Bu yaz\u0131m\u0131zda bu kurallara de\u011finece\u011fiz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin \u00c7al\u0131\u015fma Saatleri<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00c7al\u0131\u015fma s\u00fcresi, i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 i\u015fte ge\u00e7irdi\u011fi s\u00fcredir. \u0130\u015f\u00e7inin g\u00fcnl\u00fck ve haftal\u0131k \u00e7al\u0131\u015fma s\u00fcreleri ile ilgili bilgiye a\u015fa\u011f\u0131dan bakabilirsiniz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin G\u00fcnl\u00fck \u00c7al\u0131\u015fma Saati<\/strong><\/h2>\n<p style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi<\/strong> hi\u00e7bir \u015fekilde 11 saati a\u015famaz. Yarg\u0131tay, yeni tarihli kararlar\u0131nda bu y\u00f6nde bir anla\u015fman\u0131n i\u015f\u00e7i ile i\u015fveren aras\u0131nda yaz\u0131l\u0131 \u015fekilde yap\u0131lmas\u0131n\u0131 aramaktad\u0131r. Ayr\u0131ca g\u00fcnl\u00fck \u00e7al\u0131\u015fman\u0131n ba\u015flama ve biti\u015f saatleri ile dinlenme saatleri i\u015fverenlerce i\u015f\u00e7ilere duyurulur. \u0130\u015fin niteli\u011fine g\u00f6re i\u015fin ba\u015flama ve biti\u015f saatleri i\u015fveren taraf\u0131ndan farkl\u0131 \u015fekilde d\u00fczenlenebilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin Haftal\u0131k \u00c7al\u0131\u015fma Saati<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin haftal\u0131k \u00e7al\u0131\u015fma saati ne kadar? \u0130\u015f\u00e7inin haftal\u0131k \u00e7al\u0131\u015fma saati <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.4857.pdf\">\u0130\u015f Kanunu<\/a>\u2019na g\u00f6re haftada en \u00e7ok 45 saattir. \u0130\u015f s\u00f6zle\u015fmelerinde aksine bir d\u00fczenleme yoksa \u00e7al\u0131\u015fma s\u00fcresi, haftan\u0131n \u00e7al\u0131\u015f\u0131lan g\u00fcnlerine bu en \u00e7ok 45 saatlik s\u00fcre e\u015fit \u00f6l\u00e7\u00fcde b\u00f6l\u00fcnerek uygulan\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin \u00c7al\u0131\u015fma Saatlerinin De\u011fi\u015ftirilmesi<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin \u00e7al\u0131\u015fma saatlerinde de\u011fi\u015fiklik yap\u0131labilir mi?<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fveren, i\u015f s\u00f6zle\u015fmesiyle veya i\u015f s\u00f6zle\u015fmesinin eki niteli\u011findeki personel y\u00f6netmeli\u011fi ve benzeri kaynaklar ya da i\u015fyeri uygulamas\u0131yla olu\u015fan \u00e7al\u0131\u015fma ko\u015fullar\u0131nda esasl\u0131 bir de\u011fi\u015fikli\u011fi ancak durumu i\u015f\u00e7iye yaz\u0131l\u0131 olarak bildirmek suretiyle yapabilir. Bu \u015fekle uygun olarak yap\u0131lmayan ve i\u015f\u00e7i taraf\u0131ndan alt\u0131 i\u015fg\u00fcn\u00fc i\u00e7inde yaz\u0131l\u0131 olarak kabul edilmeyen de\u011fi\u015fiklikler i\u015f\u00e7iyi ba\u011flamaz. \u0130\u015f\u00e7i de\u011fi\u015fiklik \u00f6nerisini bu s\u00fcre