Bu halde kar\u015f\u0131m\u0131za, kiralanan\u0131 devren kazanm\u0131\u015f olan yeni malikin (ev sahibi) kira s\u00f6zle\u015fmesini devam ettirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc alt\u0131nda tutulup tutulmayaca\u011f\u0131 sorunu \u00e7\u0131kar.<\/p>\n<p style=\"text-align: justify;\">Hukukumuzda s\u00f6zle\u015fmeler, kural olarak yaln\u0131zca taraflar\u0131 ba\u011flar. Fakat kanun kirac\u0131n\u0131n korunmas\u0131 amac\u0131yla, bu \u015fekilde kiralanan\u0131n sonradan \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye devredilmesi hallerinde s\u00f6zle\u015fmenin ayakta tutulmas\u0131n\u0131 esas kabul eder. Ancak \u00f6yle haller vard\u0131r ki, yeni maliki var olan s\u00f6zle\u015fme ile ba\u011fl\u0131 tutmak, malik a\u00e7\u0131s\u0131ndan \u00e7ekilmez bir hal alabilir. \u00d6rne\u011fin, konut olarak kullanmak amac\u0131yla bir ta\u015f\u0131nmaz\u0131 sat\u0131n alan ve bu ama\u00e7la kullanabilece\u011fi ba\u015fka bir ta\u015f\u0131nmaz da bulunmayan ki\u015fi, sat\u0131n ald\u0131\u011f\u0131 ta\u015f\u0131nmaz\u0131n kira s\u00f6zle\u015fmesine konu edilmi\u015f bulunmas\u0131 dolay\u0131s\u0131yla kiralanandan yararlanamayacak m\u0131d\u0131r? Bu gibi ihtiya\u00e7lar sebebiyle kanun koyucu, baz\u0131 \u015fartlar\u0131n da varl\u0131\u011f\u0131 halinde, yeni ev sahibine kiralanan\u0131n tahliyesini talep etme hakk\u0131 tan\u0131m\u0131\u015ft\u0131r. T\u00fcrk Bor\u00e7lar Kanunu 351. madde bunu a\u00e7\u0131k\u00e7a belirtmi\u015ftir :<\/p>\n<p style=\"text-align: justify;\"><em>\u201cMadde 351 \u2013 Kiralanan\u0131 sonradan edinen ki\u015fi, onu kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut veya i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa, edinme tarihinden ba\u015flayarak bir ay i\u00e7inde durumu kirac\u0131ya yaz\u0131l\u0131 olarak bildirmek ko\u015fuluyla, kira s\u00f6zle\u015fmesini alt\u0131 ay sonra a\u00e7aca\u011f\u0131 bir davayla sona erdirebilir.<\/em><\/p>\n<p style=\"text-align: justify;\"><em>Kiralanan\u0131 sonradan edinen ki\u015fi, dilerse gereksinim sebebiyle s\u00f6zle\u015fmeyi sona erdirme hakk\u0131n\u0131, s\u00f6zle\u015fme s\u00fcresinin bitiminden ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava yoluyla da kullanabilir.\u201d<\/em><\/p>\n<p style=\"text-align: justify;\">G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, kanun yeni malikin ihtiyac\u0131 sebebiyle, yaz\u0131l\u0131 bildirim \u015fart\u0131n\u0131 da yerine getirmek kayd\u0131yla, kira s\u00f6zle\u015fmesinin dava yoluyla sona erdirilmesine imkan tan\u0131m\u0131\u015ft\u0131r. Bu ihtiya\u00e7 hallerini ve bildirim usul\u00fcn\u00fc a\u015fa\u011f\u0131da detayl\u0131 \u015fekilde inceleyece\u011fiz. Ayr\u0131ca unutmadan s\u00f6yleyelim ki, T\u00fcrk Bor\u00e7lar Kanunu\u2019nun bu maddesi, konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131 i\u00e7in \u00f6zel h\u00fck\u00fcm niteli\u011findedir. Bunlar d\u0131\u015f\u0131nda kalan kira s\u00f6zle\u015fmelerinde bu madde uygulanmaz.