B\u00f6yle bir durumda &#8220;Kira Uyarlama Davas\u0131&#8221; a\u00e7\u0131larak hakimin kira s\u00f6zle\u015fmesine m\u00fcdahalesi talep edilebilir.<\/p>\n<p style=\"text-align: justify;\">S\u00f6zle\u015fmede ve kanunda h\u00fck\u00fcm bulunmad\u0131\u011f\u0131 takdirde, s\u00f6zle\u015fmenin de\u011fi\u015fen hal ve \u015fartlara uydurulmas\u0131n\u0131n gerekip gerekmeyece\u011fi incelenir. Durum ve ko\u015fullar\u0131n de\u011fi\u015fmesi halinde s\u00f6zle\u015fmede \u0131srar etmek d\u00fcr\u00fcstl\u00fck kurallar\u0131na ayk\u0131r\u0131 bir tutum olur.<\/p>\n<p style=\"text-align: justify;\">Uyarlama davas\u0131 daha \u00e7ok ve \u00f6nemli \u00f6l\u00e7\u00fcde uzun ve s\u00fcrekli kira s\u00f6zle\u015fmelerinde s\u00f6z konusu olur. Ancak somut olay\u0131n \u00f6zelli\u011fine g\u00f6re k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde de kira uyarlamas\u0131 talep edilebilir. \u00d6rne\u011fin; \u00fcr\u00fcn kiras\u0131na konu olan tarlan\u0131n ya\u011f\u0131\u015f olmamas\u0131 nedeniyle gelirinin \u00e7ok d\u00fc\u015f\u00fck olmas\u0131 halinde s\u00f6zle\u015fme s\u00fcresi bir y\u0131l olsa dahi kirac\u0131 mevcut durum itibariyle kira paras\u0131n\u0131n indirilerek uyarlanmas\u0131n\u0131 talep edebilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Uyarlama Davas\u0131 \u015eartlar\u0131\u00a0<\/strong><\/h2>\n<p><!--more--><\/p>\n<p style=\"text-align: justify;\">S\u00f6zle\u015fmenin ba\u015flang\u0131c\u0131ndan itibaren be\u015f y\u0131ll\u0131k s\u00fcre boyunca T\u00dcFE art\u0131\u015f oran\u0131na g\u00f6re kira art\u0131\u015f yap\u0131l\u0131r. Bu kural d\u00f6viz endeksli kira s\u00f6zle\u015fmeleri i\u00e7in de be\u015f y\u0131l s\u00fcre boyunca art\u0131r\u0131m yap\u0131lmayaca\u011f\u0131 \u015feklinde ge\u00e7erlidir. TBK m.138&#8217;de yer alan &#8220;A\u015f\u0131r\u0131 \u0130fa G\u00fc\u00e7l\u00fc\u011f\u00fc&#8221; bu kural\u0131n istisnas\u0131d\u0131r. Yani A\u015f\u0131r\u0131 \u0130fa G\u00fc\u00e7l\u00fc\u011f\u00fc (bor\u00e7lu ki\u015finin \u00f6deme g\u00fc\u00e7l\u00fc\u011f\u00fc \u00e7ekmesi) varsa be\u015f y\u0131ll\u0131k s\u00fcre kural\u0131 uygulama bulmayacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">TBK m.138&#8217;e g\u00f6re; s\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131 s\u0131rada taraflarca \u00f6ng\u00f6r\u00fclmeyen ve \u00f6ng\u00f6r\u00fclmesi de beklenmeyen ola\u011fan\u00fcst\u00fc bir durum,\u00a0 ortaya \u00e7\u0131kar ve bor\u00e7lu da borcunu hen\u00fcz ifa etmemi\u015f veya ifan\u0131n a\u015f\u0131r\u0131 \u00f6l\u00e7\u00fcde g\u00fc\u00e7le\u015fmesinden do\u011fan haklar\u0131n\u0131 sakl\u0131 tutarak ifa etmi\u015f olursa bor\u00e7lu, hakimden s\u00f6zle\u015fmenin yeni ko\u015fullara uyarlanmas\u0131n\u0131 isteme, bu m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 takdirde s\u00f6zle\u015fmeden d\u00f6nme hakk\u0131na sahiptir.<\/p>\n<p style=\"text-align: justify;\">Ola\u011fan\u00fcst\u00fc nedenlerle s\u00f6zle\u015fmenin ba\u015flang\u0131c\u0131nda var olan denge taraflar biri aleyhine bozulmu\u015f ise, kirac\u0131 veya kiralayan taraf\u0131ndan uyarlama davas\u0131 a\u00e7\u0131labilecektir.<\/p>\n<p style=\"text-align: justify;\">Kira uyarlama davas\u0131n\u0131n a\u00e7\u0131labilmesi i\u00e7in:<\/p>\n<ul style=\"text-align: justify;\">\n<li>S\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131 s\u0131rada, taraflarca \u00f6ng\u00f6r\u00fclmeyen ve \u00f6ng\u00f6r\u00fclmesi de beklenmeyen ola\u011fan\u00fcst\u00fc bir durum ortaya \u00e7\u0131k\u0131\u015f olmal\u0131d\u0131r. Bu ola\u011fan\u00fcst\u00fc hal herkes i\u00e7in ge\u00e7erli, objektif, \u00f6nceden belirlenemeyecek nitelikte olmal\u0131d\u0131r.