D\u00fczenlenen ihtar veya \u00f6deme emri kirac\u0131ya tebli\u011f edilmeden, kirac\u0131 taraf\u0131ndan muaccel (\u00f6deme vakti gelmi\u015f, istenebilir) hale gelen kira alaca\u011f\u0131 \u00f6demesi yap\u0131lm\u0131\u015f ise hakl\u0131 ihtar olu\u015fmaz.<\/p>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesi s\u00fcresiz ise veya kira bedeli senelik \u00f6denmi\u015f ise iki hakl\u0131 ihtar olu\u015fmaz.<\/p>\n<p style=\"text-align: justify;\">\u0130htarlar tebli\u011f ile hukuki sonu\u00e7 do\u011furur. Bundan dolay\u0131 \u00f6demelerde tebli\u011f tarihi esas al\u0131nmal\u0131d\u0131r. \u0130htar\u0131n tebli\u011f tarihinden sonra yap\u0131lan \u00f6demenin hukuki de\u011feri yoktur, hukuki sonu\u00e7 do\u011furmaz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130ki Hakl\u0131 \u0130htar Nedeniyle Tahliye Davas\u0131 \u015eartlar\u0131<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li>Kira bedelinin zaman\u0131nda \u00f6denmemi\u015f olmas\u0131 gerekmektedir,<\/li>\n<li>Bir y\u0131l i\u00e7erisinde iki hakl\u0131 ihtar \u00e7ekilmi\u015f olmas\u0131 gerekir,<\/li>\n<li>\u0130htarlar ayr\u0131 ayr\u0131 muaccel kira bedellerine ili\u015fkin olmal\u0131d\u0131r. Yani kira bedelleri ayl\u0131k olarak \u00f6deniyorsa ayn\u0131 aya ait ihtarla &#8220;iki hakl\u0131 ihtar&#8221; olu\u015fmaz,<\/li>\n<li>\u0130htar yaz\u0131l\u0131 ve a\u00e7\u0131k olmal\u0131d\u0131r. Bu ihtarda, hangi ay\u0131n kiras\u0131n\u0131n \u00f6denmedi\u011fi, \u00f6denmesi gereken kira bedeli ve \u00f6denmesi gereken kira bedelinin ne oldu\u011fu mutlaka belirtilmelidir.<\/li>\n<li>Noter arac\u0131l\u0131\u011f\u0131yla d\u00fczenlenen ihtarda tebli\u011f saatinin olmamas\u0131 halinde ayn\u0131 g\u00fcn i\u00e7inde \u00f6deme yap\u0131l\u0131rsa hakl\u0131 ihtar olu\u015fmaz.<\/li>\n<li>Her aya ili\u015fkin yap\u0131lmayan \u00f6deme ayr\u0131 bir hakl\u0131 ihtara konu olur.<\/li>\n<li>Tebli\u011f edilen ihtar veya \u00f6deme emrinde tebli\u011f saati belli de\u011fil ise ayn\u0131 tebli\u011f g\u00fcn\u00fc i\u00e7inde \u00f6deme yap\u0131lmas\u0131 halinde (tebli\u011fden sonra \u00f6demenin yap\u0131ld\u0131\u011f\u0131 ispat edilemez ise) hakl\u0131 ihtar olmaz.<\/li>\n<li>T\u00fcm kira bedellerinin ayn\u0131 ihtarda istenmesi m\u00fcmk\u00fcnd\u00fcr. Fakat bu bedellerin b\u00f6l\u00fcnerek iki farkl\u0131 ihtara konu edilmesi durumunda ikinci ihtar hakl\u0131 ihtar olamaz.<\/li>\n<li>Kiraya verenin kira s\u00fcresinin ve bir y\u0131ldan uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde iki hakl\u0131 ihtar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden itibaren 1 ay i\u00e7in tahliye davas\u0131 a\u00e7m\u0131\u015f olmas\u0131 gerekmektedir.<\/li>\n<li>Kirac\u0131n\u0131n bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde; bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde 2 kira bedelini \u00f6dememi\u015f olmas\u0131 gerekir.<\/li>\n<li>Kiralayan s\u00fcre tayin etmi\u015fse ve kirac\u0131 verilen s\u00fcre i\u00e7erisinde kira bedeline \u00f6demi\u015fse dahi TBK m.315\/2 anlam\u0131nda hakl\u0131 bir ihtar mevcuttur.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Davan\u0131n Taraflar\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">Davan\u0131n kiralayan taraf\u0131ndan a\u00e7\u0131lmas\u0131 gerekir. Birden fazla kiralayan oldu\u011fu durumlarda ise kiralayanlar\u0131n birlikte ihtar d\u00fczenlemeleri ve davay\u0131 birlikte a\u00e7malar\u0131 gerekmektedir.<\/p>\n<p style=\"text-align: justify;\">Davan\u0131n kirac\u0131ya kar\u015f\u0131 a\u00e7\u0131lmas\u0131 gerekir. Birden fazla kirac\u0131 var ise yine ayn\u0131 \u015fekilde\u00a0 ihtar\u0131n ve davan\u0131n b\u00fct\u00fcn kirac\u0131lara kar\u015f\u0131 birlikte a\u00e7\u0131lmas\u0131 gerekecektir.<\/p>\n<p style=\"text-align: justify;\">\u0130ki hakl\u0131 ihtar nedeniyle tahliye davas\u0131na konu olan ta\u015f\u0131nmaz m\u00fc\u015fterek m\u00fclkiyete konu bir ta\u015f\u0131nmaz ise, ihtarnamelerin t\u00fcm ortaklar taraf\u0131ndan tebli\u011f edilmesi gerekir.