Kirac\u0131 birden fazla ise davan\u0131n hepsine y\u00f6neltilmesi gerekir.<\/p>\n<p style=\"text-align: justify;\">Elbirli\u011fi m\u00fclkiyete konu ta\u015f\u0131nmazda b\u00fct\u00fcn maliklerin davay\u0131 birlikte a\u00e7malar\u0131 gerekir. Ta\u015f\u0131nmaz payl\u0131 m\u00fclkiyete konu ise pay ve payda\u015f \u00e7o\u011funlu\u011fu sa\u011flanmas\u0131 haline bu dava a\u00e7\u0131labilecektir.<\/p>\n<p style=\"text-align: justify;\">Elbirli\u011fi veya payl\u0131 m\u00fclkiyette maliklerden herhangi biri kirac\u0131 ile s\u00f6zle\u015fme akdetmi\u015f ise malikin, yasadan ve kira s\u00f6zle\u015fmesinin taraf\u0131 olmas\u0131ndan kaynakl\u0131 tek ba\u015f\u0131na dava a\u00e7ma hakk\u0131 bulunmaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Malikin kira s\u00f6zle\u015fmesinin taraf\u0131 olmad\u0131\u011f\u0131 durumlarda kendisi, e\u015fi, \u00e7ocuklar\u0131 ve bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filer ihtiya\u00e7 iddialar\u0131 var ise tahliye davas\u0131 a\u00e7abileceklerdir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Konut \u0130htiyac\u0131 Nedeniyle Tahliye Davas\u0131 A\u00e7ma \u015eartlar\u0131<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li>Belirli s\u00fcreli s\u00f6zle\u015fmelerde kiraya veren, kira s\u00f6zle\u015fmesini kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu, veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in, belirlenen s\u00fcrenin sonunda tahliye davas\u0131 a\u00e7\u0131labilir.<\/li>\n<li>Belirsiz s\u00fcreli s\u00f6zle\u015fmelerde ise, fesih bildirim s\u00fcrelerine uyularak belirlenecek tarihten ba\u015flayarak 1 ay i\u00e7inde tahliye davas\u0131 a\u00e7\u0131labilir.<\/li>\n<li>Birden fazla kirac\u0131 varsa davan\u0131n hepsine kar\u015f\u0131 a\u00e7\u0131lmas\u0131 gerekir. G\u00f6nderilen ihtarnamelerin de ayn\u0131 \u015fekilde t\u00fcm kirac\u0131lara g\u00f6nderilmesi gerekecektir.<\/li>\n<li>\u0130htiya\u00e7 nedeniyle a\u00e7\u0131lacak tahliye davas\u0131nda ihtiya\u00e7 iddias\u0131n\u0131n <em>ger\u00e7ek, zorunlu ve samimi<\/em> olmas\u0131 gerekir. Ayn\u0131 \u015fekilde bu ihtiya\u00e7 iddias\u0131n\u0131n yak\u0131n zamanda ger\u00e7ekle\u015fmesi ve dava s\u00fcresince de devam etmesi gerekir.<\/li>\n<li>Dava tarihi itibariyle veya yak\u0131n zamanda ger\u00e7ekle\u015fmesi beklenmeyen ihtiya\u00e7 iddias\u0131 ileri s\u00fcr\u00fclerek tahliye davas\u0131 a\u00e7\u0131lamaz. \u00d6rne\u011fin; kiralayan o\u011flunun ileride evlenece\u011fini ileri s\u00fcrerek tahliye davas\u0131 a\u00e7amaz.<\/li>\n<li dir=\"ltr\">Kiralayan\u0131n yahut ihtiyac\u0131 oldu\u011funu iddia etti\u011fi kendisinin e\u015finin veya\u00a0 alt soy ve \u00fcst soyunun halen kulland\u0131\u011f\u0131 veya bo\u015f olarak tuttu\u011fu ve kullanabilece\u011fi ayn\u0131 vas\u0131flarda ba\u015fkaca bir gayrimenkul\u00fc olmamal\u0131d\u0131r.<\/li>\n<li dir=\"ltr\">Kiralanan\u0131n konut veya \u00e7at\u0131l\u0131 i\u015fyeri olmas\u0131 gerekir.