Kira bedelinin tespiti davalar\u0131n\u0131n konusunu 6570 say\u0131l\u0131 Kanun kapsam\u0131na giren ta\u015f\u0131nmaz mallar olu\u015fturur. Belediye te\u015fkilat\u0131 olan t\u00fcm yerlerdeki ta\u015f\u0131nmazlarla ilgili bu kanun h\u00fck\u00fcmleri uygulan\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Art\u0131\u015f Oran\u0131 ve Kira Bedelinin Tespiti<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira bedelinin tespiti davalar\u0131nda h\u00fck\u00fcm bir kira y\u0131l\u0131na ait kira paras\u0131n\u0131n ne olaca\u011f\u0131n\u0131n belirlenmesine ili\u015fkindir. Bu belirleme a\u00e7\u0131k, net ve tam olmal\u0131d\u0131r. Kira bedelinin tespiti davalar\u0131n\u0131n en \u00e7arp\u0131c\u0131 \u00f6zelli\u011fi kamu d\u00fczeni ile ilgili olmalar\u0131d\u0131r. Bununla ilgili y\u00f6ntemleri taraflar\u0131n belirleyemeyece\u011fi yarg\u0131sal uygulamada kabul edilmi\u015ftir. Hakim, bu davalarda kanun, i\u00e7tihad\u0131 birle\u015ftirme kararlar\u0131 ve Yarg\u0131tay i\u00e7tihatlar\u0131 ile belli edilen y\u00f6ntemlere uygun olarak kira bedelinin tespiti yoluna gitmek zorundad\u0131r. Kira paras\u0131n\u0131n tespitinde belirlenen bu ilke d\u0131\u015f\u0131na \u00e7\u0131k\u0131lmas\u0131 e\u015fit uygulama ilkesini bozdu\u011fu gibi kamu d\u00fczeni ile ilgili olan bu davan\u0131n yap\u0131s\u0131na da uygun d\u00fc\u015fmeyecektir.<\/p>\n<p style=\"text-align: justify;\">TBK 344. maddesine g\u00f6re; Taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki (T\u00dcFE) art\u0131\u015f oran\u0131n\u0131 ge\u00e7memek (T\u00dcFE art\u0131\u015f oran\u0131n\u0131n alt\u0131nda olabilir) ko\u015fuluyla ge\u00e7erlidir.<\/p>\n<p style=\"text-align: justify;\">T\u00dcFE art\u0131\u015f oran\u0131na g\u00f6re kira bedelinin belirlenmesi be\u015f y\u0131l s\u00fcreyle ge\u00e7erlidir. Taraflarca bu konuda bir anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde ve bundan sonraki her be\u015f y\u0131l\u0131n sonunda, yeni kira y\u0131l\u0131nda uygulanacak kira bedeli, hakim taraf\u0131ndan t\u00fcketici fiyat endeksindeki art\u0131\u015f oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete g\u00f6re belirlenir. Her be\u015f y\u0131ldan sonra bu belirlenene kira bedeli usul\u00fcne uygun bi\u00e7imde de\u011fi\u015ftirilebilir.<\/p>\n<p style=\"text-align: justify;\">Kiras\u0131 tespit edilecek olan ta\u015f\u0131nmaz\u0131n konut olmas\u0131 halinde kira net olarak tespit edilecektir. E\u011fer ta\u015f\u0131nmaz i\u015fyeri ise o zaman br\u00fct olarak tespit edilmesi gerekir. Stopaj veya KDV&#8217;nin \u00e7\u0131kar\u0131lmas\u0131 suretiyle net \u00fccret de belirlenmi\u015f olur.