<\/p>\n<p style=\"text-align: justify;\">Bunun yan\u0131 s\u0131ra e\u011fer malik dava a\u00e7mak istiyorsa kendisinin kiralayan olmas\u0131 gerekir. Kiralayan olmayan malikin dava a\u00e7abilmesi i\u00e7in d\u00fczenlenecek ihtara tapu senedinin eklenip kira paralar\u0131n\u0131n kendisine \u00f6denmesini talep etmesi gerekir.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Kiraya Verenin Vefat Etmesi Durumu;<\/strong><\/h3>\n<p style=\"text-align: justify;\">Kiraya veren, kira ili\u015fkisi kurulduktan sonra vefat ederse; miras\u00e7\u0131lar aras\u0131nda zorunlu dava arkada\u015fl\u0131\u011f\u0131 olaca\u011f\u0131ndan ihtar\u0131n t\u00fcm miras\u00e7\u0131lar taraf\u0131ndan g\u00f6nderilmesi, davan\u0131n t\u00fcm miras\u00e7\u0131lar taraf\u0131ndan birlikte a\u00e7\u0131lmas\u0131 gerekir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Yeni Malikin Tahliye Hakk\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira ili\u015fkisi kurulduktan sonra, kiralanan ta\u015f\u0131nmaza sahip olan yeni malik, \u00f6ncelikle kirac\u0131ya tapu senedini ve hesap numaras\u0131n\u0131 ekleyip kira paras\u0131n\u0131n kendisine \u00f6denmesi i\u00e7in ihtar d\u00fczenleyecek, d\u00fczenlenen ihtardan sonra muaccel hale gelen (\u00f6deme zaman\u0131 gelen) kira paras\u0131n\u0131n bir y\u0131ll\u0131k kira d\u00f6nemi i\u00e7erisinde d\u00fczenlenen iki ihtardan sonra \u00f6denmesi halinde iki hakl\u0131 ihtar olu\u015fmu\u015f olur.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130ki Hakl\u0131 \u0130htar Tahliye Dava A\u00e7ma S\u00fcresi\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">Bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelini \u00f6demedi\u011fi i\u00e7in yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarda bulunulmas\u0131 gerekir.<\/p>\n<p style=\"text-align: justify;\">Bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde ihtar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden itibaren 1 ay i\u00e7inde iki hakl\u0131 ihtar nedeniyle tahliye davas\u0131n\u0131n a\u00e7\u0131lmas\u0131 gerekir.<\/p>\n<p style=\"text-align: justify;\">\u0130htar tebli\u011finden sonra yap\u0131lan \u00f6demeler iki hakl\u0131 ihtar\u0131n olu\u015fmas\u0131na engel te\u015fkil etmez.<\/p>\n<p style=\"text-align: justify;\">Bir y\u0131l\u0131 a\u015fan kira s\u00f6zle\u015fmelerinde kira s\u00fcresinin sonunu beklemeye gerek yoktur. Hakl\u0131 ihtar\u0131n bir y\u0131ll\u0131k kira d\u00f6nemi i\u00e7erisinde ger\u00e7ekle\u015fmesi yeterlidir. \u00d6rne\u011fin; 01.01.2022 ba\u015flang\u0131\u00e7 tarihli ve 4 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesinde iki hakl\u0131 ihtara dayal\u0131 tahliye davas\u0131 a\u00e7\u0131labilmesi i\u00e7in kira s\u00f6zle\u015fmesinin sonunu beklemeye gerek yoktur. 01.01.2022-01.01.2023 kira d\u00f6nemi i\u00e7erisinde iki hakl\u0131 ihtar ger\u00e7ekle\u015fmi\u015f ise 01.01.2022-31.01.2022 (bir y\u0131ll\u0131k kira d\u00f6nemini takip eden bir ay i\u00e7inde) tarihi i\u00e7erisinde tahliye davas\u0131n\u0131n a\u00e7\u0131lmas\u0131 yeterlidir. Yani tahliye davas\u0131 01.01.2023-01.02.2023 tarihleri aras\u0131nda a\u00e7\u0131lmal\u0131d\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Yetkili ve G\u00f6revli Mahkeme<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130ki hakl\u0131 ihtar sebebiyle a\u00e7\u0131lacak olan tahliye davas\u0131nda g\u00f6revli mahkeme Sulh Hukuk Mahkemesidir.<\/p>\n<p style=\"text-align: justify;\">Yetkili mahkeme ise kirac\u0131n\u0131n yerle\u015fim yeri (ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer) mahkemesidir.<\/p>\n<h2><strong>\u0130ki Hakl\u0131 \u0130htar Nedeniyle Tahliye Dava Dilek\u00e7esi\u00a0<\/strong><\/h2>\n<p>Dava dilek\u00e7esine haz\u0131rlan\u0131rken mutlaka dikkat edilmesi gereken hususlar vard\u0131r. Bu hususlardan birinin eksik olmas\u0131 durumunda sonu\u00e7 aleyhinize olabilecektir. Bu nedenle dilek\u00e7e konusunda uzman kira avukat\u0131ndan yard\u0131m alman\u0131z\u0131 \u00f6nermekteyiz.<\/p>\n<h2><strong>\u0130ki Hakl\u0131 \u0130htar \u00d6rne\u011fi<\/strong><\/h2>\n<p>\u0130htarname d\u00fczenlemek uzmanl\u0131k gerektirmektedir. Unutulmamal\u0131d\u0131r ki usul\u00fcne uygun \u015fekilde haz\u0131rlanmayan ihtar ge\u00e7ersiz olacakt\u0131r.
