TBK m.344\/1&#8217;de kira art\u0131\u015f oran\u0131 \u015fu \u015fekilde d\u00fczenlemi\u015fti:<\/p>\n<p id=\"7070\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\"><em class=\"me\">\u201cTaraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki on iki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir. Bu kural, bir y\u0131ldan daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde de uygulan\u0131r.\u201d<\/em><\/p>\n<p id=\"7c07\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">Kanun de\u011fi\u015fikli\u011finden \u00f6nce konut ve \u00e7at\u0131l\u0131 i\u015fyeri kira s\u00f6zle\u015fmelerinde kira bedeline ili\u015fkin anla\u015fmalar bir \u00f6nceki kira y\u0131l\u0131nda T\u00dcFE kapsam\u0131nda 12 ayl\u0131k ortalama nezdinde de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fulu ile ge\u00e7erliydi. Bu noktada kira art\u0131\u015f oran\u0131n\u0131n t\u00fcketici enflasyonun son 12 ayl\u0131k ortalamas\u0131 dikkate al\u0131narak hesaplanmaktayd\u0131.<\/p>\n<h2 id=\"9b93\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\"><strong>Kanun De\u011fi\u015fikli\u011fi Hangi S\u00fcrelerde Ge\u00e7erli Olacakt\u0131r?<\/strong><\/h2>\n<p id=\"2b05\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">\u0130lgili ge\u00e7ici madde uyar\u0131nca; <em class=\"me\">\u201c&#8230;bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih il\u00e2 1\/7\/2023 (bu tarih d\u00e2hil) tarihleri aras\u0131nda yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u201d<\/em> \u015feklinde ifade edilmi\u015ftir.<\/p>\n<p class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">Ge\u00e7ici madde 11.06.2022 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir. Dolay\u0131s\u0131yla konut kiras\u0131na ili\u015fkin s\u00f6zle\u015fme; 11.06.2022 &#8211; 01.07.2023 tarihleri aras\u0131nda yenilenecekse, taraflar aralar\u0131nda bir \u00f6nceki kira y\u0131l\u0131nda \u00f6denmi\u015f kira bedelinin %25\u2019inden fazla kira art\u0131\u015f\u0131 kararla\u015ft\u0131ramayacakt\u0131r.<\/p>\n<p id=\"281d\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">Kanun de\u011fi\u015fikli\u011finden \u00f6nce kira s\u00f6zle\u015fmelerinde kira bedelleri, 12 ayl\u0131k T\u00dcFE ortalamas\u0131 do\u011frultusunda art\u0131r\u0131labilecekti. 11.06.2022\u201301.07.2023 tarihleri aras\u0131nda yenilenecek kira s\u00f6zle\u015fmeleri i\u00e7in ise konut kiralar\u0131nda en fazla %25 oran\u0131nda bir art\u0131\u015f yap\u0131labilecektir. Bununla birlikte s\u00f6zle\u015fmede daha az bir art\u0131\u015f oran\u0131 belirlenmi\u015fse veya T\u00dcFE oran\u0131 daha d\u00fc\u015f\u00fckse kirac\u0131n\u0131n lehine olan oran uygulanacakt\u0131r. Bu noktada s\u00f6zle\u015fmede belirlenen oran Kanun de\u011fi\u015fikli\u011finde yer alan oran ve T\u00dcFE son 12 ayl\u0131k ortalamaya g\u00f6re de\u011fi\u015fim oran\u0131ndan hangisi kirac\u0131 lehine ise o uygulanacakt\u0131r.<\/p>\n<p class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">Kira s\u00f6zle\u015fmeleri, bu ge\u00e7ici Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren yenilenen t\u00fcm kirac\u0131lar bu kuraldan yararlanabileceklerdir. Bunun yan\u0131 s\u0131ra bu art\u0131\u015f s\u0131n\u0131rlamas\u0131, 1 Temmuz 2023 tarihine kadar ge\u00e7erli olacakt\u0131r.<\/p>\n<h2 id=\"c9a9\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\"><strong>Kanun De\u011fi\u015fikli\u011finde Belirlenmi\u015f Oran\u0131n \u00dczerinde Art\u0131\u015f Uygulanmas\u0131 Hali<\/strong><\/h2>\n<p id=\"a56c\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">Eklenen ge\u00e7ici madde ile, kira art\u0131\u015f oran\u0131n\u0131n %25\u2019ten fazla oldu\u011fu konut kira s\u00f6zle\u015fmelerinin tamam\u0131yla ge\u00e7ersiz olmas\u0131ndan ziyade belirlenen oran\u0131 a\u015fan k\u0131sm\u0131n\u0131n ge\u00e7ersizli\u011fi vurgulanm\u0131\u015ft\u0131r. O halde taraflar aras\u0131nda kira art\u0131\u015f oran\u0131n\u0131n %25\u2019ten fazla oldu\u011fu anla\u015fmalarda bu oran\u0131 a\u015far nitelikteki kira bedelleri ge\u00e7ersiz say\u0131lacakt\u0131r.<\/p>\n<p id=\"c336\" class=\"pw-post-body-paragraph kw kx jk fc b ky kz la lb lc ld le lf lg lh li lj lk ll lm ln lo lp lq lr ls jd hl\" style=\"text-align: justify;\" data-selectable-paragraph=\"\">Dolay\u0131s\u0131yla bu d\u00fczenleme sonucunda %25 oran\u0131ndan fazla kira art\u0131\u015f\u0131 \u00f6ng\u00f6ren s\u00f6zle\u015fme h\u00fckm\u00fcn\u00fcn ge\u00e7ersiz olacakt\u0131r. \u00d6denmi\u015f fazla k\u0131s\u0131m sebepsiz zenginle\u015fme h\u00fck\u00fcmlerine tabi olacak ve kirac\u0131 taraf\u0131ndan talep edilebilecektir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Yeni D\u00fczenlemenin 5 Y\u0131ldan Uzun S\u00fcreli Kira S\u00f6zle\u015fmelerine Etkisi<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130lgili d\u00fczenleme ile birlikte enflasyonun olumsuz etkilerinin kirac\u0131lara yans\u0131mas\u0131 engellenmeye \u00e7al\u0131\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p style=\"text-align: justify;\">Be\u015f y\u0131ldan uzun s\u00fcreli kirac\u0131lar\u0131n durumu ise ak\u0131llarda soru i\u015fareti yaratmaktad\u0131r, zira ilgili d\u00fczenlemede TBK m.344\/3 h\u00fckm\u00fcne at\u0131fta bulunulmad\u0131\u011f\u0131ndan dolay\u0131 de\u011fi\u015fikli\u011fin tam anlam\u0131yla amac\u0131na ula\u015ft\u0131\u011f\u0131n\u0131 s\u00f6ylemek m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Yeni D\u00fczenlemenin \u0130\u015fyeri Kiralar\u0131na Etkisi<\/strong><\/h2>\n<p style=\"text-align: justify;\">T\u00fcrk Bor\u00e7lar Kanunu\u2019na eklenen ge\u00e7ici maddeyle getirilen y\u00fczde 25\u2019lik kira art\u0131\u015f s\u0131n\u0131rlamas\u0131, konutlarla s\u0131n\u0131rl\u0131 olarak getirilmi\u015ftir.
