Konutun sat\u0131lmas\u0131nda m\u00fclkiyet ve zilyetli\u011fin devri s\u00f6z konusu oldu\u011fu i\u00e7in T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 207\/1 ve 210. maddeleri de uygulanacakt\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong>\u00d6n \u00d6demeli Konut Sat\u0131\u015f\u0131nda Sat\u0131c\u0131n\u0131n Devir ve Teslim Borcu<\/strong><\/h1>\n<p style=\"text-align: justify;\">\u00d6n \u00f6demeli konut sat\u0131\u015f\u0131, sat\u0131\u015f s\u00f6zle\u015fmesinin bir t\u00fcr\u00fc oldu\u011fundan dolay\u0131 sat\u0131c\u0131n\u0131n asli borcu konutun m\u00fclkiyetinin ve zilyetli\u011finin devridir. Konutun sadece m\u00fclkiyet veya zilyetli\u011finin devredilmesi durumunda sat\u0131c\u0131n\u0131n borcu gere\u011fi gibi yerine getirdi\u011fi s\u00f6ylenemez. Yap\u0131lan in\u015faat\u0131n ortak alanlar\u0131n\u0131n veya eklentilerinin eksik olmas\u0131na ra\u011fmen tapunun al\u0131c\u0131ya devredilmesi borcun gere\u011fi gibi ifa edilmedi\u011fini g\u00f6sterir. Tam bir ifadan bahsedebilmek i\u00e7in, kat m\u00fclkiyeti tapusuyla beraber in\u015faat\u0131 tamamlanm\u0131\u015f bir yap\u0131n\u0131n zilyetli\u011finin devriyle m\u00fcmk\u00fcnd\u00fcr. Aksi halde sat\u0131c\u0131 borcunu eksik ifa etmi\u015f olacakt\u0131r.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Konutun Teslim S\u00fcresi<\/strong><\/h1>\n<p style=\"text-align: justify;\">T\u00fcketicinin Korunmas\u0131 Hakk\u0131nda Kanun&#8217;un 44. maddesine g\u00f6re; <em>&#8220;\u00d6n \u00f6demeli konut sat\u0131\u015f\u0131nda devir veya teslim s\u00fcresi s\u00f6zle\u015fme tarihinden itibaren otuz alt\u0131 ay\u0131 ge\u00e7emez. Kat irtifak\u0131n\u0131n t\u00fcketici ad\u0131na tapu siciline tescil edilmesiyle birlikte zilyetli\u011fin devri h\u00e2linde de devir ve teslim yap\u0131lm\u0131\u015f say\u0131l\u0131r.&#8221;\u00a0<\/em><\/p>\n<p style=\"text-align: justify;\">Sat\u0131c\u0131 36 ay i\u00e7inde borcunu kanunda belirtilen \u015fekliyle k\u0131smen ifa etmelidir. Borcun kalan k\u0131sm\u0131 i\u00e7in sat\u0131c\u0131 ile t\u00fcketici aralar\u0131nda farkl\u0131 bir vade belirleyebilir. Bu durumda sat\u0131c\u0131n\u0131n 36 ay i\u00e7inde ifa edece\u011fi k\u0131sm\u0131n i\u00e7eri\u011finin belirtilmesi gerekir.<\/p>\n<p style=\"text-align: justify;\">Sat\u0131c\u0131n\u0131n 36 ayda yapmas\u0131 gereken, konutu fiilen t\u00fcketiciye kullan\u0131m\u0131 i\u00e7in sunmakt\u0131r. Fiilen kullan\u0131mdan kas\u0131t, konutun oturmaya elveri\u015fli olmas\u0131, konutun b\u00fct\u00fcn eklenti ve ortak kullan\u0131m alanlar\u0131 da dahil olmak \u00fczere, eksiksiz olarak tamamland\u0131\u011f\u0131 durumlarda kat m\u00fclkiyetine ge\u00e7i\u015fte herhangi bir engelin kalmamas\u0131d\u0131r. \u00d6n \u00f6demeli konut sat\u0131\u015f\u0131 s\u00f6zle\u015fmesi kat irtifakl\u0131 tapulu konutlar i\u00e7in yap\u0131labilece\u011fi gibi kat m\u00fclkiyetli tapular\u0131 hakk\u0131nda da yap\u0131labilir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kat M\u00fclkiyetli Konutlar\u0131n Teslimi<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kat m\u00fclkiyetli konutlar, yap\u0131m\u0131 tamamlanm\u0131\u015f, yap\u0131 kullan\u0131m belgesi (iskan belgesi) al\u0131nm\u0131\u015f olan konutlard\u0131r.