<\/p>\n<h3 style=\"text-align: justify;\"><strong><em>Ayl\u0131k kira bedelinin belirlenmesinde \u00fc\u00e7 temel kriter vard\u0131r :<\/em><\/strong><\/h3>\n<h3 style=\"text-align: justify;\"><strong>1-) Taraflar Aras\u0131nda Anla\u015fma Olmas\u0131 Halinde Kira Bedelinin Tespiti<\/strong><\/h3>\n<p style=\"text-align: justify;\">Taraflar kira s\u00f6zle\u015fmesinde kira art\u0131\u015f oran\u0131n\u0131 belirleyebilir. Taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin art\u0131\u015f anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki art\u0131\u015f oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erli olacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Kira bedelindeki art\u0131\u015f oran\u0131 a\u00e7\u0131klanacak T\u00dcFE art\u0131\u015f oran\u0131 \u00fcst s\u0131n\u0131r olmak \u00fczere ge\u00e7erli olacakt\u0131r. Taraflar\u0131n serbest iradeleriyle belirledi\u011fi art\u0131\u015f oran\u0131 kira ili\u015fkisi devam etti\u011fi s\u00fcrece ve be\u015f y\u0131l bitimine kadar uygulama alan\u0131 bulacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">Kira bedelindeki art\u0131\u015f\u0131n \u00fcst s\u0131n\u0131r\u0131, bir \u00f6nceki kira y\u0131l\u0131ndaki t\u00fcketici kira y\u0131l\u0131ndaki t\u00fcketici fiyat endeksinin 12 ayl\u0131k ortalamas\u0131d\u0131r. Yani kira art\u0131\u015f\u0131 hangi ayda yap\u0131lacaksa o aydan \u00f6nceki ay\u0131n 12 ayl\u0131k T\u00dcFE art\u0131\u015f oran\u0131 esas al\u0131narak kira paras\u0131 tespit olunacakt\u0131r. Fakat taraflar T\u00dcFE oran\u0131ndan daha d\u00fc\u015f\u00fck bir oran belirleyebilirler. \u00d6rne\u011fin; Kas\u0131m ay\u0131nda art\u0131\u015f belirlenecekse bir \u00f6nceki ay olan Ekim ay\u0131n\u0131n on iki ayl\u0131k T\u00dcFE art\u0131\u015f oran\u0131 dikkate al\u0131nacakt\u0131r.<\/p>\n<h3 style=\"text-align: justify;\"><strong>2-) <\/strong><strong>Taraflar Aras\u0131nda Anla\u015fma Olmamas\u0131 Halinde Kira Bedelinin Tespiti<\/strong><\/h3>\n<p style=\"text-align: justify;\">Kiralayan ve kirac\u0131 akdetmi\u015f olduklar\u0131 kira s\u00f6zle\u015fmesinde kira bedelindeki art\u0131\u015f oran\u0131n\u0131 belirlemezlerse, en az 30 g\u00fcn \u00f6nceden kira art\u0131\u015f iradesinin kirac\u0131 tarafa bildirilmesi gerekir. Bu bildirim yap\u0131lm\u0131\u015f ise o d\u00f6nem i\u00e7in T\u00dcFE art\u0131\u015f oran\u0131 esas al\u0131narak kira paras\u0131 tespit edilir.<\/p>\n<p style=\"text-align: justify;\">Kira art\u0131\u015f\u0131 i\u00e7in 30 g\u00fcn \u00f6nceden bildirim yap\u0131lmam\u0131\u015f ise tespit olunacak kira paras\u0131 bir sonraki d\u00f6nem i\u00e7in ge\u00e7erli olmak \u00fczere mahkemece tespit edilecektir.<\/p>\n<h3 style=\"text-align: justify;\"><strong>3-) Be\u015f Y\u0131ll\u0131k Kira D\u00f6neminden Sonra Yenilenen Kira S\u00f6zle\u015fmelerinde Kira Bedelinin Tespiti<\/strong><\/h3>\n<p style=\"text-align: justify;\">Kira bedeli hususunda bir anla\u015fma yap\u0131lsa da yap\u0131lmasa da s\u00f6zle\u015fmenin ba\u015flang\u0131\u00e7 tarihinden itibaren be\u015f y\u0131ll\u0131k s\u00fcre ge\u00e7mi\u015f ise, be\u015f y\u0131ll\u0131k s\u00fcreden sonra kira konusu ta\u015f\u0131nmaz\u0131n ayl\u0131k kira paras\u0131 ola\u011fan rayi\u00e7, emsal kira bedelleri ile hakkaniyet dikkate al\u0131narak tespit edilecektir.