i\u00e7inde kabul etmezse, i\u015fveren de\u011fi\u015fikli\u011fin ge\u00e7erli bir nedene dayand\u0131\u011f\u0131n\u0131 veya fesih i\u00e7in ba\u015fka bir ge\u00e7erli nedenin bulundu\u011funu yaz\u0131l\u0131 olarak a\u00e7\u0131klamak ve bildirim s\u00fcresine uymak suretiyle i\u015f s\u00f6zle\u015fmesini feshedebilir. \u0130\u015f\u00e7i bu durumda 17 ila 21 inci madde h\u00fck\u00fcmlerine g\u00f6re dava a\u00e7abilir. Taraflar aralar\u0131nda anla\u015farak \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131 her zaman de\u011fi\u015ftirebilir. \u00c7al\u0131\u015fma ko\u015fullar\u0131nda de\u011fi\u015fiklik ge\u00e7mi\u015fe etkili olarak y\u00fcr\u00fcrl\u00fc\u011fe konulamaz. (\u0130\u015f Kanunu 22. madde)<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin \u00c7al\u0131\u015fma Saatlerini Kendi Belirlemesi<\/strong><\/h2>\n<p style=\"text-align: justify;\">G\u00fcnl\u00fck \u00e7al\u0131\u015fman\u0131n ba\u015flama ve biti\u015f saatlerini\u00a0<b>i\u015fveren, y\u00f6netim hakk\u0131 \u00e7er\u00e7evesinde belirleyebilir<\/b>. Di\u011fer bir ifadeyle i\u015f\u00e7inin bu saatleri belirleme konusunda yetkisi bulunmamaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">Ancak i\u015f\u00e7i ve i\u015fveren aras\u0131nda imzalanan i\u015f s\u00f6zle\u015fmesinde i\u015f\u00e7inin \u00e7al\u0131\u015fma saatlerini kendi belirleyebilir \u015feklinde anla\u015fma yap\u0131labilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin \u00c7al\u0131\u015fma Saatlerine Uymamas\u0131\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin \u00e7al\u0131\u015fma s\u00fcrelerine uymamas\u0131 halinde i\u015fveren i\u015f s\u00f6zle\u015fmesini hakl\u0131 nedenle derhal feshedebilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin \u00c7al\u0131\u015fma S\u00fcresinden Say\u0131lan Haller<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin \u00e7al\u0131\u015fma s\u00fcrelerini ve g\u00fcnl\u00fck azami 11 saati hesaplarken hem fiilen \u00e7al\u0131\u015f\u0131lan s\u00fcreyi hem de fiili bir \u00e7al\u0131\u015fma olmasa bile a\u015fa\u011f\u0131da say\u0131lan s\u00fcreleri dahil etmek gerekir. \u0130\u015f Kanunu\u2019na g\u00f6re a\u015fa\u011f\u0131daki s\u00fcreler i\u015f\u00e7inin g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcrelerinden say\u0131l\u0131r:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Madenlerde, ta\u015f ocaklar\u0131nda yahut her ne \u015fekilde olursa olsun yer alt\u0131nda veya su alt\u0131nda \u00e7al\u0131\u015f\u0131lacak i\u015flerde i\u015f\u00e7ilerin kuyulara, dehlizlere veya as\u0131l \u00e7al\u0131\u015fma yerlerine inmeleri veya girmeleri ve bu yerlerden \u00e7\u0131kmalar\u0131 i\u00e7in gereken s\u00fcreler<\/li>\n<li>\u0130\u015f\u00e7ilerin i\u015fveren taraf\u0131ndan i\u015fyerlerinden ba\u015fka bir yerde \u00e7al\u0131\u015ft\u0131r\u0131lmak \u00fczere g\u00f6nderilmeleri halinde yolda ge\u00e7en s\u00fcreler.