<\/p>\n<h1 style=\"text-align: justify;\"><span style=\"text-decoration: underline;\"><strong>Yeni Ev Ald\u0131m Kirac\u0131 \u00c7\u0131km\u0131yor\u00a0<\/strong><\/span><\/h1>\n<p style=\"text-align: justify;\">Kanun, ta\u015f\u0131nmaz\u0131 edinen ki\u015finin kendisinin, e\u015finin, altsoyunun (\u00e7ocuklar, torunlar vs.), \u00fcstsoyunun (anne, baba, b\u00fcy\u00fckanne, b\u00fcy\u00fckbaba vs.) ve kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filerin ihtiya\u00e7lar\u0131na tahliyenin talep edilmesi bak\u0131m\u0131ndan sonu\u00e7 ba\u011flar. Bu ihtiya\u00e7, konut bak\u0131m\u0131ndan olabilece\u011fi gibi i\u015fyeri bak\u0131m\u0131ndan da mevcut olabilir. Yarg\u0131tay i\u00e7tihatlar\u0131nda, bu ihtiyac\u0131n samimi olmas\u0131 gerekti\u011fini bir\u00e7ok kez vurgulam\u0131\u015ft\u0131r. \u00d6rne\u011fin, kira s\u00f6zle\u015fmesine konu ta\u015f\u0131nmaz\u0131 kullanmaya ihtiyac\u0131 oldu\u011fu iddia edilen ki\u015finin, ayn\u0131 veya daha iyi ko\u015fullarda kullanabilece\u011fi ba\u015fka bir ta\u015f\u0131nmaz mevcutsa ve buna ra\u011fmen kiralanan\u0131n tahliyesi talep ediliyorsa, bu durumda samimi bir ihtiya\u00e7tan bahsedilemez.<\/p>\n<h1 style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Yeni Ev Ald\u0131m Kirac\u0131y\u0131 Nas\u0131l \u00c7\u0131karabilirim ?<\/span><\/strong><\/h1>\n<p style=\"text-align: justify;\">\u00d6ncelikle yeni ev sahibi (malik), kendisinin veya maddede say\u0131lan di\u011fer ki\u015filerin ihtiyac\u0131n\u0131 samimi \u015fekilde ispat edebiliyor olsun. \u0130spat\u0131ndan emin olan yeni ev sahibi kirac\u0131ya bildirim yapmal\u0131d\u0131r. Bildirim yapmadan dava yoluna gidilemeyecektir.<\/p>\n<p style=\"text-align: justify;\">\u0130lk olarak, kiralanan\u0131 iktisap etti\u011fi tarihten ba\u015flayarak 1 ay i\u00e7inde yaz\u0131l\u0131 olarak kirac\u0131ya durumu bildirmelidir. Bu bildirimin sonu\u00e7 do\u011furabilmesi i\u00e7in 1 ayl\u0131k s\u00fcre i\u00e7erisinde bu bildirimin kirac\u0131n\u0131n eline ula\u015fm\u0131\u015f olmas\u0131 gerekir. Yaz\u0131l\u0131 \u015fekil \u015fart\u0131n\u0131n kar\u015f\u0131lanmas\u0131 i\u00e7in bildirimin noter arac\u0131l\u0131\u011f\u0131yla yap\u0131lmas\u0131 \u015fart olmamakla birlikte, 1 ayl\u0131k s\u00fcreye uyulmas\u0131 ve ispat a\u00e7\u0131s\u0131ndan kolayl\u0131k sa\u011flayacakt\u0131r. Yoksa bildirimin ge\u00e7erli olabilmesi i\u00e7in yaln\u0131z yaz\u0131l\u0131 \u015fekilde yap\u0131lmas\u0131 yeterlidir.