Bu s\u00fcre s\u00f6zle\u015fme d\u00fczenlenirken genelde 1 y\u0131l olarak belirlenmektedir. Kira m\u00fcddetlerinin 1 y\u0131l olarak d\u00fczenlenmesinde fayda vard\u0131r. Dolay\u0131s\u0131yla yap\u0131lan s\u00f6zle\u015fme de imzaland\u0131\u011f\u0131 s\u00fcre kadar ge\u00e7erli olmaktad\u0131r. Kiraya verenin \u00f6l\u00fcm\u00fc durumunda t\u00fcm miras\u00e7\u0131lar kendili\u011finden kiralayan s\u0131fat\u0131n\u0131 kazan\u0131r ve kira s\u00f6zle\u015fmesinin devam eder.<\/p>\n<p style=\"text-align: justify;\">Kira s\u00f6zle\u015fmesinin tarihi bittikten sonra yenilenip yenilenmeyece\u011fi karar\u0131, miras\u00e7\u0131 ve kirac\u0131 aras\u0131nda yap\u0131lacak anla\u015fmaya g\u00f6re de\u011fi\u015fiklik g\u00f6sterir. Yasal\u00a0kira\u00a0art\u0131\u015f oran\u0131,\u00a0kira\u00a0s\u00f6zle\u015fmesinin doldu\u011fu tarihi takip eden ay\u0131n a\u00e7\u0131klanan 12 ayl\u0131k T\u00dcFE ortalamas\u0131 al\u0131narak hesaplan\u0131yor. Ev sahipleri bu oran\u0131n \u00fczerinde art\u0131\u015f yapam\u0131yor.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kiray\u0131 \u00d6demeyen Kirac\u0131ya Yapt\u0131r\u0131m Ne Olabilir?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Kiray\u0131 \u00f6demeyen kirac\u0131ya yapt\u0131r\u0131mlar 2 \u015fekilde olabilir;<\/p>\n<h3 style=\"text-align: justify;\"><strong>1- Temerr\u00fct Yoluyla Tahliye<\/strong><\/h3>\n<p style=\"text-align: justify;\">Kira bedelinin \u00f6denmemesi durumunda kirac\u0131ya iki hakl\u0131 ihtarname g\u00f6nderdikten sonra kira borcunun 30 g\u00fcn i\u00e7erisinde halen \u00f6denmemesi durumunda\u00a0 kira s\u00f6zle\u015fmesinin feshedilece\u011fi y\u00f6n\u00fcnde bildirimde bulunmak gerekir.<\/p>\n<p style=\"text-align: justify;\">30 g\u00fcnl\u00fck s\u00fcrenin ard\u0131ndan \u00fc\u00e7\u00fcnc\u00fc bir ihtara gerek kalmaks\u0131z\u0131n kira \u00f6demeyen kirac\u0131 tahliye davas\u0131 ile kar\u015f\u0131 kar\u015f\u0131ya b\u0131rak\u0131labilir. Aksi halde cebri icra yolu ile tahliye edilece\u011fi belirtilir. Bor\u00e7lu 7 g\u00fcn i\u00e7inde borca itiraz ederse takip durur. Bu durumda itiraz\u0131n kald\u0131r\u0131lmas\u0131 i\u00e7in alacakl\u0131n\u0131n dava a\u00e7mas\u0131 gerekecektir.<\/p>\n<p style=\"text-align: justify;\">E\u011fer bor\u00e7lu 7 g\u00fcn i\u00e7inde itiraz etmezse takip kesinle\u015fir, 30 g\u00fcn i\u00e7inde \u00f6deme yapmazsa icra yolu ile tahliye ger\u00e7ekle\u015fir ve haciz i\u015flemleri ba\u015flat\u0131l\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Kiraya Verenin Hapis Hakk\u0131n\u0131n \u015eartlar\u0131 Nelerdir?<\/strong><\/h2>\n<p style=\"text-align: justify;\">Rehin, bir bor\u00e7lunun borcunu teminat alt\u0131na almak i\u00e7in ta\u015f\u0131n\u0131r veya ta\u015f\u0131nmaz \u00fczerinde kurulan bir hak olup hapis hakk\u0131 da, ta\u015f\u0131n\u0131r rehinlerine bir \u00f6rnek te\u015fkil etmektedir.<\/p>\n<p style=\"text-align: justify;\">Hapis hakk\u0131 ile alacakl\u0131, bor\u00e7luya ait olup, bor\u00e7lunun r\u0131zas\u0131yla zilyedi bulundu\u011fu ta\u015f\u0131n\u0131r\u0131 veya k\u0131ymetli evrak\u0131, borcun zaman\u0131n\u0131n gelmesi\u00a0 h\u00e2linde, bor\u00e7 \u00f6deninceye kadar hapsedebilir. Bor\u00e7 yerine getirilmezse alacakl\u0131; bor\u00e7luya \u00f6nce bildirimde bulunacak ard\u0131ndan, hapsetti\u011fi \u015feylerin paraya \u00e7evrilmesini isteyebilecektir.<\/p>\n<p style=\"text-align: justify;\">Kiraya veren kirac\u0131ya ait ta\u015f\u0131n\u0131rlara\u00a0 el koyabilmektedir.