<\/li>\n<li>\u0130\u015f\u00e7inin i\u015finde ve her an i\u015f g\u00f6rmeye haz\u0131r bir halde bulunmakla beraber \u00e7al\u0131\u015ft\u0131r\u0131lmaks\u0131z\u0131n ve \u00e7\u0131kacak i\u015fi bekleyerek bo\u015f ge\u00e7irdi\u011fi s\u00fcreler. \u00d6rne\u011fin bir garson m\u00fc\u015fteri yokken servis yap\u0131p \u00e7al\u0131\u015famayaca\u011f\u0131 i\u00e7in bu bo\u015fta ge\u00e7en s\u00fcre de \u00e7al\u0131\u015f\u0131lm\u0131\u015f say\u0131l\u0131r.<\/li>\n<li>\u0130\u015f\u00e7inin i\u015fveren taraf\u0131ndan ba\u015fka bir yere g\u00f6nderilmesi veya i\u015fveren evinde veya b\u00fcrosunda yahut i\u015fverenle ilgili herhangi bir yerde me\u015fgul edilmesi suretiyle as\u0131l i\u015fini yapmaks\u0131z\u0131n ge\u00e7irdi\u011fi s\u00fcreler.<\/li>\n<li>\u00c7ocuk emziren kad\u0131n i\u015f\u00e7ilerin \u00e7ocuklar\u0131na s\u00fct vermeleri i\u00e7in g\u00fcnde 1,5 saatlik s\u00fcre.<\/li>\n<li>Demiryollar\u0131, karayollar\u0131 ve k\u00f6pr\u00fclerin yap\u0131lmas\u0131, korunmas\u0131 ya da onar\u0131m ve tadili gibi, i\u015f\u00e7ilerin yerle\u015fim yerlerinden uzak bir mesafede bulunan i\u015fyerlerine hep birlikte getirilip g\u00f6t\u00fcr\u00fclmeleri gereken her t\u00fcrl\u00fc i\u015flerde bunlar\u0131n toplu ve d\u00fczenli bir \u015fekilde g\u00f6t\u00fcr\u00fcl\u00fcp getirilmeleri esnas\u0131nda ge\u00e7en s\u00fcreler.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Ancak, i\u015fin niteli\u011finden do\u011fmay\u0131p da i\u015fveren taraf\u0131ndan s\u0131rf sosyal yard\u0131m amac\u0131yla i\u015fyerine g\u00f6t\u00fcr\u00fcl\u00fcp getirilme esnas\u0131nda ara\u00e7larda ge\u00e7en s\u00fcre \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lmaz.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin \u0130zin Haklar\u0131\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin izin kullanma hakk\u0131 \u0130\u015f Kanunu 53. maddede belirtilmi\u015ftir.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin izin hakk\u0131 ne zaman do\u011far? \u0130\u015fyerinde i\u015fe ba\u015flad\u0131\u011f\u0131 g\u00fcnden itibaren, deneme s\u00fcresi de i\u00e7inde olmak \u00fczere, en az bir 1 \u00e7al\u0131\u015fm\u0131\u015f olan i\u015f\u00e7ilere y\u0131ll\u0131k \u00fccretli izin verilir.<\/p>\n<p style=\"text-align: justify;\">Y\u0131ll\u0131k \u00fccretli izine hak kazanmak i\u00e7in gerekli s\u00fcrenin hesab\u0131nda i\u015f\u00e7ilerin, ayn\u0131 i\u015fverenin bir veya \u00e7e\u015fitli i\u015fyerlerinde \u00e7al\u0131\u015ft\u0131klar\u0131 s\u00fcreler birle\u015ftirilerek g\u00f6z \u00f6n\u00fcne al\u0131n\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin \u0130zin S\u00fcreleri\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7ilere verilecek y\u0131ll\u0131k \u00fccretli izin s\u00fcresi:<\/p>\n<ul style=\"text-align: justify;\">\n<li>1-5 y\u0131l aras\u0131 (be\u015f y\u0131l dahil) \u00e7al\u0131\u015fm\u0131\u015f olan ki\u015filer i\u00e7in 14 g\u00fcnden,<\/li>\n<li>5 y\u0131ldan fazla 15 y\u0131ldan az \u00e7al\u0131\u015fm\u0131\u015f ki\u015filer i\u00e7in 20 g\u00fcnden,<\/li>\n<li>15 y\u0131l (dahil) ve daha fazla \u00e7al\u0131\u015fm\u0131\u015f ki\u015filer i\u00e7in 26 g\u00fcnden,<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Az olamaz.\u00a0 Yer alt\u0131 i\u015flerinde \u00e7al\u0131\u015fan i\u015f\u00e7ilerin y\u0131ll\u0131k \u00fccretli izin s\u00fcreleri d\u00f6rder g\u00fcn artt\u0131r\u0131larak uygulan\u0131r. Ancak onsekiz ve daha k\u00fc\u00e7\u00fck ya\u015ftaki i\u015f\u00e7ilerle elli ve daha yukar\u0131 ya\u015ftaki i\u015f\u00e7ilere verilecek y\u0131ll\u0131k \u00fccretli izin s\u00fcresi yirmi g\u00fcnden az olamaz. Y\u0131ll\u0131k izin s\u00fcreleri i\u015f s\u00f6zle\u015fmeleri ve toplu i\u015f s\u00f6zle\u015fmeleri ile art\u0131r\u0131labilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin Haftal\u0131k \u0130zin Hakk\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin hafta tatili hangi g\u00fcnd\u00fcr?\u00a0\u0130\u015f\u00e7iyi 7 g\u00fcnl\u00fck zaman dilimi i\u00e7erisinde mutlaka en az 24 saatlik bir dinlenme yani hafta tatili sa\u011flanmal\u0131d\u0131r. Yasal s\u00fcrelere uygun olarak 6 i\u015f g\u00fcn\u00fc \u00e7al\u0131\u015fan i\u015f\u00e7i, 7. g\u00fcn\u00fc hafta tatili olarak al\u0131r. Burada hafta tatili i\u00e7in Pazar veya Pazartesi vb. g\u00fcnleri kastetmiyoruz. Hafta tatili g\u00fcn\u00fcn\u00fcn ne olaca\u011f\u0131 i\u015fe g\u00f6re de\u011fi\u015fir. \u00d6rne\u011fin, vardiyal\u0131 \u00e7al\u0131\u015f\u0131lan yerlerde b\u00fct\u00fcn y\u0131l belirli bir tatil g\u00fcn\u00fc olmayabilir.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015fveren, 7. g\u00fcn gelmedi diye i\u015f\u00e7inin i\u015f s\u00f6zle\u015fmesini feshedemez. S\u00f6zle\u015fmedeki \u201ci\u015f\u00e7i hafta i\u00e7i veya hafta sonu gelmekle y\u00fck\u00fcml\u00fcd\u00fcr\u201d \u015feklindeki h\u00fckme ra\u011fmen 7. g\u00fcn gelmezse i\u015fverenin yapabilece\u011fi bir \u015fey yoktur. S\u00f6zle\u015fme feshedilirse haks\u0131z fesih olur.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Yarg\u0131tay\u2019a G\u00f6re Hafta Tatili 24 Saatten Azsa Tatil Verilmemi\u015f Say\u0131l\u0131r:<\/strong><\/h3>\n<p style=\"text-align: justify;\">\u201cHafta tatili izni kesintisiz en az 24 saattir. Bunun alt\u0131nda bir s\u00fcre haftal\u0131k izin verilmesi durumunda, usul\u00fcne uygun \u015fekilde hafta tatili izni kulland\u0131\u011f\u0131ndan s\u00f6z edilemez. Ayr\u0131ca, hafta tatili b\u00f6l\u00fcnerek kulland\u0131r\u0131lamaz. Buna g\u00f6re hafta tatilinin 24 saatten az olarak kulland\u0131r\u0131lmas\u0131 halinde hafta tatili hi\u00e7 kulland\u0131r\u0131lmam\u0131\u015f say\u0131l\u0131r.