<\/li>\n<li>Bu durum bor\u00e7ludan kaynaklanmam\u0131\u015f olmal\u0131d\u0131r.<\/li>\n<li>S\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131 s\u0131rada mevcut olan denge bor\u00e7lu aleyhine de\u011fi\u015fmi\u015f olmal\u0131d\u0131r.<\/li>\n<li>Bor\u00e7lu, borcunu hen\u00fcz \u00f6dememi\u015f veya bu \u00f6demenin a\u015f\u0131r\u0131 derecede g\u00fc\u00e7le\u015fmesinden do\u011fan haklar\u0131n\u0131 sakl\u0131 tutarak ger\u00e7ekle\u015ftirmi\u015f olmal\u0131d\u0131r.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Kirac\u0131, kira paras\u0131n\u0131 \u00f6dedi\u011fi s\u0131rada ihtiraz\u0131 kay\u0131t koyarsa veya daha \u00f6nceden ihtar ke\u015fide ederse geriye y\u00f6nelik olarak kira uyarlama davas\u0131 a\u00e7abilecektir.<\/p>\n<p style=\"text-align: justify;\">Yukar\u0131da say\u0131lan t\u00fcm \u015fartlar TBK m.138 de belirtilmi\u015ftir. Maddeye g\u00f6re, uyarlaman\u0131n b\u00fct\u00fcn ko\u015fullar\u0131 ger\u00e7ekle\u015fmi\u015fse bor\u00e7lu, hakimden s\u00f6zle\u015fmenin yeni ko\u015fullara uyarlanmas\u0131n\u0131 isteyebilir. Bunun m\u00fcmk\u00fcn olmamas\u0131 halinde bor\u00e7lu, s\u00f6zle\u015fmeden d\u00f6nebilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Uyarlama Davas\u0131 Ne Zaman A\u00e7\u0131l\u0131r?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira uyarlama davas\u0131 herhangi bir s\u00fcreye veya ihtara ba\u011fl\u0131 olmadan, durum ve ko\u015fullar\u0131n gerektirdi\u011fi zaman a\u00e7\u0131labilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Uyarlama Davas\u0131n\u0131n<\/strong><strong>\u00a0Taraflar\u0131 Kimlerdir?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira uyarlama davas\u0131n\u0131n taraflar\u0131, kirac\u0131 olabilece\u011fi gibi kiraya veren de olabilir. \u00d6rne\u011fin; kira bedelinin ayl\u0131k kira paras\u0131 d\u00f6viz kar\u015f\u0131l\u0131\u011f\u0131 olarak belirlendikten sonra d\u00f6vizin de\u011ferinin deval\u00fcasyon nedeniyle d\u00fc\u015fmesi halinde a\u00e7\u0131lacak kira uyarlama davas\u0131n\u0131n davac\u0131s\u0131 kiralayan olacakt\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Uyarlama Davas\u0131 Hangi Mahkemede A\u00e7\u0131l\u0131r?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira uyarlama davalar\u0131nda g\u00f6revli mahkeme Sulh Hukuk Mahkemeleridir. Yetkili mahkeme ise, kira konusu ta\u015f\u0131nmaz\u0131n oldu\u011fu yer veya daval\u0131 kiraya verenin yerle\u015fim yeri mahkemesidir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Uyarlama Davas\u0131 A\u00e7\u0131lmas\u0131 Halinde Kirac\u0131n\u0131n Kira Paras\u0131n\u0131 \u00d6deme Sorumlulu\u011fu<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kirac\u0131, kira konusu ta\u015f\u0131nmaz\u0131 kullanmaya devam etmi\u015f ise kural olarak (uyarlama davas\u0131 a\u00e7\u0131lmad\u0131\u011f\u0131 m\u00fcddet\u00e7e) kira paras\u0131n\u0131 \u00f6demek zorundad\u0131r. Aksi takdirde yap\u0131lacak icra takibi veya \u00f6denmeme ihtar\u0131 sonucunda a\u00e7\u0131lacak tahliye davas\u0131 sonucu ta\u015f\u0131nmaz\u0131 tahliye etmek zorunda kalabilir.<\/p>\n<p style=\"text-align: justify;\">Yani kira s\u00f6zle\u015fmesi; kira konusu ta\u015f\u0131nmaz, kiralayana teslim edilmedi\u011fi m\u00fcddet\u00e7e kirac\u0131n\u0131n kira borcu sorumlulu\u011fu devam eder.