<\/p>\n<p style=\"text-align: justify;\">Be\u015f y\u0131ll\u0131k kira d\u00f6nemi sonunda hakim kira bedeli belirlenirken T\u00dcFE art\u0131\u015f oran\u0131 ile ba\u011fl\u0131 kalmayacakt\u0131r. A\u00e7\u0131lan kira tespit davas\u0131nda ke\u015fif ve bilirki\u015fi incelemesi sonucu yeni d\u00f6nem kira bedeli belirlenir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Tespit Davas\u0131n\u0131n \u015eartlar\u0131<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li>Taraflar aras\u0131nda bir kira s\u00f6zle\u015fmesi bulunmal\u0131d\u0131r.<\/li>\n<li>Kira s\u00f6zle\u015fmesi yaz\u0131l\u0131 veya s\u00f6zl\u00fc olabilir<\/li>\n<li>Davay\u0131 a\u00e7an ki\u015finin (kiralayan, kirac\u0131 veya malik) bu davay\u0131 a\u00e7maya hukuki yarar\u0131 bulunmal\u0131d\u0131r. Somut olayda hukuki varl\u0131\u011f\u0131n olup olmad\u0131\u011f\u0131 konusunda uzman bir avukattan hukuki dan\u0131\u015fmanl\u0131k almak faydal\u0131 olacakt\u0131r.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Kira Tespit Davas\u0131n\u0131n Taraflar\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmeleri, kar\u015f\u0131l\u0131kl\u0131 iki tarafa bor\u00e7 y\u00fckleyen s\u00f6zle\u015fmelerden olup s\u00f6zle\u015fmenin taraflar\u0131 da kiralayan ve kirac\u0131d\u0131r. Kira bedelinin belirlenmesi i\u00e7in, kira tespit davas\u0131n\u0131 kiralayan, kirac\u0131 veya malik a\u00e7abilir.<\/p>\n<p style=\"text-align: justify;\">Ta\u015f\u0131nmaz elbirli\u011fi m\u00fclkiyetindeyse veya birden fazla kiralayan varsa kira tespit davas\u0131n\u0131n t\u00fcm kiralayanlar taraf\u0131ndan birlikte a\u00e7\u0131lmas\u0131 gerekir. Kira s\u00f6zle\u015fmesinde kirac\u0131 say\u0131s\u0131 birden fazla ise kira tespit davas\u0131n\u0131n t\u00fcm kirac\u0131lara kar\u015f\u0131 y\u00f6neltilmesi gerekir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Bedelinin Yabanc\u0131 Para Olarak Kararla\u015ft\u0131r\u0131lmas\u0131\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">S\u00f6zle\u015fmede kira bedeli yabanc\u0131 para birimi olarak kararla\u015ft\u0131r\u0131lm\u0131\u015fsa, be\u015f y\u0131l ge\u00e7medik\u00e7e kira bedelinde de\u011fi\u015fiklik yap\u0131lamaz. Taraflar, \u015fayet 5 y\u0131l\u0131n sonunda kira s\u00f6zle\u015fmesi devam ediyorsa kira bedelinin tespiti davas\u0131 a\u00e7\u0131labilir. Be\u015f y\u0131l ge\u00e7tikten sonra kira bedelinin belirlenmesinde, yabanc\u0131 paran\u0131n de\u011ferindeki de\u011fi\u015fiklikler, emsal bedeller ve kiralanan\u0131n durumu \u00a0g\u00f6z \u00f6n\u00fcnde bulundurulur.<\/p>\n<p style=\"text-align: justify;\">Kural\u00a0 olarak be\u015f y\u0131l ge\u00e7medik\u00e7e kira bedelinde de\u011fi\u015fiklik yap\u0131lamayacaksa da \u2018A\u015f\u0131r\u0131 \u0130fa G\u00fc\u00e7l\u00fc\u011f\u00fc\u2019 durumu istisnad\u0131r. A\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc, s\u00f6zle\u015fmenin kurulmas\u0131 s\u0131ras\u0131nda edimler aras\u0131na var olan dengenin sonraki d\u00f6nemlerde taraflardan birinin aleyhine de\u011fi\u015fmesidir. Kirac\u0131, TBK 138\/son maddesinde yer alan a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fcne dayanarak &#8220;Kira Uyarlama Davas\u0131&#8221; a\u00e7abilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Tespit Davas\u0131 Ne Zaman A\u00e7\u0131l\u0131r?