\u201d (Yarg\u0131tay Karar\u0131 &#8211; 9. HD., E. 2010\/796 K. 2010\/14544 T. 25.05.2010)<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin \u0130zin G\u00fcn\u00fc \u00c7al\u0131\u015ft\u0131r\u0131lmas\u0131\u00a0<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin hafta tatilinde \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 halinde\u00a0ayn\u0131 fazla \u00e7al\u0131\u015fmalar gibi\u00a0<b>y\u00fczde 50 zaml\u0131 \u00f6denmelidir<\/b>. Ancak, buradaki hesaplama fazla \u00e7al\u0131\u015fmalardakinden farkl\u0131d\u0131r. \u0130\u015f\u00e7i, 46. madde uyar\u0131nca, hafta tatili g\u00fcn\u00fcnde \u00e7al\u0131\u015fmadan dahi 1 g\u00fcnl\u00fck \u00fccrete hak kazanmaktad\u0131r. Hafta tatilinde \u00e7al\u0131\u015fan i\u015f\u00e7i toplamda 2.5 g\u00fcnl\u00fck bir \u00fccret kazanacakt\u0131r. Hafta tatilinde \u00e7al\u0131\u015fma \u00fccreti hesaplama \u00d6rne\u011fin; g\u00fcnl\u00fck 500 TL ye \u00e7al\u0131\u015fan bir i\u015f\u00e7i hafta tatilinde \u00e7al\u0131\u015fmas\u0131 durumunda 1250 TL almas\u0131 gerekir.<\/p>\n<p style=\"text-align: justify;\">Resmi tatilde \u00e7al\u0131\u015fan i\u015f\u00e7inin \u00fccreti nas\u0131l hesaplan\u0131r? \u0130\u015f\u00e7i resmi tatilde \u00e7al\u0131\u015f\u0131rsa ayr\u0131ca bir <strong>g\u00fcnl\u00fck<\/strong> <b>\u00fccret <\/b>daha \u00f6denecektir. Kanun&#8217;da \u00e7al\u0131\u015fman\u0131n ne kadar s\u00fcreyle olup olmad\u0131\u011f\u0131na ili\u015fkin bir s\u0131n\u0131rlama getirilmemi\u015ftir. Dolay\u0131s\u0131yla resmi tatilde <strong>bir<\/strong>\u00a0<b>saat<\/b>\u00a0de \u00e7al\u0131\u015f\u0131lsa <strong>7,5<\/strong>\u00a0<b>saat<\/b>\u00a0de \u00e7al\u0131\u015f\u0131lsa kar\u015f\u0131l\u0131\u011f\u0131 <strong>bir g\u00fcnl\u00fck<\/strong>\u00a0<b>\u00fccret<\/b> olacakt\u0131r. Yani\u00a0<b>br\u00fct \u00fccreti g\u00fcnl\u00fck 2.000 TL olan bir i\u015f\u00e7inin resmi tatillerde br\u00fct \u00fccreti 2 ile \u00e7arp\u0131l\u0131r<\/b>. Bu durumda da g\u00fcnl\u00fck br\u00fct \u00fccreti <strong>4.000 TL<\/strong> olacakt\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin Gece \u00c7al\u0131\u015fmas\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u00c7al\u0131\u015fma hayat\u0131nda &#8220;gece&#8221; en ge\u00e7 saat 20.00&#8217;de ba\u015flayarak en erken saat 06.00&#8217;ya kadar ge\u00e7en d\u00f6nemdir. Bir \u00e7al\u0131\u015fman\u0131n gece \u00e7al\u0131\u015fmas\u0131 say\u0131labilmesi i\u00e7in vardiyan\u0131n yar\u0131s\u0131ndan fazlas\u0131n\u0131n 20.00 &#8211; 06.00 aral\u0131\u011f\u0131na denk gelmesi laz\u0131md\u0131r. \u00d6rne\u011fin 12.00-21.00 aras\u0131 ge\u00e7e \u00e7al\u0131\u015fmas\u0131 de\u011fildir.