<\/p>\n<p style=\"text-align: justify;\">Bu bildirimin yap\u0131lmas\u0131ndan sonra kanun davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in 6 ayl\u0131k bir s\u00fcre belirlemi\u015ftir. Bu 6 ay\u0131n ne zaman ba\u015flayaca\u011f\u0131 konusunda kanunda a\u00e7\u0131kl\u0131k bulunmamakla birlikte, uygulamada devrin ger\u00e7ekle\u015fti\u011fi tarih esas al\u0131n\u0131r. Dikkat edilirse, burada uygulanan, yukar\u0131daki maddenin 1. f\u0131kras\u0131ndaki usuld\u00fcr. Bu f\u0131kra h\u00fckm\u00fc uygulan\u0131rken, s\u00f6zle\u015fmenin kalan s\u00fcresinin 6 aydan uzun veya k\u0131sa olmas\u0131 \u00f6nem arz etmez. Dava her halde iktisap tarihinden en az 6 ay sonra a\u00e7\u0131lacakt\u0131r. O halde, kira s\u00f6zle\u015fmesinin kalan s\u00fcresinin 6 aydan k\u0131sa oldu\u011fu hallerde, bu f\u0131kra h\u00fckm\u00fc yerine 2. f\u0131kra h\u00fckm\u00fcn\u00fcn uygulanmas\u0131 yeni malik a\u00e7\u0131s\u0131ndan daha elveri\u015fli olacakt\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u015eimdi de 2. f\u0131kra h\u00fckm\u00fcn\u00fc inceleyelim. Buna g\u00f6re yeni malik, dilerse s\u00f6zle\u015fmenin bitiminden itibaren 1 ay i\u00e7inde a\u00e7aca\u011f\u0131 dava yoluyla da s\u00f6zle\u015fmeyi sona erdirebilir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere bu f\u0131kra h\u00fckm\u00fc, ayr\u0131ca bir bildirim yap\u0131lmas\u0131n\u0131 gerekli g\u00f6rmemi\u015ftir. \u015eimdi de 351. maddenin uygulanmas\u0131 bak\u0131m\u0131ndan bir \u00f6rnek verelim.<\/p>\n<p style=\"text-align: justify;\">04.09.2021 tarihinde sona erecek olan kira s\u00f6zle\u015fmesine konu ta\u015f\u0131nmaz 01.07.2021 tarihinde yeni malik taraf\u0131ndan iktisap edilmi\u015f olsun. Bu durumda iktisap tarihiyle s\u00f6zle\u015fmenin sona erme tarihi aras\u0131nda yakla\u015f\u0131k 2 ayl\u0131k bir s\u00fcre bulunmaktad\u0131r. O zaman 2. F\u0131kra h\u00fckm\u00fcne g\u00f6re 04.09.2021 tarihinden itibaren 1 ay i\u00e7erisinde, yani 04.10.2021 tarihine kadar ilgili davan\u0131n a\u00e7\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Ayr\u0131ca bir bildirim yap\u0131lmas\u0131na gerek yoktur. Bu halde dahi 01.08.2021 tarihine kadar yap\u0131lacak yaz\u0131l\u0131 bildirimle 01.01.2022 tarihinden itibaren 1. f\u0131kra h\u00fckm\u00fcne g\u00f6re dava a\u00e7\u0131lmas\u0131 imkan dahilindedir. G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, hangi f\u0131kra h\u00fckm\u00fcn\u00fcn uygulanaca\u011f\u0131 somut olay\u0131n \u015fartlar\u0131na g\u00f6re yeni malik taraf\u0131ndan belirlenebilir.<\/p>\n<p style=\"text-align: justify;\">Elbette kiralayan tarafta tek bir ki\u015fi mevcut ise, bildirim bu ki\u015fiye yap\u0131lacak ve a\u00e7\u0131lacak dava bu ki\u015fiye kar\u015f\u0131 ikame edilecektir. Ancak birden fazla kiralayan\u0131n oldu\u011fu durumlarda bildirim her bir ki\u015fiye ayr\u0131 ayr\u0131 yap\u0131lmal\u0131 ve daval\u0131 tarafta kirac\u0131lardan her biri bulunmal\u0131d\u0131r. Kiralanan ta\u015f\u0131nmaz\u0131n aile konutu olarak kullan\u0131lmas\u0131 durumunda da s\u00f6z konusu bildirim hem kirac\u0131ya hem de