<\/li>\n<li dir=\"ltr\">Kiralayan\u0131n bu gayrimenkule ihtiyac\u0131 olmal\u0131d\u0131r. Yarg\u0131tay bu konuyu bir emsal karar\u0131nda, &#8216;Konut ihtiyac\u0131na dayal\u0131 olarak a\u00e7\u0131lan tahliye davalar\u0131nda tahliyeye karar verilebilmesi i\u00e7in ihtiyac\u0131n ger\u00e7ek, samimi ve zorunlu oldu\u011funun kan\u0131tlanmas\u0131 gerekir. Devaml\u0131l\u0131k arz etmeyen ge\u00e7ici ihtiya\u00e7 tahliye nedeni yap\u0131lamayaca\u011f\u0131 gibi hen\u00fcz do\u011fmam\u0131\u015f veya ger\u00e7ekle\u015fmesi uzun bir s\u00fcreye ba\u011fl\u0131 olan ihtiya\u00e7 da tahliye sebebi olarak kabul edilemez. Davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 tarihte ihtiya\u00e7 sebebinin varl\u0131\u011f\u0131 yeterli olmay\u0131p, bu ihtiyac\u0131n yarg\u0131lama s\u0131ras\u0131nda da devam etmesi gerekir.&#8217; \u015feklinde ifade etmektedir.<\/li>\n<li>Kiraya veren ta\u015f\u0131nmaz\u0131 tahliye ettirmesinden sonra, hakl\u0131 bir sebep olmadan ilgili ta\u015f\u0131nmaz\u0131 3 y\u0131l boyunca kiraya veremeyecektir. Hakl\u0131 bir sebep olmaks\u0131z\u0131n ta\u015f\u0131nmaz\u0131 kiraya verdi\u011fi takdirde tahliye ettirdi\u011fi eski kirac\u0131s\u0131n\u0131n tazminat talep etme hakk\u0131 do\u011facakt\u0131r. S\u00f6z konusu hakl\u0131 sebebi\u00a0 kiraya veren ispat etmelidir. Sonu\u00e7ta hakl\u0131 sebebin varl\u0131\u011f\u0131n\u0131 hakim takdir edecek ve hakl\u0131 sebep yoksa kiraya verenin eski kirac\u0131s\u0131na tazminat \u00f6demesine h\u00fckmedecektir.<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Konut \u0130htiyac\u0131 Nedeniyle Tahliye Davas\u0131 A\u00e7ma S\u00fcresi<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kiraya veren e\u011fer tahliye davas\u0131 a\u00e7mak istiyorsa, kira s\u00fcresinin son g\u00fcn\u00fcnden en az \u00fc\u00e7 ay \u00f6nce kirac\u0131ya bildirimde bulunmal\u0131d\u0131r. Bildirimde bulundu\u011fu kira y\u0131l\u0131n\u0131n son g\u00fcn\u00fcnden itibaren bir ay i\u00e7inde gereksinim nedeniyle tahliye davas\u0131 a\u00e7abilecektir.<\/p>\n<p style=\"text-align: justify;\">Belirli s\u00fcreli s\u00f6zle\u015fmelerde kira s\u00fcresinin bitiminden itibaren 1 ay i\u00e7inde dava a\u00e7mak suretiyle bu yola ba\u015fvurmak gerekir.\u00a0 Konut ve \u00e7at\u0131l\u0131 i\u015fyerlerinde belirli s\u00fcreli kira s\u00f6zle\u015fmesi 1 y\u0131ll\u0131k dahi yap\u0131lm\u0131\u015f olsa bu s\u00fcre kanundaki tahliye \u015fartlar\u0131ndan birisi ger\u00e7ekle\u015fmedi\u011fi takdirde kiraya veren istesin veya istemesin 10 y\u0131la kadar devam etmektedir. Ancak konut ihtiyac\u0131 nedeniyle bu 10 y\u0131l\u0131n\u00a0 dolmas\u0131 beklenmeksizin kira s\u00f6zle\u015fmesinde kararla\u015ft\u0131r\u0131lan s\u00fcre bitti\u011finde 1 ay i\u00e7inde dava a\u00e7mak suretiyle \u015fartlar ger\u00e7ekle\u015fmi\u015fse tahliye etmek m\u00fcmk\u00fcn hale gelebilecektir.<\/p>\n<p style=\"text-align: justify;\">\u00d6rne\u011fin; Kira s\u00f6zle\u015fmeniz 01.01.2022 ba\u015flang\u0131\u00e7 tarihli olup 1 y\u0131l s\u00fcreli ise 31.12.2022 tarihini takip eden bir ay i\u00e7inde (31.01.2023) tahliye davas\u0131 a\u00e7mas\u0131 gerekir. Bu durum ihtarname g\u00f6nderilmedi\u011fi takdirde ge\u00e7erlidir. E\u011fer ihtarname g\u00f6nderilmi\u015fse o zaman 1 ayl\u0131k s\u00fcre uygulanmaz. \u0130htarname g\u00f6nderildi\u011fi takdirde 31.12.2023 tarihine kadar dava a\u00e7\u0131labilecektir.