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin gece \u00e7al\u0131\u015fma s\u00fcresi ne kadar? \u0130\u015f\u00e7ilerin gece \u00e7al\u0131\u015fmalar\u0131 <strong>yedi bu\u00e7uk saati<\/strong> ge\u00e7emez. Yani bir posta gece \u00e7al\u0131\u015fmas\u0131 yapt\u0131ysa (en fazla 2 hafta) sonraki hafta veya gece \u00e7al\u0131\u015fmas\u0131 yapt\u0131\u011f\u0131 2 haftada g\u00fcnd\u00fcz \u00e7al\u0131\u015fmas\u0131 yapmas\u0131 zorunludur.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin s\u00fcrekli gece vardiyas\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 durumunda i\u015f s\u00f6zle\u015fmesinin i\u015f\u00e7i taraf\u0131ndan hakl\u0131 sebeple feshi g\u00fcndeme gelir ve i\u015f\u00e7i k\u0131dem, ihbar tazminatlar\u0131yla birlikte di\u011fer t\u00fcm i\u015f\u00e7ilik alacaklar\u0131n\u0131 da almaya hak kazan\u0131r.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin Telafi \u00c7al\u0131\u015fmas\u0131<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f Kanunu\u2019na g\u00f6re, zorunlu nedenlerle i\u015fin durmas\u0131, ulusal bayram ve genel tatillerden \u00f6nce veya sonra i\u015fyerinin tatil edilmesi veya benzer nedenlerle i\u015fyerinde normal \u00e7al\u0131\u015fma s\u00fcrelerinin \u00f6nemli \u00f6l\u00e7\u00fcde alt\u0131nda \u00e7al\u0131\u015f\u0131lmas\u0131 veya tamamen tatil edilmesi ya da i\u015f\u00e7inin talebi ile kendisine izin verilmesi hallerinde, i\u015fveren iki ay i\u00e7inde \u00e7al\u0131\u015f\u0131lmayan s\u00fcreler i\u00e7in telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131rabilir. Bu \u00e7al\u0131\u015fmalar fazla \u00e7al\u0131\u015fma veya fazla s\u00fcrelerle \u00e7al\u0131\u015fma say\u0131lmaz.<\/p>\n<p style=\"text-align: justify;\">Telafi \u00e7al\u0131\u015fmalar\u0131, g\u00fcnl\u00fck en \u00e7ok \u00e7al\u0131\u015fma s\u00fcresini a\u015fmamak ko\u015fulu ile g\u00fcnde \u00fc\u00e7 saatten fazla olamaz. G\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresinin i\u00e7inde i\u015f\u00e7ilere dinlenmeleri ve yemek, i\u00e7mek gibi ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamalar\u0131 i\u00e7in dinlenme s\u00fcreleri verilmesi zorunludur.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin Dinlenme S\u00fcresi<\/strong><\/h2>\n<p style=\"text-align: justify;\">Dinlenme s\u00fcreleri \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lmaz.\u00a0 \u00d6rne\u011fin, sabah 09.00 Ak\u015fam 19.00 \u00e7al\u0131\u015fan i\u015f\u00e7iye 1 saat \u00f6\u011fle aras\u0131 dinlenme s\u00fcresi verilmi\u015fse her ne kadar 10 saat ge\u00e7mi\u015f olsa da i\u015f\u00e7inin \u00e7al\u0131\u015fma s\u00fcresi 9 saat olarak de\u011ferlendirilir. Bunun \u00f6n\u00fcne ge\u00e7ebilmek i\u00e7in i\u015f s\u00f6zle\u015fmeleri ile dinlenme s\u00fcresinin de i\u015f \u00e7al\u0131\u015fma s\u00fcresine dahil edilmesi sa\u011flanabilir.