<\/p>\n<p style=\"text-align: justify;\">Kat m\u00fclkiyetli konut tapuda yap\u0131lan \u00f6n \u00f6demeli konut sat\u0131\u015f\u0131 s\u00f6zle\u015fmesiyle t\u00fcketiciye devredilebilir. M\u00fclkiyet al\u0131c\u0131 ki\u015fiye ge\u00e7ti\u011fi i\u00e7in art\u0131k 36 ayl\u0131k vadeden s\u00f6z edilemez. Konutun zilyetli\u011finin devri konusunda ise taraflar bir vade kararla\u015ft\u0131rabilir. Ancak bu kararla\u015ft\u0131r\u0131lacak vade 36 aydan fazla olamayacakt\u0131r. \u00c7\u00fcnk\u00fc konutun in\u015fas\u0131 ne kadar s\u00fcrerse s\u00fcrs\u00fcn 36 aydan fazla olamaz.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Kat \u0130rtifakl\u0131 Konutlar\u0131n Teslimi<\/strong><\/h1>\n<p style=\"text-align: justify;\">Kat irtifakl\u0131 konutlar, kat m\u00fclkiyetine konu olmak \u00fczere in\u015fa edilecek veya edilmekte olan konutlard\u0131r. Kat irtifak\u0131 tapuda devredilebilir. Bu sebeple \u00f6n \u00f6demeli konut sat\u0131\u015f\u0131 s\u00f6zle\u015fmesine konu olabilirler.<\/p>\n<p style=\"text-align: justify;\">Kat irtifak\u0131 ba\u015fta tapuda al\u0131c\u0131ya devredilmi\u015fse, 36 ayl\u0131k s\u00fcre t\u00fcketicinin kullan\u0131m\u0131na uygun konutun do\u011frudan zilyetli\u011finin devrine konu olacakt\u0131r. \u00d6n s\u00f6zle\u015fmesinin yap\u0131lmas\u0131yla birlikte kat irtifak\u0131 devredilmesiyse hem kat irtifak\u0131 hem de oturulabilecek konutun zilyetli\u011finin devri 36 ayl\u0131k s\u00fcreye tabidir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Sat\u0131c\u0131n\u0131n Konutu Zaman\u0131nda Teslim Etmemesi\u00a0<\/strong><\/h1>\n<p style=\"text-align: justify;\">\u00d6n \u00f6demeli konut sat\u0131\u015f\u0131nda sat\u0131c\u0131n\u0131n konutun m\u00fclkiyetini ve zilyetli\u011fini zaman\u0131nda devretmemesi durumunda sat\u0131c\u0131 ki\u015fi temerr\u00fcde d\u00fc\u015fecektir. Zaman\u0131nda ifa edilmemesinin yapt\u0131r\u0131m\u0131 T\u00fcketicinin Korunmas\u0131 Hakk\u0131nda Kanunda &#8220;ay\u0131p&#8221; i\u00e7inde konu edinmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">Sat\u0131c\u0131 ki\u015finin temerr\u00fcde d\u00fc\u015fmesi i\u00e7in 3 durumun ger\u00e7ekle\u015fmesi gerekir. Bunlar:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Sat\u0131c\u0131n\u0131n borcunun ifas\u0131 m\u00fcmk\u00fcn olmal\u0131<\/li>\n<li>Sat\u0131c\u0131n\u0131n borcunun muaccel olmas\u0131<\/li>\n<li>Al\u0131c\u0131n\u0131n sat\u0131c\u0131ya temerr\u00fct ihtar\u0131nda bulunmas\u0131<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">gerekir.