<\/p>\n<p style=\"text-align: justify;\">Belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde ise her 6 ayl\u0131k s\u00fcre\u00e7 fesih d\u00f6nemi olu\u015fturur. Bu s\u00fcrenin sonunda kiraya veren en az 3 ayl\u0131k s\u00fcre vererek tahliyeyi istemelidir. Bu s\u00fcrenin sonunda kirac\u0131 evi tahliye etmedi\u011fi durumda kiraya veren fesih d\u00f6neminin sonundan itibaren 1 ay i\u00e7erisinde tahliye davas\u0131n\u0131 a\u00e7abilecektir. Yani belirsiz s\u00fcreli kira s\u00f6zle\u015fmelerinde her alt\u0131 ayl\u0131k d\u00f6nem bir fesih d\u00f6nemi oldu\u011fundan kiralayan alt\u0131 ayl\u0131k fesih d\u00f6neminden en az \u00fc\u00e7 ay \u00f6nce kirac\u0131ya bildirimde bulunmak ve alt\u0131 ayl\u0131k fesih d\u00f6nemi dolduktan sonra bir ay i\u00e7erinde davay\u0131 a\u00e7mak durumundad\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u00d6rne\u011fin; 01.01.2022 tarihinde ba\u015flayan belirsiz s\u00fcreli kira s\u00f6zle\u015fmesinde her bir alt\u0131 ay fesih d\u00f6nemidir. Buna g\u00f6re 01.01.2022-30.06.2022 ilk fesih d\u00f6nemi, 01.07.2022-31.12.2022 ikinci fesih d\u00f6nemi, 01.01.2023-30.06.2023 \u00fc\u00e7\u00fcnc\u00fc fesih d\u00f6nemidir. 2023 y\u0131l\u0131n\u0131n \u015fubat ay\u0131nda ta\u015f\u0131nmaza ihtiyac\u0131 has\u0131l olan kiraya veren en ge\u00e7 31.03.2023 tarihine kadar kirac\u0131ya bildirimi ula\u015ft\u0131rmak ve 01.07.2023-31.07.2023 tarihleri aras\u0131nda tahliye davas\u0131n\u0131 a\u00e7mak zorundad\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Konut \u0130htiyac\u0131 Nedeniyle Tahliye \u0130htar S\u00fcresi\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesi belirli s\u00fcreli ise ihtarname \u00e7ekmeniz \u015fart de\u011fildir. Yukar\u0131da yaz\u0131lan dava a\u00e7ma s\u00fcrelerine dikkat etmeniz yeterlidir.<\/p>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesi belirsiz s\u00fcreli ise ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7madan \u00f6nce mutlaka ihtar \u00e7ekilmesi gerekmektedir. \u00c7ekilecek olan ihtar, TBK 329. madde gere\u011fince 6&#8217;\u015far ayl\u0131k d\u00f6nemler i\u00e7in 3 ay \u00f6nceden g\u00f6nderilmelidir. \u00d6rne\u011fin; 01.04.2022 tarihinde ba\u015flayan belirsiz s\u00fcreli kira s\u00f6zle\u015fmesinde her bir alt\u0131 ay fesih d\u00f6nemidir. Buna g\u00f6re 01.04.2022-30.09.2022 ilk fesih d\u00f6nemi, 01.10.2022-31.03.2022 ikinci fesih d\u00f6nemi, 01.04.2023-30.09.2023 \u00fc\u00e7\u00fcnc\u00fc fesih d\u00f6nemidir. 2023 y\u0131l\u0131n\u0131n may\u0131s ay\u0131nda ta\u015f\u0131nmaza ihtiyac\u0131 has\u0131l olan kiraya veren en ge\u00e7 30.06.2023 tarihine kadar kirac\u0131ya ihtar\u0131 g\u00f6ndermek zorundad\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Konut \u0130htiyac\u0131n\u0131n \u0130spat\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">Gereksinim nedeniyle a\u00e7\u0131lacak tahliye davalar\u0131nda, davan\u0131n s\u00fcresinde a\u00e7\u0131lmas\u0131 yeterli olmay\u0131p, gereksinim iddias\u0131n\u0131n da tan\u0131k dahil her t\u00fcrl\u00fc delil ile ispat edilmesi gerekir.