<\/p>\n<h2 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7inin Dinlenme S\u00fcreleri T\u00fcrleri<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f Kanunu\u2019na g\u00f6re, g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresinin ortalama bir zaman\u0131nda o yerin gelenekleri ve i\u015fin gere\u011fine g\u00f6re ayarlanmak suretiyle i\u015f\u00e7ilere dinlenme s\u00fcreleri verilmesi zorunludur.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f\u00e7inin dinlenme s\u00fcrelerini <a href=\"https:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.4857.pdf\">\u0130\u015f Kanunu<\/a> \u015fu \u015fekilde belirlemi\u015ftir:<\/p>\n<ul style=\"text-align: justify;\">\n<li>4 saat veya daha k\u0131sa s\u00fcreli i\u015flerde 15 dakika,<\/li>\n<li>4 saatten fazla ve 7,5 saate kadar (7,5 saat d\u00e2hil) s\u00fcreli i\u015flerde 30 dakika,<\/li>\n<li>7,5 saatten fazla s\u00fcreli i\u015flerde 1 saat.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Bu dinlenme s\u00fcreleri asgari olup i\u015f\u00e7iye aral\u0131ks\u0131z verilir. Ancak dinlenme s\u00fcrelerinde de \u00e7al\u0131\u015f\u0131lm\u0131\u015fsa ve bu \u00e7al\u0131\u015fmayla birlikte haftal\u0131k 45 saat a\u015f\u0131lm\u0131\u015fsa, i\u015fveren fazla \u00e7al\u0131\u015fman\u0131n da \u00fccreti \u00f6demelidir.<\/p>\n<p style=\"text-align: justify;\">Dinlenme s\u00fcreleri bir i\u015fyerinde i\u015f\u00e7ilere kar\u015f\u0131 ayn\u0131 veya de\u011fi\u015fik saatlerde kulland\u0131r\u0131labilir. Yani n\u00f6betle\u015fe bir kullan\u0131m s\u00f6z konusu olabilecektir. Son olarak s\u0131kl\u0131kla kar\u015f\u0131la\u015f\u0131ld\u0131\u011f\u0131 gibi bir i\u015f\u00e7i \u201cBizde dinlenme s\u00fcresi yok, \u00f6\u011fle tatili var\u201d derse, asl\u0131nda yukar\u0131da belirtilen dinlenme s\u00fcrelerini kastetmi\u015f olur.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Ulusal Bayram ve Genel Tatil G\u00fcnlerinde \u00c7al\u0131\u015fma<\/strong><\/h2>\n<p style=\"text-align: justify;\">\u0130\u015f Kanunu\u2019na g\u00f6re ulusal bayram ve genel tatil g\u00fcnlerinde i\u015fyerlerinde \u00e7al\u0131\u015f\u0131l\u0131p \u00e7al\u0131\u015f\u0131lmayaca\u011f\u0131 toplu i\u015f s\u00f6zle\u015fmesi veya i\u015f s\u00f6zle\u015fmeleri ile kararla\u015ft\u0131r\u0131l\u0131r. Kad\u0131n i\u015f\u00e7inin erken do\u011fum yapmas\u0131 halinde ise do\u011fumdan \u00f6nce kullanamad\u0131\u011f\u0131 \u00e7al\u0131\u015ft\u0131r\u0131lmayacak s\u00fcreler, do\u011fum sonras\u0131 s\u00fcrelere eklenmek suretiyle kulland\u0131r\u0131l\u0131r.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Erkek \u0130\u015f\u00e7ilerin Do\u011fum \u0130zni Kullanabilmesi M\u00fcmk\u00fcn M\u00fcd\u00fcr?<\/strong><\/h3>\n<p style=\"text-align: justify;\">Erkek i\u015f\u00e7inin de do\u011fum izni kullanabilmesi m\u00fcmk\u00fcnd\u00fcr. Do\u011fumda veya do\u011fum sonras\u0131nda annenin \u00f6l\u00fcm\u00fc h\u00e2linde, do\u011fum sonras\u0131 kullan\u0131lamayan s\u00fcreler babaya kulland\u0131r\u0131l\u0131r.