Peki sat\u0131l\u0131\u011fa \u00e7\u0131kar\u0131lan evi, kirac\u0131 al\u0131c\u0131lara g\u00f6stermek zorunda m\u0131? Kirac\u0131 evi gezdirmek zorunda m\u0131? Kirac\u0131 evin foto\u011fraf\u0131n\u0131 \u00e7ektirmek zorunda m\u0131?\u00a0 \u0130\u015fte bu yaz\u0131m\u0131zda bunlardan bahsedece\u011fiz.<\/p>\n<h1 style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Kirac\u0131 Evi G\u00f6stermek Zorunda M\u0131?<\/span><\/strong><\/h1>\n<p style=\"text-align: justify;\">Kirac\u0131 sat\u0131l\u0131k evi g\u00f6stermek zorunda m\u0131? Ta\u015f\u0131nmaz mal\u0131n sahibi olan ki\u015fi ta\u015f\u0131nmaz\u0131n\u0131 diledi\u011fi zaman satabilir. \u0130\u015fte bu sat\u0131\u015f s\u00fcrecinde baz\u0131 kirac\u0131lar evi g\u00f6stermek istememektedirler. Evi g\u00f6remeyen al\u0131c\u0131 da evi almaktan vazge\u00e7iyor ve bu durumda sat\u0131c\u0131 ma\u011fdur olmaktad\u0131r. Peki kirac\u0131n\u0131n evi g\u00f6stermeme gibi bir hakk\u0131 var m\u0131 yoksa kirac\u0131n\u0131n evi g\u00f6sterme zorunlulu\u011fu var m\u0131?<\/p>\n<p style=\"text-align: justify;\">Kirac\u0131, kiralanan\u0131 sat\u0131n almak ya da kendisi \u00e7\u0131kt\u0131ktan sonra kiralamak isteyenlerin g\u00f6rmesine ve gezmesine izin vermekle y\u00fck\u00fcml\u00fcd\u00fcr. Ancak bu yap\u0131l\u0131rken kirac\u0131 i\u00e7in en uygun olan zaman se\u00e7ilmelidir. Aksi takdirde evi g\u00f6sterme bahanesiyle kirac\u0131 ma\u011fdur edilebilecektir.<\/p>\n<p>Yani evde kirac\u0131 varken evin foto\u011fraf\u0131n\u0131 \u00e7ekmek hukuka uygun olmayabilir. Bununla ilgili yak\u0131n zamanda bir i\u00e7tihat \u00e7\u0131kaca\u011f\u0131n\u0131 da d\u00fc\u015f\u00fcnmekteyiz.<\/p>\n<h1 style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong>Ev Sahibi Evin Foto\u011fraflar\u0131n\u0131 \u00c7ekebilir Mi?<\/strong><\/span><\/h1>\n<p style=\"text-align: justify;\">Emlak\u00e7\u0131 evin foto\u011fraflar\u0131n\u0131 \u00e7ekebilir mi? Evi sat\u0131l\u0131\u011fa \u00e7\u0131karmak isteyen ev sahipleri evin son halinin foto\u011fraf\u0131n\u0131 \u00e7ekip ilana koymak istemektedirler. Kirac\u0131 ise bu duruma pek yana\u015fmamaktad\u0131r. Peki kirac\u0131, evin foto\u011fraf\u0131n\u0131n \u00e7ekilmesine m\u00fcsaade etmek zorunda m\u0131?<\/p>\n<p style=\"text-align: justify;\">A\u00e7\u0131k\u00e7as\u0131 bu konuyla ilgili ne mevzuatta ne de i\u00e7tihatlarda bir h\u00fck\u00fcm bulunmamaktad\u0131r. Ancak son zamanlarda a\u00e7t\u0131\u011f\u0131m\u0131z sat\u0131lacak olan evin kirac\u0131 taraf\u0131ndan g\u00f6sterilmesi davalar\u0131nda evin i\u00e7inin foto\u011fraf\u0131n\u0131n \u00e7ekilmesi mahkemece reddedilmektedir. Evin d\u0131\u015ftan foto\u011fraf\u0131n\u0131n \u00e7ekilmesi talebini ise mahkeme kabul etmektedir.<\/p>\n<h1 style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Kirac\u0131n\u0131n Evi G\u00f6stermesi Davas\u0131\u00a0<\/span><\/strong><\/h1>\n<p style=\"text-align: justify;\">Sat\u0131l\u0131\u011fa \u00e7\u0131kar\u0131lm\u0131\u015f ev kirac\u0131 taraf\u0131ndan g\u00f6sterilmek zorundad\u0131r. Evi g\u00f6stermeyen kirac\u0131 veya ev sahibi ve kirac\u0131n\u0131n hangi g\u00fcn ve saatlerde evin g\u00f6sterilece\u011fi hususunda anla\u015famamas\u0131 halinde ev sahibi dava a\u00e7abilecektir. Bu dava &#8220;Kira (Kiralanan\u0131 G\u00f6stermeye \u0130zin \u0130stemli)&#8221; davas\u0131d\u0131r. Bu dava T\u00fcrk Bor\u00e7lar Kanunu md. 319\/2 ye dayan\u0131larak a\u00e7\u0131labilir.