<\/p>\n<p style=\"text-align: justify;\">Peki, al\u0131c\u0131 sat\u0131c\u0131ya ne zaman ihtarda bulunmas\u0131 gerekir ?<\/p>\n<p style=\"text-align: justify;\">\u00d6n \u00f6demeli konut sat\u0131\u015f\u0131nda taraflar borcun vadesini serbest\u00e7e kararla\u015ft\u0131rabilirler. Ancak kat irtifak\u0131 ve konutun kullan\u0131labilir halde t\u00fcketiciye 36 ay i\u00e7inde zilyetli\u011finin devredilmesi gerekir.<\/p>\n<p style=\"text-align: justify;\">\u00d6rne\u011fin; taraflar\u0131n 48 ay vade belirlemesi durumunda, 36 ay i\u00e7inde sat\u0131c\u0131, al\u0131c\u0131ya kat irtifak\u0131 ve kullan\u0131ma uygun konutun zilyetli\u011fini devretmesi gerekir. Sat\u0131c\u0131, borcun kalan k\u0131sm\u0131 i\u00e7in ise 48 ay\u0131n dolmas\u0131yla temerr\u00fcde d\u00fc\u015fecektir. Bu durumda t\u00fcketici, sat\u0131c\u0131ya temerr\u00fct ihtar\u0131nda bulunmal\u0131d\u0131r.<\/p>\n<p style=\"text-align: justify;\">\u00d6n \u00f6demeli konut sat\u0131\u015f\u0131nda t\u00fcketicinin sat\u0131c\u0131ya kural olarak temerr\u00fct ihtar\u0131nda bulunmas\u0131 gerekir. \u00c7\u00fcnk\u00fc sat\u0131c\u0131 ve al\u0131c\u0131 belirli bir vade kararla\u015ft\u0131rmak zorunda de\u011fildir.\u00a0 Borcun ifas\u0131 i\u00e7in belirli bir vade kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131 durumlarda temerr\u00fct ihtar\u0131na gerek yoktur. Ancak taraflar konutun teslim tarihini kararla\u015ft\u0131rmak zorundad\u0131rlar. Konut teslim tarihi olmayan s\u00f6zle\u015fmeler \u015fekle ayk\u0131r\u0131l\u0131ktan dolay\u0131 h\u00fck\u00fcms\u00fcz kalacakt\u0131r. (T\u00fcrk Bor\u00e7lar Kanunu 12 ve 27. madde). Ancak bu ge\u00e7ersizlik t\u00fcketici (al\u0131c\u0131) aleyhine ileri s\u00fcr\u00fclemeyecektir. Vadenin belirlenmedi\u011fi durumlarda ifa zaman\u0131 kanunda belirtilen en \u00fcst s\u00fcre olan 36 ay olacakt\u0131r. Bu s\u00fcrenin ge\u00e7mesiyle birlikte sat\u0131c\u0131 ihtar gerekmeksizin temerr\u00fcde d\u00fc\u015fecektir.<\/p>\n<h1 style=\"text-align: justify;\"><strong>Sat\u0131c\u0131n\u0131n Konutu Zaman\u0131nda Teslim Etmemesinin Sonu\u00e7lar\u0131<\/strong><\/h1>\n<p style=\"text-align: justify;\">Sat\u0131c\u0131n\u0131n temerr\u00fcd\u00fc halinde kanun (T\u00fcrk Bor\u00e7lar Kanunun 125. md.) t\u00fcketiciye 3 se\u00e7imlik hak tan\u0131m\u0131\u015ft\u0131r:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Aynen ifa istemeye devam ederek gecikme zarar\u0131n\u0131n tazminini istemek,<\/li>\n<li>S\u00f6zle\u015fmeden d\u00f6nerek menfi zarar\u0131n tazminini istemek,<\/li>\n<li>\u0130fadan vazge\u00e7erek m\u00fcspet zarar\u0131n\u0131 istemek<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Sat\u0131c\u0131n\u0131n temerr\u00fcde d\u00fc\u015fmesinde kusurlu olmas\u0131 gerekmez. Al\u0131c\u0131 yukar\u0131da say\u0131lan 3 haktan istedi\u011fini kullanabilir. Temerr\u00fct kusura ba\u011fl\u0131 olmasa da tazminat kusura ba\u011fl\u0131d\u0131r.