<\/p>\n<h2 style=\"text-align: justify;\"><strong>D\u00f6viz \u0130le Belirlenen Kira Paras\u0131n\u0131n TL&#8217;ye \u00c7evrilmesi \u0130le \u0130lgili A\u00e7\u0131lacak Kira Uyarlama Davas\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira bedeli yabanc\u0131 para ile kararla\u015ft\u0131r\u0131lm\u0131\u015fsa be\u015f y\u0131ll\u0131k s\u00fcre ge\u00e7medik\u00e7e kira bedelinde de\u011fi\u015fiklik yap\u0131lamayacakt\u0131r. Fakat s\u00f6zle\u015fmenin ba\u015flang\u0131c\u0131nda var olan denge ola\u011fan\u00fcst\u00fc durum nedeniyle taraflardan birinin aleyhine d\u00f6n\u00fc\u015fm\u00fc\u015f ise d\u00f6viz kar\u015f\u0131l\u0131\u011f\u0131 yap\u0131lan kira \u00f6demelerinde de &#8220;Kira Uyarlama Davas\u0131&#8221; a\u00e7\u0131labilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>K\u0131sa S\u00fcreli Kira S\u00f6zle\u015fmeleri Bak\u0131m\u0131ndan Uyarlama Davas\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kural olarak Kira Uyarlama Davas\u0131 uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde uygulama alan\u0131 bulur. Ancak s\u00f6zle\u015fme s\u00fcresi k\u0131sa s\u00fcreli de olsa ola\u011fan\u00fcst\u00fc ve beklenmedik bir durum ortaya \u00e7\u0131km\u0131\u015f ve bu durum bor\u00e7ludan kaynaklanmayan bir sebeple meydana gelmemi\u015f ise Kira Uyarlama Davas\u0131na konu olabilecektir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Uyarlama Davas\u0131 ile Kira Tespit Davas\u0131 Aras\u0131ndaki Farklar Nelerdir?<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li><a href=\"https:\/\/oner.av.tr\/kira-tespit-davasi\/\">Kira tespit davas\u0131nda<\/a> hakim, e\u011fer s\u00f6zle\u015fme 5 y\u0131ldan k\u0131sa s\u00fcreli ise kira bedelini en fazla T\u00dcFE oran\u0131nda art\u0131rabilir.<\/li>\n<li>Kira uyarlama davas\u0131 herhangi bir \u015fart ve s\u0131n\u0131rlama yoktur, kira bedeli yeni ko\u015fullara uyarlanmal\u0131d\u0131r.<\/li>\n<li>Kira tespiti davalar\u0131 yaln\u0131zca konut ve \u00e7at\u0131l\u0131 i\u015f yerleri i\u00e7in a\u00e7\u0131labilir.<\/li>\n<li>Kira uyarlama davalar\u0131 t\u00fcm ta\u015f\u0131n\u0131r ve ta\u015f\u0131nmaz s\u00f6zle\u015fmeleri i\u00e7in a\u00e7\u0131labilir.<\/li>\n<li>Kira tespit davalar\u0131nda kira bedeli; ta\u015f\u0131nmaz\u0131n yeri, bulundu\u011fu bulundu\u011fu yer, kalitesi, de\u011feri ve rayi\u00e7 bedeller g\u00f6z \u00f6n\u00fcnde bulundurularak belirlenir.<\/li>\n<li>Kira uyarlama davalar\u0131nda kira s\u00f6zle\u015fmesinin \u00f6zellikleri, s\u00fcresi, o d\u00f6nemki ekonomi, her iki taraf\u0131n menfaati gibi objektif ko\u015fullar g\u00f6z \u00f6n\u00fcnde bulundurularak kira bedeli belirlenecektir.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Kira Uyarlama Davalar\u0131nda \u0130htiyati Tedbir<\/strong><\/h2>\n<p style=\"text-align: justify;\">Mevcut durumda meydana gelebilecek bir de\u011fi\u015fme sebebiyle hakk\u0131n elde edilmesinin \u00f6nemli \u00f6l\u00e7\u00fcde zorla\u015faca\u011f\u0131ndan veya bir zarar\u0131n do\u011faca\u011f\u0131ndan endi\u015fe edilmesi hallerinde, uyu\u015fmazl\u0131k konusu hakk\u0131nda &#8220;ihtiyati tedbir karar\u0131&#8221; verilebilir.<\/p>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesinin devam\u0131 s\u0131ras\u0131nda ola\u011fan\u00fcst\u00fc bir halin ortaya \u00e7\u0131kmas\u0131 halinde ciddi bir zarar\u0131n ortaya \u00e7\u0131kaca\u011f\u0131 ortadad\u0131r. Hakim somut olay\u0131n \u00f6zelli\u011fine g\u00f6re bu ciddi zarar\u0131 tespit eder ve davan\u0131n a\u00e7\u0131lmas\u0131 ile birlikte ihtiyati tedbir karar\u0131 verebilir.<\/p>\n<p style=\"text-align: justify;\">Mahkemece verilen tedbir karar\u0131, mahkeme karar\u0131 kesinle\u015finceye kadar devam eder.<\/p>\n<p style=\"text-align: justify;\">COVID-19 salg\u0131n hastal\u0131\u011f\u0131na ba\u011fl\u0131 olarak olu\u015fan pandemi s\u00fcrecinde yerle\u015fmi\u015f B\u00f6lge Adliye Mahkemesi ve Yarg\u0131tay 3.