<\/p>\n<p style=\"text-align: justify;\"><strong>TBK 319\/2<\/strong> <strong>&#8211;<\/strong> <em>Kirac\u0131, bak\u0131m, sat\u0131\u015f ya da sonraki kiralama i\u00e7in zorunlu oldu\u011fu \u00f6l\u00e7\u00fcde, kiraya verenin <\/em><em>ve onun belirledi\u011fi \u00fc\u00e7\u00fcnc\u00fc ki\u015finin kiralanan\u0131 gezip g\u00f6rmesine izin vermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/em><\/p>\n<p style=\"text-align: justify;\"><strong>TBK 319\/3 &#8211;<\/strong><em> Kiraya veren, \u00e7al\u0131\u015fmalar\u0131 ve kiralanan\u0131n gezilip g\u00f6r\u00fclece\u011fini uygun bir s\u00fcre \u00f6nce <\/em><em>kirac\u0131ya bildirmek ve bunlar\u0131n yap\u0131ld\u0131\u011f\u0131 s\u0131rada kirac\u0131n\u0131n yararlar\u0131n\u0131 g\u00f6z \u00f6n\u00fcnde tutmak <\/em><em>zorundad\u0131r. <\/em><\/p>\n<p style=\"text-align: justify;\">Davan\u0131n g\u00f6r\u00fclmesi a\u015famas\u0131nda dikkat edilmesi gereken durumlar vard\u0131r. Bunlar:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Ta\u015f\u0131nmaz\u0131n niteli\u011fi bulundu\u011fu mevki g\u00f6z \u00f6n\u00fcnde tutularak muhtemel sat\u0131labilme s\u00fcresi tespit edilmelidir. Bu s\u00fcre i\u00e7esinde de hangi g\u00fcn ve saatlerde g\u00f6sterilmesinin uygun olaca\u011f\u0131, hem kirac\u0131 hem de ev sahibinin menfaati g\u00f6z \u00f6n\u00fcne al\u0131narak belirlenmelidir.<\/li>\n<li>Kirac\u0131n\u0131n i\u015f ve be\u015feri ili\u015fkileri de g\u00f6z \u00f6n\u00fcne al\u0131narak g\u00fcn ve saatin belirlenmesi gerekir.<\/li>\n<li>Hakim davay\u0131 duru\u015fmal\u0131 olarak y\u00fcr\u00fctmelidir. Taraf delillerinin toplanmas\u0131 a\u00e7\u0131s\u0131ndan bu durum \u00f6nemlidir. Mahkemece, duru\u015fma a\u00e7\u0131larak taraf delilleri birlikte de\u011ferlendirilerek neticesine g\u00f6re bir karar verilmesi gerekir.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><strong>MADDE 319\/2-<\/strong> <em>Kirac\u0131, bak\u0131m, sat\u0131\u015f ya da sonraki kiralama i\u00e7in zorunlu oldu\u011fu \u00f6l\u00e7\u00fcde, kiraya verenin ve onun belirledi\u011fi \u00fc\u00e7\u00fcnc\u00fc ki\u015finin kiralanan\u0131 gezip g\u00f6rmesine izin vermekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/em><br \/>\n<em><strong>MADDE 319\/3-<\/strong> Kiraya veren, \u00e7al\u0131\u015fmalar\u0131 ve kiralanan\u0131n gezilip g\u00f6r\u00fclece\u011fini uygun bir s\u00fcre \u00f6nce kirac\u0131ya bildirmek ve bunlar\u0131n yap\u0131ld\u0131\u011f\u0131 s\u0131rada kirac\u0131n\u0131n yararlar\u0131n\u0131 g\u00f6z \u00f6n\u00fcnde tutmak zorundad\u0131r.<\/em><\/p>\n<h1 style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Kiralanan\u0131 G\u00f6stermeye \u0130zin Davas\u0131nda G\u00f6revli Mahkeme<\/span><\/strong><\/h1>\n<p style=\"text-align: justify;\">Kirac\u0131n\u0131n evi g\u00f6stermesi davas\u0131nda g\u00f6revli mahkeme Sulh Hukuk Mahkemesidir.<\/p>\n<h1 style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Kiralanan\u0131 G\u00f6stermeye \u0130zin Davas\u0131nda Yetkili Mahkeme <\/span><\/strong><\/h1>\n<p style=\"text-align: justify;\">Kirac\u0131n\u0131n evi g\u00f6stermesi davas\u0131nda yetkili mahkeme hangisidir? Bu davada \u00f6ncelikle kira s\u00f6zle\u015fmesine bakmak gerekir. Kira s\u00f6zle\u015fmesinde hangi mahkemelerin yetkili olaca\u011f\u0131 yaz\u0131lm\u0131\u015f olabilir. Ancak e\u011fer kira s\u00f6zle\u015fmesinin taraflar\u0131 tacir veya kamu t\u00fczel ki\u015fisi de\u011filse yap\u0131lan olan yetki s\u00f6zle\u015fmesi ge\u00e7ersizdir. Yani tacir olmayan iki vatanda\u015f aras\u0131nda yap\u0131lan olan kira s\u00f6zle\u015fmesindeki yetki durumu ge\u00e7ersizdir. Bu davalarda yetkili mahkeme ta\u015f\u0131nmaz\u0131n bulundu\u011fu yer mahkemesidir.<\/p>\n<h1 style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Kiralanan\u0131 G\u00f6stermeye \u0130zin Davas\u0131nda Vekalet \u00dccreti<\/span><\/strong><\/h1>\n<p style=\"text-align: justify;\">Taraflar aras\u0131ndaki uyu\u015fmazl\u0131\u011f\u0131n kiralanan\u0131 g\u00f6stermeye izin davas\u0131 oldu\u011funda vekalet \u00fccretinin maktu olarak takdir edilmesi gerekir.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Evimi satmak istiyorum kirac\u0131 evi g\u00f6stermiyor.