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Evlat Edinen \u0130\u015f\u00e7ilerin De \u0130zin Kullanabilmesi M\u00fcmk\u00fcn M\u00fcd\u00fcr?<\/strong><\/h3>\n<p style=\"text-align: justify;\">3 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f \u00e7ocu\u011fu evlat edinen e\u015flerden birine veya evlat edinene, \u00e7ocu\u011fun aileye fiilen teslim edildi\u011fi tarihten itibaren 8 hafta izin kulland\u0131r\u0131l\u0131r.<\/p>\n<h3 style=\"text-align: justify;\"><strong>\u0130\u015f\u00e7ilerin Do\u011fum \u0130zninden Sonra \u00dccretsiz \u0130zin Kullanabilmeleri M\u00fcmk\u00fcn M\u00fcd\u00fcr?<\/strong><\/h3>\n<p style=\"text-align: justify;\">Yukar\u0131da de\u011findi\u011fimiz gibi kullan\u0131lan do\u011fum sonras\u0131 anal\u0131k hali izninin bitiminden itibaren \u00e7ocu\u011fun hayatta olmas\u0131 kayd\u0131yla, kad\u0131n i\u015f\u00e7iye (anneye) birinci do\u011fumda 60 g\u00fcn, ikinci do\u011fumda 120 g\u00fcn, sonraki do\u011fumlarda ise 180 g\u00fcn s\u00fcreyle haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin yar\u0131s\u0131 kadar \u00fccretsiz izin verilir. \u00c7o\u011ful do\u011fum h\u00e2linde bu s\u00fcrelere 30 g\u00fcn eklenir. \u00c7ocu\u011fun engelli do\u011fmas\u0131 halinde bu s\u00fcre 360 g\u00fcn olarak uygulan\u0131r. Bu \u00f6ng\u00f6r\u00fclen s\u00fcreler i\u015f\u00e7inin sa\u011fl\u0131k durumuna ve i\u015fin \u00f6zelli\u011fine g\u00f6re do\u011fumdan \u00f6nce ve sonra gerekirse art\u0131r\u0131labilir.<\/p>\n<h3 style=\"text-align: justify;\"><strong>Kad\u0131n \u0130\u015f\u00e7ilerin S\u00fct \u0130zinleri<\/strong><\/h3>\n<p style=\"text-align: justify;\">Kad\u0131n i\u015f\u00e7ilere 1 ya\u015f\u0131ndan k\u00fc\u00e7\u00fck \u00e7ocuklar\u0131n\u0131 emzirmeleri i\u00e7in g\u00fcnde toplam 1,5 saat s\u00fct izni verilir. Bu s\u00fcreyi i\u015fyeri i\u00e7inde ya da d\u0131\u015f\u0131nda ge\u00e7irebilir. \u0130\u015fyerinde ge\u00e7irmesi ve bu s\u00fcre i\u00e7inde \u00e7al\u0131\u015fmaya devam etmesi durumunda ara dinlenmesi verilmemi\u015f say\u0131l\u0131r. Ancak i\u015f\u00e7i i\u015fyerinde kalsa bile, ara dinlenmesi s\u00fcresini serbest\u00e7e kullanabilir, bu s\u00fcre i\u00e7inde \u00e7al\u0131\u015fmaya zorlanamaz. Bu nedenle \u00f6ncelikle i\u015f\u00e7inin vardiyal\u0131 \u00e7al\u0131\u015f\u0131p \u00e7al\u0131\u015fmad\u0131\u011f\u0131, ara dinlenmesini i\u015fyerinde i\u015fin niteli\u011fi gere\u011fi fiilen \u00e7al\u0131\u015farak ge\u00e7irip ge\u00e7irmedi\u011fi belirlenmelidir. Davac\u0131 tan\u0131klar\u0131 davac\u0131n\u0131n ara dinlenme s\u0131ras\u0131nda i\u015fyerinde bulundu\u011funu belirtmi\u015f ise de i\u015fyerinde bulunman\u0131n nedenini ve i\u015fyerinde bulunman\u0131n gerekli olup olmad\u0131\u011f\u0131 konusunda her hangi bir a\u00e7\u0131klamada bulunmam\u0131\u015flard\u0131r. Mevcut delillerle bir sonuca varma olana\u011f\u0131 g\u00f6r\u00fclmemektedir.