e\u015fine ayr\u0131 ayr\u0131 yap\u0131lmal\u0131d\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong><span style=\"text-decoration: underline;\">Dikkat Edilmesi Gereken Hususlar<\/span><\/strong><\/h1>\n<p style=\"text-align: justify;\">Tahliye talepli davay\u0131 a\u00e7an yeni malik, bu davay\u0131 kazanmas\u0131 ve ta\u015f\u0131nmaz\u0131 tahliye ettirmesi durumunda, belirli bir s\u00fcre i\u00e7in bu ta\u015f\u0131nmaz\u0131 nas\u0131l kullanaca\u011f\u0131na dikkat etmelidir. Zira 3 y\u0131ll\u0131k s\u00fcre ge\u00e7meden, tahliye edilen ta\u015f\u0131nmaz\u0131n ba\u015fka bir ki\u015fiye kiraya verilmesi durumunda, yeni malikin hakk\u0131n\u0131 k\u00f6t\u00fcye kullanm\u0131\u015f oldu\u011fu iddias\u0131yla tazminat talep edilmesi m\u00fcmk\u00fcnd\u00fcr. T\u00fcrk Bor\u00e7lar Kanunun ilgili maddesini birlikte inceleyelim.<\/p>\n<p style=\"text-align: justify;\"><em>Madde 355 \u2013 Kiraya veren, gereksinim amac\u0131yla kiralanan\u0131n bo\u015falt\u0131lmas\u0131n\u0131 sa\u011flad\u0131\u011f\u0131nda, hakl\u0131 sebep olmaks\u0131z\u0131n, kiralanan\u0131 \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e eski kirac\u0131s\u0131ndan ba\u015fkas\u0131na kiralayamaz.<\/em><\/p>\n<p style=\"text-align: justify;\">Yeniden in\u015fa ve imar amac\u0131yla bo\u015falt\u0131lmas\u0131 sa\u011flanan ta\u015f\u0131nmazlar, eski h\u00e2li ile, hakl\u0131 sebep olmaks\u0131z\u0131n \u00fc\u00e7 y\u0131l ge\u00e7medik\u00e7e ba\u015fkas\u0131na kiralanamaz. Eski kirac\u0131n\u0131n, yeniden in\u015fa ve imar\u0131 ger\u00e7ekle\u015ftirilen ta\u015f\u0131nmazlar\u0131, yeni durumu ve yeni kira bedeli ile kiralama konusunda \u00f6ncelik hakk\u0131 vard\u0131r. Bu hakk\u0131n, kiraya verenin yapaca\u011f\u0131 yaz\u0131l\u0131 bildirimi izleyen bir ay i\u00e7inde kullan\u0131lmas\u0131 gerekir; bu \u00f6ncelik hakk\u0131 sona erdirilmedik\u00e7e, ta\u015f\u0131nmaz \u00fc\u00e7 y\u0131l ge\u00e7meden ba\u015fkas\u0131na kiralanamaz.<\/p>\n<p style=\"text-align: justify;\">Kiraya veren, bu h\u00fck\u00fcmlere ayk\u0131r\u0131 davrand\u0131\u011f\u0131 takdirde, eski kirac\u0131s\u0131na son kira y\u0131l\u0131nda \u00f6denmi\u015f olan bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminat \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p style=\"text-align: justify;\">\u0130htiya\u00e7 sebebiyle kiralanan\u0131 tahliye ettiren ve hen\u00fcz 3 y\u0131l ge\u00e7meden eski kirac\u0131dan ba\u015fkas\u0131yla s\u00f6zle\u015fme akdeden yeni malik bak\u0131m\u0131ndan 1. ve 3. f\u0131kra h\u00fck\u00fcmleri uygulama alan\u0131 bulur. Bu durumda malik aleyhine son kira y\u0131l\u0131nda \u00f6denmi\u015f olan bir y\u0131ll\u0131k kira bedelinden az olmamak \u00fczere tazminata h\u00fckmedilebilir. Yeni malik ancak hakl\u0131 sebeplerin varl\u0131\u011f\u0131n\u0131 iddia ederek tazminat \u00f6demekten kurtulabilir.