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kural olarak kira tespit davas\u0131 her zaman a\u00e7\u0131labilir.<\/p>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesinde kira art\u0131\u015f \u015fart\u0131 var ise; kira tespit davas\u0131 herhangi bir ihtar ke\u015fide ve tebli\u011f edilmeksizin d\u00f6nem sonuna kadar a\u00e7\u0131labilir. \u00d6rne\u011fin; kira s\u00f6zle\u015fmesinde kira art\u0131\u015f oran\u0131 belirlenmi\u015fse 01.01.2021-31.12.2021 d\u00f6nemi i\u00e7in 31.12.2021 tarihine kadar bu dava a\u00e7\u0131labilir. A\u00e7\u0131lacak olan davada bu kira tespiti 01.01.2021 tarihinden itibaren ge\u00e7erli olacak \u015fekilde istenecektir. Kirac\u0131, kiraya verenin 12 ayd\u0131r kira ald\u0131\u011f\u0131n\u0131 bu y\u00fczden davay\u0131 a\u00e7mada k\u00f6t\u00fc niyetli oldu\u011funu ileri s\u00fcremeyecektir.<\/p>\n<p style=\"text-align: justify;\">Kira art\u0131\u015f s\u00f6zle\u015fmesinde kira art\u0131\u015f \u015fart\u0131 yok ise; yeni d\u00f6nem ayl\u0131k kira paras\u0131n\u0131n tespiti i\u00e7in en az 30 g\u00fcn \u00f6nceden kira art\u0131\u015f iradesinin kar\u015f\u0131 taraf kirac\u0131ya bildirilmesi zorunludur. Kira art\u0131\u015f iradesi 30 g\u00fcn \u00f6nceden kirac\u0131ya bildirilmezse a\u00e7\u0131lan dava da tespit olunan miktar bir sonraki d\u00f6nemden itibaren ge\u00e7erli olacakt\u0131r. Bu s\u00fcrelere uygun \u015fekilde a\u00e7\u0131lmad\u0131\u011f\u0131 takdirde, kira bedelinin belirlenmesine ili\u015fkin karar bir sonraki kira d\u00f6neminde uygulanabilecektir.<\/p>\n<p style=\"text-align: justify;\">Dolay\u0131s\u0131yla bu davan\u0131n yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan itibaren sonu\u00e7 do\u011furmas\u0131 i\u00e7in yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131ndan en ge\u00e7 <em>otuz g\u00fcn<\/em> \u00f6nceki bir tarihte a\u00e7\u0131lmas\u0131 ve kiraya veren taraf\u0131ndan bu s\u00fcre i\u00e7erisinde kira bedelinin art\u0131r\u0131laca\u011f\u0131na ili\u015fkin olarak kirac\u0131ya yaz\u0131l\u0131 bildirimde bulunulmu\u015f olmas\u0131 gerekir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kiralayan\u0131n El De\u011fi\u015ftirmesi Durumunda Kira Tespit Davas\u0131 A\u00e7\u0131labilir Mi?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Malikin yeni veya eski olmas\u0131, kira tespit davas\u0131 a\u00e7\u0131s\u0131ndan bir anlam ifade etmeyecektir. Yeni mal sahibi de kira ili\u015fkisi ile ba\u011fl\u0131d\u0131r. Dolay\u0131s\u0131yla eski malik gibi yeni malik de bu davay\u0131 a\u00e7abilecektir.<\/p>\n<p style=\"text-align: justify;\">Kira tespit davas\u0131, yeni kira d\u00f6neminin ba\u015flamas\u0131ndan en ge\u00e7 otuz g\u00fcn \u00f6nce a\u00e7\u0131lm\u0131\u015fsa veya art\u0131r\u0131m talebi\u00a0 kar\u015f\u0131 tarafa yaz\u0131l\u0131 olarak bildirilmi\u015fse, tespiti istenen d\u00f6nemin sonuna kadar a\u00e7\u0131lan bir tespit davas\u0131nda al\u0131nan karar geriye etkili olacakt\u0131r. Bu s\u00fcrede dava a\u00e7\u0131lmam\u0131\u015f veya kar\u015f\u0131 tarafa yaz\u0131l\u0131 bildirimde bulunulmam\u0131\u015fsa, a\u00e7\u0131lan tespit davas\u0131 sonucunda belirlenen bedel bir sonraki kira y\u0131l\u0131nda uygulan\u0131r.