<\/p>\n<p style=\"text-align: justify;\">\u0130htiya\u00e7 iddias\u0131nda bulunan\u0131n kirada olmas\u0131 ihtiya\u00e7 iddias\u0131 i\u00e7in karine te\u015fkil eder. Zira kiraya verenin ta\u015f\u0131nmaz\u0131 bo\u015f tutmas\u0131na ra\u011fmen ihtiya\u00e7 iddias\u0131nda bulunmas\u0131, bu iddian\u0131n &#8216;ger\u00e7ek ve samimi&#8217; olmad\u0131\u011f\u0131n\u0131 g\u00f6sterir.<\/p>\n<p style=\"text-align: justify;\">\u00d6rne\u011fin asans\u00f6r\u00fc olmayan bir evin \u00fcst kat\u0131nda ya\u015fayan ya\u015fl\u0131 bir kiralayan, asans\u00f6rl\u00fc eve ihtiyac\u0131 oldu\u011funu ileri s\u00fcrerek tahliye davas\u0131 a\u00e7abilir. B\u00f6yle durumlarda mahkemece her iki ta\u015f\u0131nmaz \u00fczerinde ke\u015fif-bilirki\u015fi incelemesi yap\u0131larak \u00fcst\u00fcn vas\u0131f tespit edilir.<\/p>\n<p style=\"text-align: justify;\">Bunun d\u0131\u015f\u0131nda kiralayan, ikamet etti\u011fi evi kirac\u0131n\u0131n talebine ra\u011fmen kirac\u0131ya olan rayice uygun kira paras\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda kiralamad\u0131ysa veya bunu teklif etmediyse de ihtiya\u00e7 iddias\u0131n\u0131n ger\u00e7ek ve samimi oldu\u011fu kabul edilemez.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Konut Gereksinimi Nedeniyle Tahliye Davas\u0131nda G\u00f6revli ve Yetkili Mahkeme<\/strong><\/h2>\n<p style=\"text-align: justify;\">Konut ihtiyac\u0131 nedeniyle tahliye davas\u0131nda g\u00f6revli mahkeme Sulh Hukuk mahkemesidir.<\/p>\n<p style=\"text-align: justify;\">Yetkili mahkeme ise kiraya verilen ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesidir. Tahliye davas\u0131 ta\u015f\u0131nmaz\u0131n ayn\u0131na ili\u015fkin olmad\u0131\u011f\u0131ndan, bu yetki kesin olmay\u0131p daval\u0131n\u0131n yerle\u015fim yeri ya da s\u00f6zle\u015fmenin ifa edilece\u011fi yerde de tahliye davas\u0131 a\u00e7\u0131labilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Tahliye Davas\u0131 Devam Ederken Evin Bo\u015falt\u0131lmas\u0131\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">Konut ihtiyac\u0131 nedeniyle a\u00e7\u0131lan tahliye davas\u0131 devam ederken kirac\u0131 evi bo\u015falt\u0131rsa ne olur? Bu durumda tahliye davas\u0131 konusuz kalm\u0131\u015f olacakt\u0131r. Ancak davac\u0131 taraf, yarg\u0131lama gideri ve vekalet \u00fccreti talep edebilir. E\u011fer davac\u0131n\u0131n b\u00f6yle bir talebi varsa dava konusuz kalmam\u0131\u015f gibi deliller toplan\u0131r ve davac\u0131n\u0131n hakl\u0131 \u00e7\u0131kmas\u0131 durumunda daval\u0131 aleyhine yarg\u0131lama gideri ve vekalet \u00fccretine h\u00fckmedilebilir. Ancak davac\u0131 yarg\u0131lama gideri ve vekalet \u00fccreti istemedi\u011fi takdirde mahkeme, davan\u0131n konusuz kald\u0131\u011f\u0131n\u0131 ve yarg\u0131lama gideri ile vekalet \u00fccretine h\u00fckmedilmesine yer olmad\u0131\u011f\u0131na dair karar verir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Konut \u0130htiyac\u0131 Nedeniyle Tahliye Dava Dilek\u00e7esi\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">Haz\u0131rlanacak olan dava dilek\u00e7esinin mutlaka \u00f6zenli bir \u015fekilde haz\u0131rlanmas\u0131 gerekir. Aksi takdirde dava aleyhinize sonu\u00e7lanabilecektir.