<\/p>\n<p style=\"text-align: justify;\">Kira konusunun el de\u011fi\u015ftirmesi ihtimalinde, daha \u00f6nceki kiraya veren taraf\u0131ndan TBK&#8217; da belirtilen s\u00fcrede ihtarname g\u00f6nderilmi\u015fse, yeni malikin a\u00e7aca\u011f\u0131 davada verilen karar da geriye etkili olacakt\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Tespit Davalar\u0131nda Takdiri \u0130ndirim<\/strong><\/h2>\n<p style=\"text-align: justify;\">Hak ve nesafet kurallar\u0131na g\u00f6re belirlenen ayl\u0131k kira paras\u0131ndan mahkemece takdiri indirim yap\u0131labilmektedir. Uygulanacak olan takdiri indirim %10-20 aras\u0131d\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Bedelinin Tespiti Davas\u0131 K\u0131smi veya Belirsiz Olarak A\u00e7\u0131labilir Mi?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira bedelinin tespitine ili\u015fkin talep b\u00f6l\u00fcnemez ve kira bedeli davac\u0131 taraf\u0131ndan bir seferde a\u00e7\u0131k ve net olarak istenilmesi gerekir. Di\u011fer bir anlat\u0131mla kira bedelinin tespiti davalar\u0131nda fazlaya ili\u015fkin haklar sakl\u0131 tutulamaz ve sakl\u0131 tutulan bu hakla ilgili olarak \u0131slah talebinde bulunulamaz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Tespit Davalar\u0131nda G\u00f6revli Mahkeme<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira ili\u015fkisinden do\u011fan alacak davalar\u0131 da dahil olmak \u00fczere t\u00fcm uyu\u015fmazl\u0131klar\u0131 konu alan davalar ile bu davalara kar\u015f\u0131 a\u00e7\u0131lan davalara Sulh Hukuk Mahkemeleri bakmakla g\u00f6revlidir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Tespit Davalar\u0131nda Yetkili Mahkeme<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira tespit davalar\u0131nda yetkili mahkeme daval\u0131n\u0131n yerle\u015fim yeri mahkemesi veya s\u00f6zle\u015fmenin icra edildi\u011fi yer mahkemesi yahut taraflarca usul\u00fcne uygun olarak yap\u0131lan yetki s\u00f6zle\u015fmesinde kararla\u015ft\u0131r\u0131lan yer mahkemesinde a\u00e7\u0131labilir. S\u00f6zle\u015fmede belli bir yer mahkemesinin belirlenmesi kiralanan\u0131n bulundu\u011fu yer mahkemesi durumunu etkilemez. Dava her iki yerde de a\u00e7\u0131labilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kira Tespit Davalar\u0131nda Faiz Ba\u015flang\u0131c\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira tespit davalar\u0131, tespit niteli\u011finde oldu\u011fundan dolay\u0131 kesinle\u015fmedi\u011fi s\u00fcrece icra takibine konu olamaz. Karar\u0131n kesinle\u015fmesinden itibaren \u00f6denen ve tespit olunan miktar aras\u0131ndaki fark kirac\u0131dan istenebilir. Talep edilecek miktar ( stopaj miktar\u0131 mahsup edildikten sonra) br\u00fct kira paras\u0131n\u0131n net miktar\u0131 olacakt\u0131r.
